一、乙方按甲方要求的保函条款为甲方出具投标保函或电子交易

2、甲方在投标有效期内被通知为中标人后，未按招标文件的规定签订合同；
3、甲方中标后不能按照招标文件的规定提供履约保证；
4、招标文件规定的投标人应支付投标保证金的其他情形。
四、在保函有效期内乙方收到招标人的书面索赔通知，说明甲方违反上述条款时，乙方应在7个工作日内支付保函限额内相应的担保金额,并不需要从实质上对付款条件进行审查，因此引发的纠纷及损失由甲方负责，乙方不承担任何责任。
五、保函原件不办理任何挂失、补发手续，甲方遗失、损坏保函原件而产生的任何后果由甲方自行负责，对应保证金的退还必须待保函有效期结束并由甲方向乙方提供书面申请及有关证明才能办理。
六、本协议一式三份，均具同等效力。本协议自双方盖章签字之日起生效。
七、若申请出具网上投标保函时，乙方在收到招标人的退还或扣划指令后才出具保函原件。
