PRELIMINARY STATEMENT 前言
The parties hereby agree that the Company shall employ the Employee according to the following provisions:
双方特此同意公司按照下列条款雇佣员工：
ARTICLE 1 –GENERAL PROVISIONS AND GOVERNING LAW 第一条总则和适用法律
1.01 This contract shall be subject to and governed by the Labor Contract Law of the People’s Republic of China and the Regulations of Shanghai Municipality on Labor Contracts and other published and publicly available laws and regulations applicable to foreign investment enterprises in Shanghai Municipality, PRC.
1.01 本合同须遵守《中华人民共和国劳动合同法》、《上海市劳动合同条例》及在中华人民共和国上海市公开发布的有关外商投资企业的法律和法规并受其管辖。
ARTICLE 2 –TERM OF CONTRACT 第二条劳动合同期限
2.01 This Contract will be for a term of years commencing on unless earlier terminated in accordance with provisions of this Contract, provided that this Contract shall not become effective unless and until all the following conditions are satisfied:
本合同从日起生效，为期年。按照本合同有关条款，可以提前解除合同，但本合同须在下列条件全部满足后才能生效。
(i) the personnel file of the Employee has been received by the Company or the institution designated by the Company; and
公司或公司指定的机构已收到员工的人事档案，及
(ii) the Employee completes a satisfactory medical examination at a hospital/clinic designated by the Company.
员工已在公司指定的医院/诊所完成体检，且体检结果令人满意。
2.02 This Contract may be renewed if both Parties agree to the renewal and sign a new labor contract within thirty (30) days before the expiry of this Contract. In the absence of a new employment contract duly signed by both Parties, this Contract shall terminate automatically upon its expiration.
在本合同期满之前30天内，经双方一致同意后，本合同可以续订并由双方签署一个新的劳动合同。如果双方没有签署新的雇佣合同，则本合同于期满时自动失效。
ARTICLE 3 - PROBATIONARY PERIOD 第三条试用期
3.01 The Employee will serve a probationary period of month . At the end of this period, the Company will appraise his/her performance, and subject to good conduct and performance, his/her employment will continue with the Company.
员工试用期为个月。试用期期满，公司对员工进行业绩评估，在符合行为和业绩良好的前提下，该员工将由公司继续雇佣。
3.02 During the probationary period, the Company has the right to terminate this Contract if the Employee is deemed unqualified on giving written notice of seven (7) working days, or by the payment of seven (7) days’wages in lieu of notice.
在试用期内，如果公司认为员工不符合录用资格，公司有权解除本合同。﹝公司可提前七 (7) 个工作日书面通知员工，或支付员工七 (7) 天工资代替通知。﹞
ARTICLE 4 –APPOINTMENT AND DUTIES 第四条岗位和职责
4.01 The Employee during the term of employment hereunder shall serve the Company in the position of Toilet Engineer and shall perform the duties specified by the Company and any additional duties assigned to him/her by the Company time by time.
在本合同期间，员工在 ____ 岗位工作。员工应履行公司具体分配的职责以及公司不时分配的任何额外职务。
4.02 The Company shall have the right to, upon agreement between the Parties, re-deploy the Employee to work in another position and/or to vary the duties and powers assigned to him/her by Company based on the business requirements of the Company and his/her performance.
经过双方同意，根据公司的业务需要和员工的业绩，公司有权重新安排员工的工作岗位和/或改变公司分配给该员工的职责和权力。
4.03 The Employee shall devote his/her full working time and attention to the performance of his/her duties. During the term of employment hereunder, he/she shall not be employed by or engaged in any business activities of any other entity or person without the prior written consent of the Company. The Employee shall be subject to immediate dismissal for any violation of these obligations.
员工应投入其全部的工作时间和注意力履行其职责。在本合同规定的受雇期内，在未得到公司书面同意之前，员工不得受雇于其它单位或个人或从事任何其它单位或人的任何商业
