3、双方职责

3、2 乙方职责:

4、施工与工程设计变更

4、1 乙方在施工中要根据国家颁发得施工验收规范与质量检验标准,以及设计要求进行,要
求全部工程达到合格标准。

4、3 在施工中,若甲方a有变更设计文件得要求,应书面通知乙方;若乙方发现设计文件有错误或严重不合理得地方,也应书面通知甲方,双方商定并修改设计文件与图纸后方可继续施工。

4、4 在施工过程中,如遇下列情况,需顺延工期,双方应及时进行协商,并通过书面形式确定顺延期限:

a.因天灾或人力不能抗拒得原因被迫停工得;

5、竣工验收与售后服务

5、1 乙方必须严格执行隐蔽工程验收制度,凡隐蔽工程完成后,必须经过验收并作好记录(隐蔽工程指墙内、吊顶内得管线施工等)。
5、3 工程验收合格后进入质保期。质保期为验收合格之日起12个月。在质保期内,乙方应对系统除人为因素外得所有故障负责免费维修或更换。

6、技术服务与培训

6、1 由乙方按技术培训大纲负责对甲方得有关操作人员与维修人员进行使用级培训。通过培训,使甲方得受训人员能掌握系统设备得配置,能进行正确操作与日常维护及一般常见故障
排查。接受培训得人员由甲方确定,日期由甲乙双方共同商定。
6、2 在保修期内,乙方提供两次上门巡检服务,包括各系统运行状况得查瞧、记录,以及必
要得设备维护。

materials, party a has the right to terminate the contract
and asks for loss from party b、

14.warranty
14.1.warranty scope: as state in the contract、

第二条:政府批复

2、1 乙方负责协助甲方办理此项施工需要办理得所有政府报批,包括但不仅限于消防、环保得报批与其她与本工程相关得报批,甲方负责政府行政审批得费用。

2、2 乙方负责其工程报备

2、3 乙方应承担2、2所述报备不全而导致得政府罚金,并且不能顺延工期。
第三条:甲方得权利与义务

3、1 向乙方提供经确认得施工图纸或做法说明五份,并向乙方进行现场交底,向乙方提供施工所需要得水电设备,并说明使用注意事项。

3、2 指派xxxx为甲方驻工地代表,负责合同得履行。对工程质量、进度进行监督检查,办理验收、变更事宜。甲方得工地代表如果认为乙方得某雇员行为不当或散漫不羁,或甲方认为该雇员不能胜任,则乙方应立即进行撤换,并且未经甲方实现书面许可,乙方不得在施工中再行雇佣该等人员。被撤换得任何人员应尽可以能立即由甲方代表所批准得胜任得人员代替。

3、5 甲方有权要求乙方按照甲方得组织设计与施工工期进行施工,乙方如对甲方得要求与指令不予执行得,则按照乙方违约处理,乙方应承担违约责任。

3、6 甲方有权要求乙方服从甲方得统一安排与管理,乙方得施工人员必须遵守各项规章制度。对于乙方施工人员违规操作所产生得后果,乙方承担全部责任。甲方有权从工程总价款中扣除相应得款项。

3、7 甲方所有得通知可以以书面或口头形式发出,乙方接获甲方得通知后应根据通知规定得内容执行。

3、9 甲方有权制定专业分包商,并按照乙方在投标文件中承诺得配合管理费率向乙方支付配合管理费。
