社区矫正是西方国家首先推行的一种刑事执法模式，其理念始于19世纪末近代学派的行刑社会化思想。
如今，社区矫正制度已成为代表当今世界范围内行刑发展的趋势与潮流。
在中国，于2003年开始了社区矫正试点工作，截至2010年12月底，全国已开展的社区矫正工作，覆盖全国91%的市（州）、72%的县（区）和65%的乡镇（街道）。
2011年2月25日，《中华人民共和国刑法修正案（八）》通过，明确规定了对判处管制、缓刑以及假释的罪犯依法实行社区矫正，标志着我国社区矫正法律制度的确立，为改革完善我国刑罚执行制度奠定了重要基础。
2012年3月1日，《社区矫正实施办法》正式施行。
一、社区矫正的概念及功能（一）社区矫正的概念社区矫正，亦称“社区矫治”，简单而言，就是一种避免让犯罪分子与社会相隔离，利用社区的资源帮助犯罪分子改造的方法的总称。
具体而言，是指把不需要监禁的且社会危险性小的罪犯置于社区内，由专门的国家机关在相关社区组织以及社会志愿者的协助下，在判决、裁定或决定确定的期限内，运用社会工作方法，整合社会资源和力量，对其实施行刑监督、教育改造和帮助救济，从而提高改造质量，促进社会长期稳定与和谐发展的非监禁性的刑事执行活动。
（二）社区矫正的功能目前，社区矫正已经成为国际社会一项重要的司法制度，并且发挥了巨大作用，其原因是基于社区矫正所具有的功能。
1.惩罚功能社区矫正作为刑罚执行手段之一，当然要具备惩罚功能。
服刑人员在社区中并不是完全自由的，在社区力量的监督下，必须接受社区矫正机构的监督和管束，若违反了行为规则和限制，必须承担相应的后果，甚至可能会被重新送往监狱或其他监禁机构。
2.修复功能社区矫正通过开放式的矫正措施，修复犯罪人员与社会的关系，增强其适应社会的能力，促使其顺利回归正常生活，最大限度的降低再犯罪率。
同时，通过对服刑人员的惩戒，对被害人的心理产生一种内在的补偿与抚慰，实现惩恶扬善的道德要求。
3.康复功能社区矫正机关及相关工作人员，通过专业的矫正活动对服刑人员进行心理健康教育，以及对处于严重心理危机状态的服刑人员进行及时的危机干预，使他们的行为恶习、不正当的心理状态得以修复，树立正确的价值观，达到身心康复的效果。
二、社区矫正政策评估每一项社会政策都是国家为解决特定的问题而制定的，并且也确实起到了应有的效果。
但是随着社会的发展，彼时的政策规定是否能适合此时的形势发展，任何政策制定者都难以保证，这也就产生了政策评估。
如何判断一项政策的实施效果，对其成本-效益的分析，往往是一种较为直观的方法。
（一）社区矫正的效益分析我们这里所谈到的效益，并不仅仅局限于经济效益，同时也注重对社会效益、文化效益等方面的分析。
同时，从社会和矫正对象两个方面对社区矫正政策带来的效益进行阐述。
1.社会效益分析（1）社区矫正彰显了人道主义精神，体现了我们社会对人权的尊重。
处于监禁状态下的犯罪人员，长期与正常的社会生活相隔离。
因此，当犯罪人员恢复自由生活状态时，社会适应能力下降，无法回归正常生活，甚至连最基本的生存发展权都难以保障。
他们虽然触犯了法律，但仍然具有宪法与法律所赋予的人权内容。
社区矫正可以维护犯罪人员在监禁时被剥夺的一些权利，尊重他们的人权，有利于平和他们的罪犯心理。
有效消除了他们对社会的威胁和对不满情绪，避免社会矛盾的激化，充分彰显了立法中人本位的人道主义精神。
（2）有利于维护社会稳定，构建社会主义和谐社会。
构建社会主义和谐社会，就要对影响社会和谐的犯罪行为以及犯罪人员进行严厉打击。
而社区矫正不是单纯为了惩罚犯罪人员，而是为了解决问题。
倘若严刑峻法会带来一部分人的消极抵触，甚至产生仇恨社会的情绪。
那么通过社区矫正，把无需监禁的犯罪人员置于社区中实施矫正，让他们成为宽严相济政策的受益者，有利于降低社区中的不和谐因素，维护社会稳定，促进和谐社会的建设。
2.矫正对象效益分析（1）社区矫正有利于解决矫正对象的经济困难，保障基本生活需求。
在监狱中，犯罪人员基本上与外界处于隔绝的状态，尤其针对那些刑期较长的人来说，等从监狱中出来，很容易陷入贫困状态。
而在社区中，给予更多接触社会的机会。
对于在改造中有积极表现的人员，相关部门还会免费为他们提供技能培训和就业创业指导，帮助其提高就业谋生能力，解决生活中面临的困难。
根据司法部数据显示，在上海，2004年至2008年，上海共建成过渡性就业安置基地356个，累计成功推荐社区服刑人员就业2103人，组织参加技能培训1868人，帮助解决住房困难170人，解决临时性补助3972人。
（2）社区矫正能够使矫正对象避免交叉感染，提高矫正质量，防止二次犯罪。
在监狱内，环境相对隔绝，服刑人员同质性很强，各种类型的犯罪分子聚集在一起有很多的沟通机会，一些人甚至利用闲暇时间互相交流犯罪心得和技巧，增强反侦察能力，出现交叉感染。
而在社区中，矫正对象接触的大部分都是健康积极的人群，周围环境比起监狱要优越和健康，再加上严格的监督机制，这样就会避免交叉感染的出现。
同时并采取法律、心理等各种手段，对其进行耐心的思想政治教育和文化技术教育，也就大大提高了矫正质量，防止服刑人员再次跌入深渊。
（二）社区矫正的成本分析成本和效益是相对应的，效益往往较为间接地表现社区矫正政策的评估结果，而成本则会较为直观的让我们看到政策的实施表现。
1.社区矫正降低行刑成本，为国家节省了大量的财政资源我们知道，传统意义上的监禁主要在监狱中进行，国家不仅要投入大量资金修建监狱，而且还要为监狱系统的运行支付庞大的后续资金。
据统计，我国在监狱矫正方面每年投入的费用就达到500多亿。
具体来说，我国监狱关押一名罪犯的年度花费，平均约为1.5万元，而在上海市，社区矫正成本为每人每年6000元。
因此可以看出，对一些轻度犯罪人员，用社区矫正代替传统的监禁措施，可以使监狱集中人力、物力和财力矫正那些轻度的犯罪分子，还可以合理地配置行刑资源，降低行刑成本，节省国家财政资源，使财政资源效益最大化。
2.社区矫正增加了社区的运行成本，造成资金困难一个社区，维持本社区正常的运转，并不需要很多的资金支持。
但当增加社区矫正项目后，运行成本就会增加，如矫正工作人员的工资、各类材料的制作、开展集中教育的设施等。
即使有司法部门的支持，但往往还需要社区自行筹集一部分资金。
另外，社区服刑人员在社会内服刑，大部分时间仍然与其他社会成员一起生活，这就会使社区中的居民产生抵触情绪。
需要安装更多的摄像头、成立治安巡逻队伍等。
所有这些，无疑会增加社区的成本，出现资金紧张局面。
（三）社区矫正政策实施效果分析据司法部社区矫正管理局负责人介绍，2012年以来，社区矫正工作紧紧围绕加强社会建设、创新社会管理，以贯彻执行“两院两部”《社区矫正实施办法》为抓手，以提高教育矫正质量为核心，以确保社区矫正安全稳定为目标，不断加强社区矫正工作体系建设，取得了重要进展。
截至2013年1月底，社区矫正工作已在全国各省和新疆生产建设兵团98%的地（市）、97%的县（区）和96%的乡镇（街道）开展。
各地累计接收社区矫正人员133.3万人，累计解除矫正76万人，在册57.3万人。
其中，去年1月至今年1月净增长17.2万人，每月平均增长1.32万人。
同时，2012年至今，我国社区矫正人员数量每月以万人的速度净增长，社区矫正工作逐步实现全覆盖，社区矫正人员在矫正期间重新犯罪率一直保持在0.2%的较低水平。
另外，司法行政机关积极加强社区矫正工作者队伍建设。
目前，全国共有社区矫正社会工作者10.2万人，社会志愿者57.3万人。
三、社区矫正发展面临的问题以及对策通过对社区矫正政策的分析评估，可以对社区矫正实施过程加以监控，防止其发展方向发生偏差。
同时也是为了评估社区矫正的效果，继而分析在社区矫正政策实施过程中产生的问题，提出相应的对策建议，以期更好完善社区矫正政策，维护社会利益。
（一）问题分析1.公众对社区矫正的认同度低人们普遍认为，犯罪人员必须得为自己的错误付出沉重的代价，而监禁在监狱中接受严厉的惩罚是最好的方式。
他们认为，若将犯罪人员放在社区中，不但不能使他们醒悟，还会对社区治安造成很大的威胁。
而公众的这种不满的情绪与不理解都会对社区矫正的顺利实施带来不便与阻碍。
2.缺乏专业矫正人才目前社区矫正的工作人员基本分为两类，普通的司法所人员和社区中的工作人员。
前者法律知识掌握熟练，但社区矫正工作的开展所需要心理学、社会学、社会工作方面的知识素养薄弱；后者没有经过专业的学习，工作时又不讲方法，在与矫正对象进行接触交流时，不会运用人性化的工作方法，影响矫正质量的提高。
3.我国社区矫正工作缺乏经费保障社区矫正作为刑罚制度的一种方式，必须要有稳定的经费支持，才足以顺利的开展工作。
现阶段，从各个试点的地方来看，办公经费来源单一，主要是依赖上级部门的财政拨款，而且由于各个地方对社区矫正的重视程度不同，经费的多少也存在很大的差异，很多矫正项目都难以有效的开展。
（二）政策建议1.加强社区矫正的宣传力度，转变人们的刑罚观念社区是社区矫正的土壤，而社区居民对社区矫正工作的认同是工作顺利开展的基础，因此我们要注重加强对社区矫正定义和内涵的宣传，纠正人们的认识偏差。
发挥大众传媒的作用，报道在社区矫正中典型的成功案例，扩大先进典型的社会影响，营造积极向上的工作氛围，获得社会和居民的认可。
2.开展社区矫正工作，还必须配备一支专业化的矫正队伍这就需要具备良好的法学基础和职业素养的人员，还要具备社会学、心理学、社会工作等专业教育的背景。
要经常对工作人员进行岗位培训和经验交流，提供多种学习的渠道。
完善社区矫正工作者的工资体系和个人晋升规划，使他们能够安心从事社区矫正社工作。
3.扩大我国社区矫正的经费来源，保障社区矫正的顺利进行我们可以借鉴国外先进经验，采取“政府主导，多方筹措”的方式。
政府在提供财政支持的同时，可以鼓励热心于公益事业的组织和个人的捐助、赞助，给他们一定的减免税、通报表扬等方面的奖励，以提高社会公众的积极性。
此外，还应该开源节流，科学合理得使用，最大限度的节约经费开支。
社区矫正制度是顺应当今时代潮流的产物，是人类社会文明发展的大势所趋。
我国经过十几年的探索与实践，已经取得了很大的进步，通过对其成本-效益的分析，我们也能清楚地看到其效果。
但现阶段，依然存在一些影响其顺利发展的因素。
但我们坚信，伴随着中国特色社会主义经济的发展，公民素质的成长，社会文明程度的提高，社区矫正工作定会在建设和谐社会中发挥巨大的作用。
