外籍专家聘用合同EMPLOYMENT CONTRACT OF FOREIGN EXPERT一、科技有限公司聘请德籍Wolfgang Krautter（外文姓名）为技术总监，护照号码：______。
双方本着友好合作精神，自愿签订本合同并保证认真履行合同中约定的各项义务。
Article 1 Technology Co., Ltd. agrees to employ Wolfgang Krautter, who is of German nationality and whose passport number is ______, to serve as its Chief Technology Officer. The two parties, in the spirit of friendship and cooperation, agree to enter into this Contract and fulfill the liabilities and obligations agreed herein.二、合同期共 12 个月，自2012年7 月10 日起至2013年7 月 10日止。
受聘方的试用期为60天，在试用期内，聘方如发现受聘方健康状况或专业水平等不能胜任本聘用合同规定的工作任务，有权解除合同，且无须向其支付任何违约金或补偿。
Article 2 The term of this Contract shall be 12 months, from July 10, 2012 to July 10, 2013. The probation period for Employee is 60 days. Within the probation period, in case Employer finds Employee incompetent to the tasks stipulated herein due to his health condition or professional capability, Employer shall be entitled to rescind this Contract without obligation to give Employee any liquidated damages or compensation.三、受聘方的工作任务 Article 3 Tasks of Employee1）员工品质观念的提升和技术培训1) Promoting Employee's awareness on quality and technical training;2）品质控管体系的建立，品质的提升，达到德国标准2) Establishing quality control system and enhancing the quality to meet German Standard;3）精密附件和双层冠的技术指导3) Technical instructions on precise accessories and double dental crowns;4）过程技术难点的攻克 4) Overcoming the challenge of process technology;5）技术管理和技术仲裁 5) Technology management and technology arbitration;6）降低公司的重作率和过程返工返修率6) Lowering the remaking rate and back repair rate for the company;7）优化工艺流程，提高工作效率7) Improving the process flow and enhancing the work efficiency.四、受聘方的月薪为欧元4500元，月工作时数为187小时（不含用餐时间,以30天/月，8.5小时*5天*4周+2天*8.5小时），每小时工资为24欧元。
（受聘方应当按照《中华人民共和国个人所得税法》依法交纳个人所得税）Article 4 The monthly salary for Employee is 4500 Euros. The monthly working hours shall be 187 hours (excluding the hours for meals, 30 days a month, 8.5 hours * 5 days *4 weeks + 2 days *8.5 hours), and the wage for each working hour is 24 Euros. Employee shall pay the individual income tax according to the Individual Income Tax Law of the People’s Republic of China.五、受聘方每日工作时间为9小时，用餐时间为每次半小时，每周工作时间为五天，月工作时数为187小时。
Article 5 Employee shall work 9 hours a day, including half an hour for the meal. Employee shall work 5 days a week and 187 hours a month.六、聘方的义务：Article 6 Liabilities of Employer:1、向受聘方介绍中国有关法律、法规和聘方有关工作制度以及有关外国专家的管理规定。
6.1 shall introduce to Employee relevant laws and regulations of China, relevant working systems of Employer and relevant management requirements on foreign experts.2、对受聘方的工作进行指导、检查和评估。
6.2 shall direct, inspect and assess Employee’s work.3、工作期间，免费向受聘方提供吃住。
若受聘方需在珠海租房，费用自理。
6.3 Shall provide free accommodation and food to Employee during the period in which Employee works for Employer. In case Employee needs to rent a house in Zhuhai, Employee shall be responsible for fees and expenditures incurred therefrom.4、配备合作共事人员。
6.4 shall assign partners to assist Employee.5、每月15日支付受聘方上月的工作报酬，以人民币支付，按工资发放日的汇率进行结算。
6.5 shall pay the salary for the previous month on the 15th day of each month in RMB according to the exchange rate on the day.6、受聘方享受中国下列节日休假：元旦、春节、国际劳动节、国庆节以及法律、法规规定的其他法定节假日。
6.6 shall enable Employee to enjoy the following Chinese holidays and festivals: New Year’s Day, The Spring Festival, International Labor Day, National Day and other statutory holidays and festivals stipulated by applicable laws and regulations.七、受聘方的义务：Article 7 Obligations of Employee:1、遵守中国的法律、法规，不干预中国的内部事务。
7.1 shall abide by the laws and regulations of China and shall not interfere with the internal affairs of China.2、遵守聘方的工作制度和有关外国专家的管理规定，接受聘方的工作安排、业务指导、检查和评估。
未经聘方同意,不得兼任与聘方无关的其他劳务。
7.2 shall abide by Employer’s working system and relevant management requirements on foreign experts; and shall accept work arrangement, operation direction, inspection and assessment made by Employer. Without consent of Employer, Employee shall not engage in other labor service irrelevant to Employer.3、按期完成工作任务，保证工作质量。
7.3 shall complete the tasks on schedule and guarantee the work quality.4、尊重中国的宗教政策。
不从事与专家身份不符的活动。
7.4 shall respect China’s policies on religion; shall not conduct any activity incompatible with the status of a foreign expert.5、尊重中国人民的道德规范和风俗习惯。
7.5 shall respect the Chinese people’s moral standards and customs.八、合同的变更、解除和终止：Article 8 Change, Rescission and Termination of the Contract:1、双方应信守合同，未经双方一致同意，任何一方不得擅自更改、解除和终止合同。
8.1 The two parties hereto shall comply with this Contract and, without the prior consensus between the two, neither party may alter, rescind or terminate thisContract.2、经当事人双方协商同意后，可以变更、解除和终止合同。
