Continue to deepen the reform of the cadre and personnel system, always adhere to correct direction of personnel, implement regulations on cadre selection 根据《中华人民共和国合同法》规定，为明确甲乙双方的权利、义务和经济责任，双方本着平等互利的原则，经友好协商，订立本合同并达成以下协议及条款: 一、合同范围 乙方为甲方提供CDMA移动执法车监控系统和与系统相关联的所有硬件、软件提供保质期外的检修保养服务。 二、主要内容 (一)系统中设备的故障响应。 故障响应:乙方在接到甲方电话或书面的检修通知后，必须指定技术人员 市区2小时、市区以外5小时内到达故障现场。 (二)系统中设备损坏后的修复和更换。 故障修复:后端软件平台3小时内修复、执法车前端设备4小时内修复、 重大事故(执法车不能正常工作)24小时内修复(以上时间均包括响应时 间在内)。修复后必须由甲方相关人员确认。 设备更换:在故障现场不能修复的设备，乙方为了应急修复所用的设备在 征得甲方同意后方可更换，相关费用与甲方另行结算，更换后的损坏件应 交由甲方查验。甲方若需更换相关设备及其配件，事先要与乙方技术人员 沟通确认无异议后方可进行更换，乙方有义务对甲方错误进行指正。 (三)系统保养和维护。 执法车摄像机保养:乙方至少贰月1次对摄像机表面进行清洁、除垢，时 间为每月的15号，遇雨天或周末等顺延。 执法车主要设备保养:乙方至少贰月1次对执法车主要设备进行详细检测， 时间为每月的15号，遇雨天或周末等顺延。 系统保养:乙方至少每半年各进行壹次对执法车系统进行全面的检测保养， 时间为每年4月和9月的第一个星期。 mass line of the party construction of education system, improve scientific and systematization and standardization level of th第 3 页 共 6 页 e party building. Continue to deepen the reform of the cadre and personnel system, always adhere to correct direction of personnel, implement regulations on cadre selection 执法车应用终端:执法车服务器端软件、执法车客户端软件,GIS定位软件 故障排除及恢复、病毒防范及消除、硬盘垃圾清理、电脑外设安装调试、 系统安装调试与维护、应急、系统恢复及日常维护等。 其它保养:对执法车摄像机支架、标示等设施的损坏和自然锈迹在必要时 进行修复和表面翻新。在“执法车移动视频系统”有迁移必要时进行迁移。 以及其它未罗列相关设施的保养。 (四)系统改造和升级的建议。 对移动执法车系统具备提高硬件、软件性能技术条件的时候，乙方将负责 执法车系统的平滑过渡。对中国电信3G业务平台推出后，在支持CDMA的 3G移动视频终端面世，运行性能稳定后，乙方将按照低于市场价格平滑过 渡CDMA移动执法车到3G。 对软件平台升级、迁移工作，乙方将通过跟甲方的友好协商，根据实际内 容的大小确定后续工作。 (五)用户操作人员的培训。 对甲方提出的CDMA移动执法车操作培训要求，乙方将根据甲方的实际需求， 积极配合甲方的工作，定期组织相关培训。 三、责任义务 乙方必须配备检修、保养工作所必须的交通工具，检测设备、仪器仪表，对系统所需的所有配件须常年备货。 乙方必须建立一支有相关知识组成的专业技术队伍，提供7*7*24服务，并将相关人员的通讯方式告知甲方。 乙方必须向甲方提交详细的工作计划与工作安排，对每次检修，保养工作认真做好记录，并交甲方相关人员签字。 乙方应切实加强现场管理确保安全生产，在检修保养中发生人身设备及第三者事故，甲方不承担任何责任。 乙方不得对相关信息进行查询、下载挪作他用，不得泄露甲方工作秘密。 与电信、公众信息公司等部门工作上的协调原则上由乙方负责，在乙方无法协调时，甲方有协助协调的义务。 甲方必须为乙方工作的顺利开展提供工作上的便利，并指派专人负责。 mass line of the party construction of education system, improve scientific and systematization and standardization level of the party building.
