基于乙方完全理解其所应聘甲方的岗位/职位的工作性质、特点和要求,以及工作环境和条件,根据

《中华人民共和国劳动法》(以下简称“《劳动法》”)、《中华人民共和国劳动合同法》(以下简称“《劳动合同法》”)及其它相关中国现行法律法规的有关规定,双方在合法、公平、平等自愿、协商一致、诚实信用

的基础上,签订本合同。双方在此同意,公司雇佣员工为其全日制职工,且双方之间的劳动关系受劳动法

律以及公司不时修订的在公司人力资源部门保存的公司员工手册和其他各项内部规章制度的约束(下称

“公司内部规章”)。

Based on Party B fully understanding the occupation’s description, character and requirement provided by Party

Republic of China and other relevant laws and regulations (together A, under the Labor Law of the People’s

referred to as “Labor Laws”), Party A and Party B have reached this Contract of their free will on the basis of equal consultation, and agreed to comply with all provisions as stipulated in this Contract. Both parties confirm that, Party B is a full-time employee of Party A and obeys Labor Laws; Employee Handbooks signed by Party B

, referred to as “Company internal and kept by HR department, any and all Party A’s other regulations (“together

Regulation”).

1. 定义和解释

1. Definition and Explanation

1.1 甲方的关联企业:在本合同中指控制甲方或被甲方所控制的、或与甲方共同受控制于同一实体的任何

企业。控制是指直接或间接拥有该企业百分之五十(50%)以上的股权、投票权或管理权。为明确起见,

双方特此确认甲方关联企业包括但不限于[]。

1.1 Party A’s Affiliate(s): means any legal entity that directly or indirectly controls another entity via

beneficial ownership of more than fifty percent (50%) of voting power or equity in another entity ("Control"),

or is Controlled by another entity or is under common Control with another entity, so long as such Control exists. More clear, both parties confirm that Party A‘sAffiliate(s) is including but not limited __________

1.2 商业秘密:在本合同中指:(a)甲方或甲方的关联企业拥有的或者与甲方或甲方的关联企业实际或

者预期的商业活动、研究和发展有关的未向社会公开的非公开信息、技术资料(包括但不限于设计、程序、产品配方、制作工艺或者公式、技术、设计、技术图示和图纸、工程方案、硬件配置信息)、经营资料(包括但不限于经营决策、客户名单、管理诀窍、供货渠道、销售渠道)、公司的客户(包括但不限于那些在

乙方受聘期间乙方曾经交往和熟悉的客户)、财务资料(包括但不限于销售额、营业数额)、人事资料(包括但不限于公司组织结构、员工工资)、商业交易秘密或者KNOW-HOW(包括但不限于研发计划、产品

计划、任何与公司的产品、服务和市场相关的其他信息)和/或其他任何可能对甲方或甲方的关联企业的

经济利益或竞争优势造成影响的资料;(b)甲方或甲方的关联企业必须对第三方承担保密责任的任何资

料。

1.2 Confidential Information: (a) means any information, technical data, or know-how considered confidential by

Party A or Party A’s Affiliate(s), including but not limited to, research, products, software, services, development, inventions, processes, specifications, designs, drawings, diagrams, engineering, marketing, techniques, mask works, design tapes, documentation, customer and supplier information, pricing information, procedures, data, concepts, and financial, marketing, sales, manufacturing, operational, strategic planning, budgeting and other information disclosed by Party A or Party A’s Affiliate(s), which is

in case of disclosure in any tangible form and which is clearly marked or identified as “Confidential” 

clearly designated as confidential at the time of disclosure and thereafter reduced to a written summary within thirty (30) days in case of disclosure in any intangible form.(b)any and all information or documents that Party A or Party A’s Affiliate(s) should keep confidential to the third party.

2. 聘用期限、劳动报酬

2. Term of Labor Contract, Remuneration of Labor

2.1 甲方聘用乙方的合同种类、期限、试用期、工资计算方式、具体数额、工作地点、职位、工作内容及

职责范围详见本合同附件—:《员工聘用期限/薪资/工作说明表》。

2.1 Labor Contract type, period, probation period, salary calculation, the amount, working place, title, job description and responsibility will refer to the Attachment one (“Employee Job period/ Salary/ Job Description Form) of this Labor contract.

2.2 乙方同意根据附件一的相关规定从事相应的岗位工作并领取工资,附件一中的工资数额为税前工资

数额,甲方需依法为乙方代扣代缴由此产生的个人所得税。

2.2 Party B agrees to work and get the salary from Attachment one, the amount showed in the attachment 1 is before-tax salary and that Party A will deduct the income tax for Party B according to the laws.

2.3 甲方应每月日前以货币(人民币)形式足额支付乙方工资。在法定工作时间内,乙方完成甲方

规定的合理工作任务的,月工资不得低于本市规定的职工月最低工资标准。甲方安排乙方加班或延长工作

时间,应根据国家及本市有关规定,按公司加班政策支付报酬。

2.3 Party A should pay the salary to Party B with the RMB currency form. In the legal working hour, Party B

should finish the reasonable and according job, the salary of each month should not is low than the lowest

salary standard of the local. If Party A arranges Party B to overtime work or extend the working time, Party

A should pay the according allowance based on laws and regulation of the country and the local.

3. 社会保险、休息休假及福利待遇

3. Social Insurance/ Rest and Holiday/ Welfare

3.1 甲方按照相关法律法规的规定为乙方缴纳社会保险费,其中乙方个人应承担的部分,由甲方按月在乙

方的工资中代扣代缴。

3.1 Party A will pay for all mandatory social insurance according to the relevant government and city regulations,

and deduct the parts that need to be paid by Party B from Party’s salary of each month.

3.2 乙方患职业病、因工负伤或非因工负伤时其工资和医疗待遇按国家有关规定执行。

3.2 During the period of occupational disease, work-related injury and non-work related injury, Party B’s salary

and medical welfare will be paid according to relevant regulation of government.

3.3 乙方依法享受国家法定的节假日、婚假、产假、丧假等,详细情况见甲方有关规定。公司的生活福

利政策,见甲方的有关规定。

3.3 Party B is entitled to official holiday, marriage leave, maternity leave, funeral leave and so on, the detail

please refer to Party’s relevant regulation. Party B’s welfare policy will be described in the relative regulation.

4. 工作时间、工作安排、加班认定及调岗调薪

4. Work Hour/ Job Arrangement/ Overtime Work cognizance/ Adjustment of occupation and salary

4.1乙方应当遵循甲方的工作时间制度:具体请参看甲方的《员工手册》、《考勤管理实施办法》等相关规

定。

4.1 Party B should obey Party A’s work hour policy, the detail please refer to Party A’s Employee Handbook,

attendance policy and so on.

4.2 甲方可以根据生产和工作需要及乙方的能力和表现合理调整乙方的工作,乙方愿意服从甲方的管理和

安排。

4.2 Party A can adjust Party B’s occupation based on the need of product and job, and Party B’s ability and

4.3 乙方加班须根据甲方的《员工手册》及《加班管理办法》等相关规章制度规定的内容执行。

4.3 Overtime work of Party B should be carried out based on Party B’s Employee

policy and other relative regulations.

4.4 乙方在日常工作中应按照公司的要求工作。按时完成规定的合理工作数量,达到规定的质量标准。

甲方可根据工作需要、雇员的绩效表现及身体状况可以调整雇员的工作岗位,并根据合同约定实行变岗变

薪制度。

4.4 Party B should work as Party A’s request and meet Party A’s request from the amount and quality standard.

Party A can adjust the employee’s occupation based on job need, employee’s performance and b and the salary will be changed accordingly.

5. 商业秘密

5. Confidential Information

5.1 除非事先经过甲方董事会批准,或因乙方履行在甲方的职务所必须披露外,乙方不得将其从甲方或甲

方的关联企业取得或获悉的商业秘密以任何方式提供给其他任何第三方,也不得将该等商业秘密向社会公开,亦不得为非工作的目的而私自使用该等商业秘密。

5.1 Unless getting prior Party A’s director approval, or the disclosure purpose of fulfilling Party A’s occupation, Party is prohibited to disclose the Confidential Information to any third party by any method, to disclose to public and to use it for the non-work purpose.

5.2 在本合同终止之后,乙方在本条款下的保密义务并不随之终止,乙方仍需遵守保密条款,履行其所承诺的保密义务,直到甲方同意其解除此项义务,或事实上不会因违反本保密条款而给甲方或甲方的关联企

业造成任何形式的损害时为止。

5.2 This Confidentiality liability of Party B shall survive the termination or expiration of this Labor Contract.

5.3 乙方在聘用期限内编制的、使用或持有的、与甲方或甲方的关联企业秘密有关的任何文件(包括所有往来书信、客户名单、笔记、备忘录、计划、图纸和其他性质文件)、模具及样本均属于甲方或甲方的关

联企业所有。如甲方或甲方的关联企业要求,乙方应立即将上述任何文件、资料或软件,交还甲方或甲方

的关联企业,并且不得以任何方式继续保留、保存、拥有或使用上述文件、资料或软件。

5.3 Any documents controlled by Party B during the Labor Contract period, which is relative with the Confidential Information, including but not limited all letters, customer list, note, memo, plan and others, model,

and sample belong to Party’s A and its Affiliate(s). Party B should immediately return them to Party A or Party

A’s Affiliate(s) if required by Party A or its Affiliate(s), and is prohibited to retain, keep, own or use them.

5.3 乙方在甲方工作其间,未经第三方(此款所谓之第三方包括乙方之前之所有雇主)和甲方的许可,不得使用任何第三方的商业秘密和其他知识产权。不得将任何第三方的商业秘密带入甲方公司。违反此规定给甲方造成的任何损失由乙方承担。甲方有权根据规章制度对乙方进行处理。

5.3 During the period of Labor Contract, without the third party including Party B’s before employer and Party A’s consent, Party B should not use any third party’s Confidential Information and intellectual property rights, not be allowed to carry any third party’s Confidential Information into Party A working place. Party B

Should compensate Party A any and all loss caused from breaching such regulation and Party A has the right to punish Party B according to Party A’s regulation.

5.5 乙方同意并承认,其根据本合同第四条和附件一中所确定的工资已经包括了任何因为乙方承担和履行

本合同项下保守商业秘密的义务而需要甲方在合同有效和解除后根据任何法律所需要向乙方支付的相关

补偿金。

5.5 Party B agrees and confirms that the salary that is described in article 4 and Attachment 1 has contained all relative compensation that need to be paid for obeying the confidentiality liability whenever during the effective period and expiration of the Labor Contract based on any laws.

6. 工作设备

6. Work Device

6.1 甲方应当向乙方提供履行职责所必须的工作设备。甲方提供乙方的工作设备只能用于与甲方业务有

关的用途,不得用于与甲方业务无关并且影响到甲方业务、利益以及规章制度的执行的任何用途。

6.1 Party A should provide the work device to Party B for the work purpose. Except for Party A’s business, this

work device is prohibited to use any other purpose that is not relative with Party A and may do harm to

Party A’s business, interest and regulation fulfill and anything

6.2 甲方有权随时对工作设备的使用情况进行检查,如发现乙方违反上述规定使用工作设备,甲方有权

终止该设备的使用,直至收回工作设备。乙方不得以工作设备中包含私人物品、个人隐私资料、软

件或其他个人财产为理由阻止甲方对工作设备行使合法的权利。

6.2 Party A has the right to supervise the work device, if any breach of using rule, Party can terminate the use of

such device at any time till return it. Party B can’t disturb Party A ‘s legal rights to this device with any personal reasons, such as it covers personal things, personal confidential information, software and other personal property.

7. 劳动保护、劳动条件及职业病危害防护

7. Labor protect/ Labor condition/ Protect on Work-related Injury

7.1 甲方保证依照法律法规规定给予乙方必要的劳动保护和职业危害保护,包括但不限于安排乙方的工作

时间及休息日符合国家规定;提供安全、卫生的工作环境,并根据工作需要,按国家规定向乙方提供劳动

保护工具和保健用品;女职工孕期、产期、哺乳期内对其提供相应的劳动保护。

7.1 Party A will defend Party B from the damage from work-related injury and provide necessary labor protect according to the government laws and regulation, including but not limited to arrange Party B’s work time and rest time based on the rule of government; provide the safe and clean work environment, provide the tool of labor protect and body health; provide the labor protect for the women employee during the pregnancy, maternity leave and feeding periods.

7.2 甲方如安排乙方从事接触职业病危害作业的工作,应事先告知乙方,并进行职业危害防范专项培训,

采取针对性的劳动防护措施,提供上岗前、在岗和离岗前职业健康检查。

7.2 Party A will prior notice Party B if any work may refer to the harm of work-related injury, provide the

prevent training and measures, and provide the body check before the work, in and after the work.

7.3乙方须遵守甲方制定的作业指导书、操作规程、劳动安全卫生制度,自觉预防事故和职业病的发生。

7.3 Party B should obey the guideline, action instruction and labor safe and health regulation, and prevent the incident and work-related injury.

8. 劳动纪律

8. Labor discipline

8.1 乙方应遵守国家的各项法律规定和甲方依法制定的各项规章制度。乙方违反劳动纪律,甲方可依据本单位的规章制度,给予必要的纪律处分以及经济处罚,包括但不限于解除本合同。

8.1 Party B should obey all government laws and regulations made by Party A. If any breach, Party A can punish Party B based on the according policy, including but not limited to terminate this labor contract.

8.2 甲方应当向乙方提供履行职责所必须的工作设备。甲方提供乙方的工作设备只能用于与甲方业务有关

的用途,不得用于与甲方业务无关并且影响到甲方业务、利益以及规章制度的执行的任何用途。(与 6.1

重复)

8.2 Party A should provide the work device to Party B for the work purpose. Except for Party A’s b

work device is prohibited to use any other purpose that is not relative with Party A and may do harm to

Party A’s business, interest and regulation fulfill and anything

8.3 甲方有权随时对工作设备的使用情况进行检查,如发现乙方违反上述规定使用工作设备,甲方有权终

止该设备的使用,直至收回工作设备。乙方不得以工作设备中包含私人物品、个人隐私资料、软件或其他

个人财产为理由阻止甲方对工作设备行使合法的权利。(与6.2重复)

8.3 Party A has the right to supervise the work device, if any breach of using rule, Party can terminate the use of

such device at any time till return it. Party B can’t disturb Party A‘slegal rights to this device with any

personal reasons, such as it covers personal things, personal confidential information, software and other

personal property.

9. 技术培训

9. Skill Training

9.1 甲方将根据需要为乙方提供基本的职业技术培训,乙方应当接受甲方安排的培训活动。

9.1 Party A may provide the basic profession skill training for Party B, and Party should accept such arrangement.

9.2 甲方为乙方提供专项培训费用,对其进行专业技术培训(包括但不限于出国培训,专业技术的外训

或内训等)的,有权与乙方签订培训协议,约定服务年限。具体事宜由双方按照法律规定在培训协议中约

定。

9.2 Party A has the right to sign the training agreement and appoint the service period with Party B if Party A

pays the training fees and provides the profession skill training, including but not limited the abroad training,

profession training or internal training. The details please refer to the training agreement signed by both parties

according to the laws.

10. 合同变更

10. Contract Change

10.1 双方经协商同意,可随时变更本合同的任何内容。包括但不限于以下情形:

10.1 After both parties negotiate and agree in good faith, any content of this Labor Contract can be changed at

any time based on the condition as below, which is including but not limited:

10.1.1 订立本合同所依据的法律、法规已经修改;

10.1.1 The applicable laws or provisions of this Labor Contract have been revised;

10.1.2 甲方的经营条件、主要业务或产权结构发生重大变化,无法继续履行本合同的;

10.1.2 A major change in Party A’s business circumstances, main business or the property frame relied

results the Labor Contract hard to perform;

10.1.3 由于任何一方当事人难以克服的客观原因致使本合同无法正常履行的;

10.1.3 The objective and insurmountable reason of any party results the Labor Contract hard to perform

normally.

10.1.4 法律规定的其他情况。

10.1.4 Other circumstances stipulated in laws or administrative statutes.

10.2 乙方同意,如果发生下列任何一种情况,甲方有权单方面对乙方的任职部门、职位、级别、工资及工

作内容进行调整;

10.2 Party B agrees, Party A can unilaterally adjust Party B’s department, title, scale, salary and job content, if:

10.2.1 乙方违反了公司规则(包括但不限于员工手册、人事管理制度、标准作业规范等)并被记大

过;

10.2.1 Party B is recorded of serious demerit because of breaching Company policy, including but not

limited Employee Handbook, HR management Policy, standard policy and so on; or

10.2.2 乙方有失职行为或被证明不能胜任本职工作;

10.2.2 Party B commits serious dereliction of duty or is incompetent and is proved to be incompetent; or

10.2.3 乙方不服从直接上级职权范围内合理的指示;

10.2.3 Party B doesn’t obey the reasonable order from his direct leader; or

10.2.4 乙方行为不当,与正当及忠诚履行职责的原则不相符;

10.2.4 Party B’s behavior is not applicable and not accordance with the principles of justice and honesty;

or

10.2.5 乙方所任职的部门或所担当的岗位因客观原因而被撤销;

10.2.5 The occupation is revoked for the objective reason; or

10.2.6 乙方因疾病、受伤或意外而无法履行其职务的时间连续超过二十个工作日或在十二个月内累

计超过三十个工作日。

10.2.6 Party B serial leave time reaches more than twenty (20) working days or thirty(30) working days

within twelve months.

11. 合同解除与终止、经济补偿金

11. Termination of Labor Contract / Economic compensation

11.1 乙方提前解除本合同,试用期内应当提前三日通知甲方,试用期后应当提前三十日以书面形式通知

甲方。

11.1 Party can terminate the Labor Contract with prior three (3) days notice to Party A in the probation period

and with prior thirty (30) days written notice to Party A.

11.2 其他关于劳动合同的解除和终止及支付经济补偿金的情形照国家和地方的有关规定执行。

11.2 Other circumstances of terminating the Labor Contracts and payment of economic compensation will refer

to the relative government laws or regulations.

11.3 乙方无论何种原因从甲方处离职的,均应依照《员工手册》的相关规定的流程及要求履行离职通知

及工作交接义务。

11.3 Whatever resignation reasons, Party B should obey the resignation procedure and request of Employee

Handbook to fulfill the liability of taking over the work.

12. 赔偿责任

12. Compensation Liability

12.1 甲方违反劳动安全和劳动保护的规定,以致发生事故,损害乙方利益的,应赔偿乙方实际受到的损失。

12.1 Party A shall compensate Party B the direct loss that caused by accidence of Party A breaching the regulation

of labor security and protection.

12.2 如乙方违反其于本合同项下的知识产权、保密、其他任何义务而给甲方造成经济损失,乙方应当赔偿甲方因此遭受的直接经济损失,双方另有约定或国家另有规定的从其约定。

12.2 Party B should compensate Party A the direct loss for Party B breaching of the liability of the intellectual property rights, confidential information and others.

13. 争议解决

13. Labor Dispute Resolution

13.1 本合同执行中如发生纠纷,甲乙双方应协商解决,协商不成时,可提请甲方所在地劳动争议仲裁委

员会仲裁解决。对仲裁裁决不服的,可向有管辖权的人民法院提起诉讼。

13.1Where a labor dispute between the parties takes place during the performance of this Contract, the parties concerned may seek for a settlement through consultation; or either party may apply to the labor dispute mediation committee of their unit for mediation. if the mediation fails and one of the parties requests for arbitration, that party may apply to the labor dispute arbitration committee for arbitration

14. 其他规定

14 Others

14.1 在双方结束劳动关系后,乙方同意甲方向乙方的新雇主发出关于乙方根据本合同应有的相关权利和

义务的通知。

14.1 After termination of the Contract, Party B agrees that Party A can send the new employer the notice about

Party B’s relative rights and liability under this Contract.

14.2 乙方同意竭尽全力遵守附件二《先前发明和原创作品透露表》、《知识产权声明》及附件三《利益冲突

指南》的规定。

14.2 Party B agrees to try his/her best to obey the attachment two (“the disclosure of former invention and

original works”, “Intellectual Property Right Disclaim”and attachment three (“Conflict of Interest Guideline”).

14.3 如果本合同中任何条款因违反法律或其他原因,可视为完全或部分无效,但不影响本合同的其余条

款的法律约束力。如本合同所依据的法律或地方法规变更,双方同意本合同中相关条款从其变更,同时,

如本合同的某些条款必须作出修改方可保持效力,则双方须同意对该条款进行最接近该条款愿意的修改。

14.3 If any one or more of the provisions contained in this Contract shall be invalid, illegal, or unenforceable in

any respect, the subject provision(s) shall be enforced to the maximum extent permissible so as to effect

the intent of the Parties. The validity, legality and enforceability of the remaining provisions contained herein shall not in any way be affected or impaired thereby. No provision of this Contract shall be amended, modified, waived, discharged or terminated other than by express written consent of both Parties. No failure or delay by any of the Parties hereto in exercising any right, power or privilege under this Contract

shall operate as a waiver thereof.

14.4 本合同的任何一方没有行使或未能及时行使本合同项下的任何权利均不应视为其放弃该权利,也不

影响该方在将来行使该权利。

14.4 Party does not exercise or delay in the exercise of its right, power or privilege under this agreement does not

constitute a waiver of such right, power or privilege, and single or partial exercise of such right, power or

privilege did not exclude any other right, power or privilege of the exercise.

14.5 双方签署本合同前任何书面协议中的约定与本合同不一致的,视为双方已经做出新的约定,均以本

合同为准。

14.5 In the event of a conflict or inconsistency between the terms of this Labor Contract and those of any written agreement from one party to the other, the terms of this Labor Contract shall be controlling.

14.6 本合同是乙方和甲方之间达成的关于本合同下所有内容的全部的同意和谅解。本合同取代任何以前

的,包括但不限于,在面试和关于重新安置工作地点时的所有书面和口头的讨论、声明。除非经甲方盖章和乙方的书面签字,本合同不得更改,本合同项下的权利也不会被放弃。任何今后关于乙方的职责、薪

资和其他收益的变化均不会影响到本合同的有效性和他的范围。

14.6 This Labor Contract sets out the entire agreement and understanding between the Parties regarding all contents contained herein and supersedes all previous discussion, arrangements and understandings, written or oral, between the Parties regarding this Labor Contract. Unless getting Party A’s stamp and Party B’s written signature, this Labor Contract can’t be revised and all rights under this Contract will be not waived. Any change with Party B’s responsibility, salary and other allowance will not influence the validity and extent of this Labor Contract.

14.7 本合同未尽事宜由双方另行协商作出补充规定。补充规定与本合同具有同等法律效力。

14.7 Both Parties can negotiate the supplement in good faith about the other contents; such supplement will have

same effectively with this Labor Contract.

14.8 本合同期限届满前15天,若乙方未收到甲方任何关于续签或终止劳动合同的通知时,则乙方有义

务提醒甲方以上事宜,也可至甲方人力资源部及时询问。

14.8 If Party B doesn’t receive the notice of extending or terminating this Labor Contract before 15 days of this Labor Contract expiration, Party B has the liability to reminder such content to Party B and can consult the relative content to HR department of Party A in time.

14.9 本合同正本壹式贰份,甲方执壹份,乙方执壹份,具有同等法律效力,双方签字盖章后生效。

14.9 This Contract shall be in force after both parties sign and stamp and executed in any number of original

contract, each of which shall be deemed an original but all of which shall constitute one and the same instrument.

社保补贴

个人缴交社保后,薪资未达本市最低工资标准的,

公司已设补贴形式补贴相关款项,使之达到最低

工资标准;如若超过本市最低工资,则不再补贴。

After employee pays the social insurance, if

employee salary is lower than the lowest salary

standard of city, Party A has offset the relative

payment by allowance and finally the total amount

of salary meets the lowest salary standard; if over

such standard, Party A will not provide any

allowance.

照《岗位聘任制度》及《岗位聘任协议》的约定另行执行。部门:

职位考核:甲方实行定期绩效评估制度,当乙方绩效评估连续两次未达到及格水平,视为不符合职位要

求,甲方安排乙方进行培训或变岗,如乙方不同意变岗,可协商解除劳动合同;如经培训或变岗后,三

个月内绩效评估仍未达到及格水平,认定为不适任,甲方有权按不适任条款与乙方解除劳动合同。

Occupation Review: Party A will carry out the performance review policy(“PRP”), if Party B’s PR reach the qualified level for twice, it will be deemed to be unqualified with this occupation, Party A will be

entitled to train or change the occupation for Party B, if Party B refuses that, both parties can negotiate to

terminate this Labor Contract; After training or changing the occupation, if PRP still doesn’t level within three months, it will be deemed to be unqualified, and Party A has the right to terminate the Labor

Contract according to the unqualified clauses.

1.乙方保证其在签署本合同及附件没有与其他用人单位之间存在任何劳动关系,并且乙方与甲方签署

合同及附件不违反其向任何第三方承担的不竞争及其他任何义务。

2.乙方保证其向甲方提供的证明乙方自身教育背景、工作经验、工作能力等情况的文件(包括但不限于

个人简历、学历证明、资格证书等)上所载的内容均属真实、准确。

2. Party B promises his/her education background, work experience and work ability so on are true and correct (including but not limited resume, Education Certification, Qualification certificate and other documents) .

3.如乙方违反上述保证,甲方有权根据规章制度对乙方进行处理,包括但不限于解除劳动合同。

3. If Party B breaches such promise, Party A can take action based on the regulation and policy, including but not limited to terminate the Labor Contract.
