According to P eople’s Republic of CHINA Labor Law,People’s Republic of CHINA Labor Contract Law and Province Labor Contract Regulation, party A and party B are willing to sign the contract on the basis of fair discussion and agreement and comply with it.一、劳动合同期限Contract Period第一条本合同期限类型为固定期限合同。

(根据劳动法可签订固定期限合同,或无固定期限合同)This contract is fixed period contract.(According to Labor Law there could befixed or non-fixed period labor contract).合同日期自年月日起截至到年月日止,其中年月日至年月日为试用期。

This contract period is from to , includingprobation period from to .二、工作内容Work Contents第二条乙方同意根据甲方工作需要,担任指定的岗位(工种)工作,以及其他由甲方指定的兼职工作和临时工作。

工作地点为:XX市XX区XXXXX路1号。

Party B is willing to work as according Party A’s requirement s andother part-time and temporary work required by Party A. Work place: No.1 WildRoad, Development Zone, Rizhao.第三条乙方必须按照甲方的合法要求,按时完成规定的工作数量,达到规定的质量标准。

Party B should fulfill all the work in time and by quality standard according toParty A’s legal requirements.三、劳动保护、劳动条件、工作时间和休假Work Protection, Condition, Time and Leaves 第四条甲方安排乙方执行8小时/日工作制,甲方依法保证乙方的休息权利。

乙方在劳动合同履行期间依法享受法定节假日以及探亲假、婚丧假、产假、带薪年假等休假权利。

甲方安排乙方每日工作时间不超过8小时,每周工作5天,平均每周不超过40小时。

甲方保证乙方每周休息二天。

因特殊原因需要延长工作时间的,在保障乙方身体健康的条件下,甲乙双方友好协商执行,原则上每月不超过24小时。

There are 8 working hours per Day. Party A promises rest time to Party Baccording to the laws. Party B has the right to enjoy the legal vacation, homeleave, marriage and mourning leave, maternity leave and legal paid vacation,etc.Party A arranges Party B to work maximum 8 hours per day and 5 days everyweek, and the average work hours per week should be not more than 40 hours.Party A gives Party B 2 days vacation every week. Because of special reasonsParty B needs to work over-hours on the basis of normal health condition, afteragreement of two parties. Basically it should not be more than 24 hours everymonth.第五条甲方安排乙方加班的,应安排乙方同等时间补休或依法支付加班工资;加点的,甲方应付加点工资。

If party A requires party B to do overtime work, Party A should give the equaltime leave in some other time or give overtime payment according to law; if partyB needs to work in extension hours, Party A should pay for the extension hours. 第六条甲方为乙方提供必要的劳动条件和劳动工具,建立健全的生产工艺流程,制定操作规程、工作规范和劳动安全卫生制度及其标准。

Party A should provide the necessary work conditions and tools, build upcomplete production process and make operation regulations, rules and safetysystem and standards.第七条甲方负责对乙方进行政治思想、职业道德、业务技术、劳动安全卫生及有关规章制度的教育和培训。

Party A should arrange to give the necessary training for Party B about politicalthoughts, professional morality, operation skills and operation safety andregulations.四、劳动报酬Work payment第八条乙方应按照甲方的要求完成相应的工作,甲方应根据按劳分配、效率优先、兼顾公平的原则,按照国家规定和甲方依法制定的工资分配办法等规章制度按月以货币形式支付乙方的工资,每月7日前公司为员工支付上月工资(遇节假日则顺延)。

甲方支付乙方的试用期工资标准为:元/月,试用期过后为元/月。

工资额度必须对第三者保密,甲乙双方都应严格遵守。

Party B fulfills the work according to the requirements of Party A. Party A shouldgive the payment in cash every month according to national law and party A’ssalary payment regulation on the basis of working, efficiency priority with dueconsideration to fairness. Every month before 7th, Party A should pay Party B’ssalary of last month(if there is holiday, the paid date will be postponed). Party B’sprobation salary is Yuan/Month, after probation period salary isYuan/Month. Both parties must keep the salary as a confidential matter to thirdparty.第九条由于甲方生产任务不足,使乙方待岗的,甲方保证乙方的月生活费不低于日照市最低生活保障。

If Party A doesn’t have enough work task and Party B have no work to do, PartyA should gives PartyB the living allowance which should not be less thanRizhao Minimum living guarantee.五、保险福利待遇Insurance and welfare第十条甲乙双方应按国家和山东省社会保险的有关规定交纳职工养老、失业和大病医疗统筹及其他社会保险费用。

乙方应缴纳的部分按照法律法规应有甲方代扣代缴的,由甲方从乙方工资中代为扣缴。

甲方应为乙方填写《职工养老保险手册》。

双方解除、终止劳动合同后,《职工养老保险手册》按有关规定转移。

Party A and Party B should pay endowment insurance, unemploymentinsurance and serious illness insurance and other social insurance as nationaland province regulations about insurance. The Part which should be paid byParty B should be withheld from salary by Party A.Party A should fill in Employee Endowment Insurance Handbook for Party B.After the termination of the contract, Employee Endowment InsuranceHandbook should be handed over according to relevant regulations.第十一条乙方患病或非因工负伤,其工资按照国家已经制定相关规定执行。
