1、根据教育部、财政部、国家外专局《高等学校聘请外国文教专家和外籍教师的规定》、《外国文教专家工资和生活待遇管理办法》等有关文件要求,以及国家其他有关法律、法规的规定,双方本着合法、公平、平等自愿、协商一致、诚实守信的原则和友好合作的精神,自愿签订本合同并保证认真履行合同约定的各项义务。
This contract is based on the stipulations of MOE, MOF & SAFEA of China on foreign experts or teachers. Both parties, in line with the principles of legality, fairness, equality, mutual agreement, honesty, and trustworthiness, on a voluntary basis, and in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill all the obligations stipulated hereinafter.
2、本合同分为正本和附件两部分,附件中对受聘人的具体工作任务、待遇及考核等事项提出明确要求。附件是本合同不可分割的组成部分,与本合同具有同等的法律效力。
The contract itself and the appendix constitute a whole contract. Tasks assigned to Party B are written in the appendix, which shall have the same legal effect with the text of this contract.
3、合同期自年月日起至年月日止,共个月,其中第一个月为试用期。试用期内,如受聘方无法胜任工作,聘方有权解除合同。
The term of this contract shall be from (Date) to (Date), with the first month set as probation period. The total working length is calculated as ten months. In the probation period, Party A has the right to cancel this contract while Party B is incompetent for this job.
4、受聘方的薪酬待遇为:年薪人民币元(税前)及租房补贴1500元/月。每年合同工作期个月。薪酬发放方式为:按月发放,每月发放人民币元。Party B’s annual salary shall be RMB (before tax), which shall be paid by installment with RMB each time (before tax). Party A shall provide 1,500 RMB each month to Party B as accommodation subsidy (before tax).
按照国家外专局有关规定,受聘方薪酬的70%可按月兑换外汇,由受聘人根据需要自行兑换。该薪酬中包含受聘人国际及国内交通费、办理医疗保险、社会保险、居留许可等费用。其他有关待遇经双方协商后在本合同附件中明确。
70% of the salary can be converted into foreign currency on a monthly basis. The international and domestic travelling expenses, medical insurance, social insurance and residence permit fees of Party B shall be included in the salary. Please see the appendix
