Article 1. DEFINITIONS

1. 受雇日期
业主同意雇佣雇员，雇员愿意且只为雇主工作，从_______年_______月_______日起

2.Scope of Work and Responsibilities:
The Employee will be assigned to the position as ________________________________ under ____________________________________ Department.
During the aforesaid Employment Period or term of the Contract, the Employee shall devote his/her entire time and attention to his/her own duties and responsibilities and carrying out his/her own scope of work in good faith and with diligence as directed by the Employer.
The Employee shall comply with all of the rules and regulations of the Employer and instructions or orders issued by the Employer.
The Employee shall render the services assigned by the Employer to the maximum satisfaction of the Employer and to the best of his/her ability and performance in diligent, trustworthy, business-like, efficient and proactive manner.
During his/her Employment Period the Employee shall not engage in any other business or employment.
Employee’s Scope of Work and Responsibilities refers to Attachment I.
2. 工作范围及职责：

在上述合同期内，雇员应按雇主要求将全部时间和精力放在工作上，勤勉敬业完成
自己的工作和职责。
雇员须遵守雇主的规章制度及发布的指示、指令。
雇员须完成雇主指派任务，做到勤勉、可靠、专业、高效、前瞻，最大程度使业主
满意。
合同期内雇员不得从事其他职业或供职他方。
雇员工作范围及职责见附件1。
3. Working Hours:
Subject to legal provisions, Employer may at his discretion fix hours of work, the interval for meals and/or rest and the times of commencement and termination of work and to alter from time to time at the employer's discretion. Employee should manage to complete his tasks within this working hours. Working hours do not include intervals for meals and rest.
3. 工作时间
根据相关法律，雇主可以单独安排和随时更改雇员工作时长、用餐、休息、上班下班时间。雇员需在工作时间内完成自己的工作任务。工作时长不包括用餐、休息时间。
4. Remuneration:
In consideration of the covenants in this contract, the Employee shall be paid fixed salary ________________ per day. Besides, incentive will also be issued based on the Employee’s performance to improve the productivity.
Salary will be paid every month before 10th day of next month for wage period from the first day of the month to the last day of the month.
Salary will be reviewed by Employer, depending upon the capabilities, special efforts and performance of the Employee etc.
However salary increment shall be at the sole discretion and judgment of the Employer. 4. 工资

每月一次，于次月10日之前支付，工资期由当月月初至当月月末。
雇主将基于雇员能力、特殊贡献和绩效等来审核雇员工资。
雇主有权单独决定是否给雇员加薪。
5. Holidays & Leaves:
(a) Normally the whole day of Sundays (or Saturdays) as weekly holiday, the whole day of Poya Days and other Mercantile Holidays.
(b) Employee is entitled to sick leave (continuous two sick days or above should be certified by a registered medical practitioner) for a period of 7 days (in a 12-month period).
(c) Employer is entitled to casual leave for a period of 7 days (in a 12-month period).
(d) Employee should inform his competent Chinese leader and Project Manager and get approved before taking casual/sick leave. A written leave note with leave duration, cause and signature (signed by Employee, his competent Chinese leader, Project Manager) is required and recorded in Admin Office. Employee is required to report back after leave in Admin Office, or otherwise his leave will be deemed as extended. Unauthorized leave will be treated as absence.
5. 假期
雇员须事先告知中国籍领导，获批后方可享有假期。请假需填写请假条，包括请假
时间、事由，并由请假人及其中国籍直管领导签字。未请示批准无故缺勤将作旷工
处理。
6. Performance Review
The Employer will conduct performance review of the employee every month, and decide
for the award or penalty.
1. If working days are over 25 days for the month, the salary will be issued 100%. If attendance/working days are between 21days to 24 days, the salary will be issued 90%. For working days of 20 days or less, the salary will be issued by 80%.
6. 绩效考核
雇主每月将对雇员进行绩效考核，根据雇主决定有相应奖罚。
1、工作满25天的，当月工资按照工资标准100％发放，工作满21天-24天的按照
工资标准90％发放，工作满20天及以下的按照工资标准80％。
7. Termination of Contract
(a) Either party will be at liberty to terminate this Agreement by giving One (1) calendar month’s notice without assigning any reason whatsoever.
(b) If at any time the Employee commits a breach of any term of this Agreement or conducts himself or herself in any manner prejudicial to the interest of the Employer or be guilty of misconduct or convicted in a court of law for having committed a criminal offence, or if by illness or other cause the Employee is incapacitated for duly attending to his/her duties for a time exceeding in One (1) month, the Employee’s services shall, at the Employer’s discretion, be terminated forthwith without any notice.
(c) If the Employee performs to his malpractice，negligence, disobedience or any other poor performance or failure to fulfill his duties, the Employer will issue a warning or penalty by downgrade the salary level. The Employee shall immediately rectify for his working attitude to the satisfaction of the Employer. If the employee fails to meet the satisfaction of the Employer, the Employee will be dismissed immediately.
7. 终止雇佣合同
1.任何一方有权无需任何理由提前一个月告知对方终止本合同。
2.如果雇员存在违反本合同，或做出有损雇主利益的行为，或承认自己失职，或在法
庭上承认自己犯罪，或因生病或其他原因超过一个月不能履职等情况，雇主有权无
需通知雇员而终止本合同。
3.因雇员玩忽职守、失职、不服从或其他不良表现没能履职，雇主会给予雇员警告或
者降薪处罚，雇员需立即改正自己工作作风以使雇主满意。如果雇主不满意，雇员
将被立即解雇。
8. Notice
Any notice request demand or other communication relating to any matter regarding this Contract shall be made in writing and shall be deemed to have been duly given if sent by e-
mail or courier as the case may be to the addresses given above.
任何与本合同有关的通知、要求或其他沟通均应以书面形式发出，通过本合同邮件
地址以电子邮件或快递的方式发出的函件均被视为已送达。
9. Company Management Regulations and Rules
The employee shall be subject to the regulations and rules, standing instructions and orders made from time to time by the employer. If any safety issue occurs due to the failure of the employee for complying with the relevant regulations and rules, any consequences shall be borne by the employee himself.

雇员必须服从雇主的公司管理规章制度、指示和指令。如果不遵守相关规定造成的
安全事故由雇员自行承担。
10. Punctuality
Any late attendance will make the employee liable for disciplinary action as deemed by the company.

雇员迟到会被雇主视为违纪行为。
11. Confidentiality
The Employee shall agree not to disclose any Confidential Information including any technical specifications, drawings, technical data, price list, technical documents, contractual documents or any other business secret or information marked “Confidential”
or “Proprietary”, to any third party unless otherwise specifically agreed or consent ed by the Employer in writing. The Employee shall treat the Confidential Information with the highest degree of care and importance.
11. 保密
雇员须同意不会向第三方披露任何保密信息，包括任何技术规范、图纸、技术数据、
价格清单、技术文件、合同文件及其他商务秘密、标记“保密”“专有”的信息，
除非特别同意或由雇主书面同意。雇员须对保密信息持高度谨慎和保管态度。
12. Entire Contract
This Contract, set forth the entire agreement between the parties hereto and supersedes all prior negotiations, undertakings and agreements between the parties concerning the . No amendments or modifications of this Contract shall be made except by a writing signed by the parties to be bound thereby or the successor or assign of such party.
12. 完全合同

THIS EMPLOYMENT AGREEMENT (the Employment Agreement), dated as of this _________,_________,_________(M/D/Y), is entered into by and among AAA Corporation (the Company or Employer) and BBB (Executive).
