在本合同中以先生为公司代表Employee______ ______________ ___ (hereinafter referred to as “The Employee”), ID Number:乙方___( 以下称作“乙方”)身份证号码：2 Employment雇佣关系2.1 The Company hereby offers formal employment to the Employee, and the Employeehereby agrees to be employed by the Company, with the work area of technicalsupport, in accordance with the terms and conditions set forth in this Contract, theJob Description and the Remuneration Scheme annexed to this Contract and theEmployee Handbook. A clean release from the Employee's previous employer isrequired; otherwise the Company holds the right to revoke this offer.依照本合同及其附属的工作描述与报酬表以及公司员工手册中所列的条款和要求，甲方正式雇佣乙方，乙方同意接受雇佣。
乙方的工作范围属于技术服务相关的各种事务。
乙方必须与前雇主完全脱离雇佣关系，否则甲方有权撤回要约。
3 Duration and probation period合同期和试用期3.1 This Contract, signed by the Company and the Employee, shall continuefrom , for a period of years(hereinafter referred to as “TheTerm”), unless the Contract is earlier terminated in accordance with its provisions.本合同由甲方和乙方共同签订。
除非其因合同相关条款的规定而提前终止，合同有效期（以下称为“合同期”）将从年月日起持续至年月日,为期年。
3.2 The Employee shall be required to undergo a period of probation of 3 months.(Employees who renew contracts are exceptions if agreed to by the Company).乙方应当履行为期三个月的试用期。
（乙方经甲方同意续签合同的情况除外）3.3 The Company may dismiss the Employee at any time during, or at the end of, theprobationary period if the Company considers that the Employee's performancecannot satisfy the recruitment conditions or the standards in the job descriptionduring the probationary period. If the Company considers that the Employee'sperformance has been satisfactory during the probationary period, the Employeeshall become a regular employee of the Company in accordance with the terms ofthis Contract, and the probation period will be within the contract term.在试用期中的任何时间或试用期末，甲方如果认为乙方的表现没有达到雇佣的条件或工作描述的标准，可以随时解雇乙方。
如果甲方对乙方在试用期间的表现满意，则根据合同条款乙方将成为甲方的正式员工，并将试用期计入合同期内。
3.4 Execution of this Labor Contract shall terminate at its expiration. At least 30 daysprior to the scheduled expiration of the Term, the Company shall offer the Employeea renewal of the Contract if the Company intends to renew the Contract. If theCompany offers to renew the Contract, the Employee shall accept or refuse therenewal prior to the expiration of the Term. In the event that the Employee fails torespond prior to the expiration of the Term, the Employee shall be deemed to haverefused to renew the Contract.inor atheshalltheofto乙方有权享受法定节假日、年假和其他不时生效的相关法律及甲方工作规章所规定的带薪假期。
有关合同生效日起假期的条款请参照本合同所附的报酬表。
5 Remuneration劳动报酬5.1 The monthly salary of the Employee during his/her probationary period shall be asset forth in the Remuneration Scheme. After the satisfactory completion of theprobationary period, the Company will conduct an assessment of the Employee’stechnical level, work attitude and efficiency etc. Thereafter the Company maychange the wage of the Employee from time to time based on the performance of theEmployee.乙方在试用期内的月薪将在报酬表中列明。
如果乙方在试用期的表现令甲方满意，甲方将对其技术水平、工作态度、效率水平等进行评估。
此后，甲方可根据乙方的表现适时对其工资进行调整。
5.2 It is stipulated that during period of legal holidays and Marriage or BereavementLeaves and legal participation in social activities, the Company shall pay the wage.乙方在法定休假日和婚丧假期间以及依法参加社会活动期间，甲方依法支付工资。
5.3 As for other subsidy and allowance of the Employee, the Company shall conduceThe7 Work condition and labor protection劳动条件与劳动保护7.1 The Company shall strictly observe rules and standards of P.R.C on occupationalsafety and hygiene and regulations on working hours, rest and holiday system as wellas special protections on female employees; and provide occupational safety andhealth conditions conforming to relevant provision of P.R.C and necessary articles toensure the Employee will be safe and healthy during process of production or work.If the Employee is to be engaged in work with occupational hazards, regular medicalcheck should be provided.甲方严格执行国家劳动安全卫生规程和标准、工作时间和休息、休假制度及女职工特殊保护规定，为乙方提供符合国家规定的劳动安全卫生条件和必要的劳动保护用品，保障乙方在工作（生产）过程的安全和健康。
如安排乙方从事职业危害的作业，需对乙方定期进行健康检查。
7.2 The Employee must strictly abide by rules of safe operations during working process,and has the right to refuse peccant command.乙方在生产过程中必须严格遵守安全操作规程，并有权拒绝违章指挥。
