In May 2006, Foxconn discovered Wang Wei(王维), its senior engineer in the quality control department, sent 42 confidential documents to a BYD employee, Zhang Jian(张健).Foxconn immediately filed a civil lawsuit in Shenzhen against BYD in June In April 2007, Wang was convicted and sentenced to nine months’ imprisonment Building on the success of this conviction, Foxconn escalated its IP court battle with BYD in Hong Kong. It stated that a number of senior managers who left for BYD in 2005 had breached their confidentiality agreements with Foxconn by applying information from confidential documents in setting up a similar production line for BYD.

Two senior managers of BYD, Si Shaoqing (司少卿) and Liu Xiangjun (柳向军), were convicted in March and April 2008 with the evidence provided by Beijing JZSC. However, BYD declared that these individuals were no longer its employees when they were sentenced and that the company had not been involved in their criminal acts. The case took a U-turn in Dec 2008. BYD stated that three officials responsible for investigating the case in Beijing JZSC had been arrested for taking bribes and for destroying and faking evidence. A former BYD employee, Zhang Chaozheng (张朝正), was also detained and charged with accepting a bribe from Foxconn-related companies and stealing BYD’s trade secrets.

PROTECTION OF IP IN CHINA
China covers a large area and has a huge population. Together with diversified subcultures in different regions, it was relatively difficult to identify breaches and effectively enforce IP laws. Another problem is local protectionism due to the involvement of top government officials in major businesses in China as many of the large companies are state owned. Bureaucratic red tape and rampant corruption were not counter-checked by non-governmental organizations or the media in China. There is a shortage of middle and upper level managers during 2000s.
