rtybshallsignaseparateentrustedpaymentauthorization withcentury21beijingregionforitsmortgageservices.a.ifpartybsatisfiesthecriteriaofgettingthemortgagel oanthroughtheexaminationofthelendingbank,thelendingbankshallremittheloaninlumpsumtothespecialse ttlementaccountopenedbypartyaatthebankinaccordancewiththeentrustedpaymentauthorization.b.incasepartybdoesnotsatisfythecriteriaofgettingthe loanthroughtheexaminationofthelendingbank,party bwillchoosethefollowingmethodsasthesolution:i)ii)3.taxesandfeesa.partyaandpartybshallpayallthetaxesandfeesrespecti velyinaccordancewithrelevantregulationsofthestatean dlocalgovernments.shallassistpartyaandpartybtocalcul aterelevanttaxesandfees.throughnegotiation,partyaan dpartybagreetobearthetaxesandfeesasfollows:foranytaxesorfeesunspecified,unclear,orchangedwitht hepolicy,partyaandpartybshallreachaconsensusdaysbeforethetitletransfer,orpartyaandpartybshallmakethepa ymentinaccordancewiththegovernmentregulation.feesincludingbutnotlimitedtopropertymanagementfee,u tilityfeesforwater,electricity,gas,telephoneandothe rsbeforethehandoverofthepropertyisconcludedshallbeb ornbypartya.andthefeesaftershallbebornbypartyb.b.pa rtyaandpartybmayentrusttopaytheaforesaidtaxesandfee sandshalltransferthepaymentproof,receiptsandinvoice sissuedbyrelevantgovernmenttothepartiesthatmakethep ayment.withindaysafterthebankdecidesnottoprovidetheloan,pa rtybshallraisetheremainingpaymentbyhimselfandpayinc ashtopartya.partybshallbearalltheexpensesoccurreddu ringthisperiod;terminatethisagreement,andpartyaandp artybshallrefundthemoneywhichhavebeenpaidtoeachothe r.partybshallbearalltheexpensesoccurredduringthispe riod.iv.titletransferagencyservicespartyaandpartybshallpreparethecertificatesandmaterialsfortitletransferandshallprovidechargeabletitletransferservicesforpa rtyaandpartybwithfees.v.handoveroftheproperty1.partyaandpartybagreethatpartyashallvacatetheprope rtdaysbeforethetitletransfer.shallassistpartyaandpa rtybcoveredbyappendixioftheagreementfromthesigningofthe agreementtothehandoverofthepropertyinaccordancewith theevaluationofthedamagedordismantleddecorationsand accessories.3.partyashallbearthepropertymanagementfeeandotherre levantfeesbeforethehandoverofthepropertyandtheaforesaidfeesshallbepaidbypartybafterthehandoveroft heproperty.4.partyaandpartybagreetoconductthetitletransferdaysaftersigningofthisagreementtakingtitlecertificatean drelevantmaterial.willinformthespecificdate.partysh allpaythetaxesandfeesfortitletransferinaccordancewi ththegovernmentregulations.vi.rightsandobligationsofpartya1.rightsofpartyaa.partyashallhavetherighttocheckpartyb’sidentification.b.partyashallhavetherighttogetdepositandpropertysal espriceasstipulatedintheagreement.c.partyashallhavetherightoflawsuituponpartyb’sbreachtothisagreement.2.dutiesofpartyab.partyashalldisclosetopartybtherealfactsaboutthepr operty,includingbutnotlimitedtotherental,collateral, leakageandotherdefectoftheproperty;c.partyashallchangeitsresidenceaddressattheproperty daysaftertitletransfer;d.partyashallcooperatewithpartybfortitletransferina timelymanner;e.partyashallguaranteeallthefacilities andaccessoriesofthepropertydescribedinappendixiarei ngoodconditionuponthehandoveroftheproperty;f.partyashallpayoffallthefeesrelatedwiththeproperty beforethehandoveroftheproperty.vii.rightsandobligationsofpartyb1.rightsofpartyba.partybshallhavetherighttocheckallthematerial,cont ractsandcertificateabouttheproperty;b.partybshallhavetherighttoinspecttheproperty;c.partybshallhavetherighttobeinformedofthefactsabou ttheproperty;d.partybshallhavetherightoflawsuitupon partya’sbreachtothisagreement.2.obligationsofpartyba.partybshallpaythedepositandsalespriceinaccordance withthestipulationofthisagreement;b.partybshallcooperatewithpartyafortitletransferina timelymanner;viii.rightsandobligationsofpartyc1.partycshallprovideagencyservicesforpartyaandparty bforsigningthisagreement,providingthesigningplace,a ndbearingtestimonyofsigningthisagreement;2.partycshallprovidepartyaandpartybrelatedmaterial, updatethemthetransactionprocessandassistthem withpropertyhandover.ix.breachoftheagreementbypartya1.partyashallrefundd oubleddeposittopartybincasethetitleofthepropertyfai lstobetransferredorthepropertyfailsto2.incasepartyafailstohandovertheaforesaidpropertyto partybwithintheperiodstipulatedintheagreement,party aandpartybagreetoadoptofthefollowingsolutions:a.partyashallpaypartyofthecollectedpaymentpardayast hedefaultfineandtheagreementshallcontinueto beeffective.b.incasethelengthofoverdueperiodexceedsdaysandparty ahasnothandedoverthepropertyortransferthepropertytitletopartyb,partybshallsendawrittennotice topartya,andpartybshallhavetherighttoterminatetheagreementwhenpartyastillfailstohandover thepropertyortransferthetitledaysafterpartybsendsoutthewrittennoticetopartya.inthiscase,partyas hallreturndoublethedeposittopartyband3.incasethereoccursanydamageonpartybastheresultthat partyafailstodisclosetopartybtherealfactsaboutthepr operty,includingbutnotlimitedtotherental,collateral ,leakageandotherdefectoftheproperty,partyaandpartyb agreetoadoptthefollowingsolutions:a.partyashallpaypartyofthepropertysalespricepardaya sthedefaultfineandtheagreementshallcontinueto beeffective.b.partyapromisestorecoverthepropertytotheconditions atisfiedbypartybwithindays,andtheagreementshallcontinuetobeeffective.otherwise,partybreserves therighttoterminatethisagreementandinthiscase,4.partyashallchangetheresidenceaddresswithindaysand shallpaytopartybasthedefaultfine.x.breachoftheagreementbypartyb2.incasepartybfailstomakethepaymentorconducttitletr ansferprocessfollowingthetimingasstipulatedinthisag reement,partyaandpartybagreetoadoptasthesolution:a.partybshallpaypartyofthedefaultpaymentpardayasthe defaultfineandtheagreementshallcontinuetobe effective.b.incasetheoverdue,partyashallsendawrittennoticetop artyb,andpartyashallhavetherighttoterminatetheagreementwhenpartybstillfailstomakethepaymentorc onducttitletransferprocessdaysafterpartybreceivesthewrittennoticefrompartya.inthiscase,party ashallreservetherightnottorefundthedepositto xi.validityoftheagreement1.theagreementshalltakeeffectonthedatewhenpartya,pa rtybandpartycsignandaffixsealstotheagreement.2.incasethecontentoftheagreementsreservedbypartyaan dpartybdisagrees,bothpartyaandpartybshallregardthe agreementreservedbypartycasthestandard.3.theagreementhasfourcopies.partya,partybandpartyck
