保险经纪人制度

篇一：保险经纪人法律制度 摘要 作为保险中介之一的保险经纪人是保险市场的重要组成部分。而我国的保险经纪人法律制度起步时间不长，还有许多问题有待解决。如何完善保险经纪人法律制度对于促进保险市场的发展有着重大意义。本论文将保险经纪人法律制度作为研究对象，力图结合英、美等保险经纪发达国家有关保险经纪人制度的法律和判例，借鉴其先进和成熟的经验，基于我国《保险法》、《合同法》、《民法通则》、《保险经纪机构管理规定》等法律、法规，提出了完善我国保险经纪人法律制度的具体构想，以期对健全我国的保险经纪人法律制度有所帮助。 本论文分为四章。 第一章介绍了经纪人和保险经纪人的概念，以及保险经纪人的分类和作用，阐述了保险经纪人制度的起源及其在世

2 12 界发达国家的发展现状，为后文具体论述保险经纪人法律制度作了宏观上的介绍和铺垫。 第二章首先从保险经纪合同的角度讨论了保险经纪合同的分类以及特点。然后分析了保险经纪人的法律地位，在这部分分析比较了在英美法，大陆法中保险经纪人的法律地位的不同，并结合我国的具体情况分析了我国保险经纪人的法律地位。同时文章用了大篇幅来阐述保险经纪人的合同行为及其在保险经纪合同中的主要权利义务。保险经纪人权利义务是本章内容的重点，首先分别讨论保险经纪人享有的基本权利和应当履行的基本义务，其次在此基础上探讨当前在我国保险经纪实务中存在却还未归入我国保险经纪法律制度的其他特殊权利和义务，提出相应的立法建议。 第三章论述了保险经纪人的监管法律制度。通过对英国、美国、日本保险经纪人的监管制度进行分析比较，总结其先进经验加以借鉴。随后对我国的保险经纪人监管法律制度作了概要介绍，对加强和完善我国保险经纪人的监管法律制度提出了一些设想。 第四章回顾了我国保险经纪人制度的发展历程，评述了我国保险经纪人法律制度的发展现状、存在的问题及问题产生的原因，对具有自身特点的海上保险经纪人制度的现状和存在的问题进行分析，进而对完善我国保险经纪人法律制度提出了一些建议。
