根据《中华人民共和国合同法》、《上海市房屋租赁条例》（以下简称：《条例》）的规定，甲、乙双方在平等、自愿、公平和诚实信用的基础上，经协商一致，就乙方承租甲方可依出租（出租）的商品房（房屋/商品房）事宜，订立本合同。
