劳动合同管理办法(试行)

1.0 PURPOSE(目的)

The purpose of the procedure is to establish the relation between company and staff, nail down the

rights and obligations of both sides and make the management of the labor contract regularly.

为确立公司与员工之间的劳动关系,明确劳动关系双方的权利和义务,并使劳动合同的管理有所依循,

特制定本办法。

2.0 SCOPE(范围)

It is applicable for all the signing, visa, renewing and terminating of labor contract of domestic staff.

公司全体境内员工劳动合同签订、签证、续签及终止作业均适用。

3.0 REFERENCE DOCUMENTS(参考文件)

4.0 RESPONSIBILITY(职责)

Made by Human Resources and Administration Department according to the Labor Law of the People’s

Republic of China and approved by director and manager.

由公司人力资源及行政部依据《中华人民共和国劳动法》制订,总经理/董事长核决。

7.0 PROCEDURE(程序)

7.1 Labor contract signing

劳动合同签订

7.1.1 Signing the labor contract with staff by company.

以公司为单位与员工签订劳动合同。

7.1.2 New employee signs the labor contract with the company on the same day of

registering.

新进员工于报到当日办理签订劳动合同手续。

7.1.3 Contract shall be signed in the principle of equality, unconstraint and following the

principle of consensus. The most important is that it shall not violate the national laws

and regulations.

公司与员工签订劳动合同应遵循平等自愿、协商一致的原则,双方签订的劳动合同不得

违反国家法律、行政法规的规定。

7.1.4 Ways to sign the labor contract :

劳动合同签订方式:

The unified contract is used as the labor contract. As for the visa and number of

the labor contract, they are operated according to the regulations of the personnel

department of Government of Shanghai.

公司使用统一的《劳动合同》)文本,是否需要签证及签订份数依上海市政府劳动人

事部门之规定操作。

7.2 Term of the labor contract :

劳动合同期限

7.2.1 To regard a concrete job or a job of period of time as term:

以完成一项具体的工作或一个阶段的工作期限:

A. Generally, the term of this kind of contract is under one year;

此类合同期限一般在一年以下;

B. It is applicable for casual labors.

此类合同期限适用临时工劳动合同的签订。

7.2.2 Fixed term:

固定期限

A. Generally, the fixed term contract is one year.

此类合同期限一般为一年.

B. It is applicable for formal staff whose probationary period is 3 months.

此类合同期限适用于编制内的正式员工,适用期三个月。

7.3 Labor contract renewing :

劳动合同的续签:

7.3.1 Once the fixed term contract expires, it will be renewed according to the original

contract term and the same time limit automatically if both sides have not notified each

other about the termination.

固定期限合同到期,双方均无解约统治视为双方同意按原合同条款及相同期限自动续约。

7.3.2 Human Resources and Administration Department is responsible for filling in the

Cognizance Form for Renewing the Labor Contract one and a half months before the

labor contract expires, and submits it to the manager of the employing department for

confirming.

人力资源及行政部在员工劳动合同到期前一个半月填写《劳动合同续签认定表》送用人

单位权责主管进行续签合同认定。

7.3.3 Direct manager of employing department shall write down the explanation and submit

it to the manager for approving, once it confirmed that the employee will not renew the

labor contract with the company. Then the Human Resource and Administration

Department shall fill in the Labor Contract Termination Notice, and notify the employee

one month prior to the termination of the labor contract and handle the leaving

procedure one day prior to the expiry of the contract according to Exit Management

Procedure.

经认定不再续签之员工,用人单位直属主管填写说明,呈权责主管核准后,由人力资源

及行政部填写《终止劳动合同通知书》,于合同到期前一个月通知员工本人,于合同到

期前一日依公司《员工离职管理办法》办理离职手续。

7.4 Labor contract terminating

劳动合同的终止

Labor contract will be terminated at once if the term of the labor contract expires or the appointed condition appears.

劳动合同期满或者当事人约定的劳动合同终止条件出现,劳动合同即行终止。
