Abstract
WithChina'saccessiontoWTO,thearchitectureindustryinourcountryhasdevelopedrapidly,andconstructionmarketwithinternationalstandardsgradually.TheoriginoftheconstructionsuesfordamagesinChina,theproductionofconstructionmarket,intheproductwithinternationalstandards.Yetthedegreeofmarketcompensationisnotenough,andtheconstructionsuesfordamageisnotgeneralinconstructionalmarket.Therearemanykingsofproblemsintheprocessofclaimdamages,whichhasrestrictedthedevelopmentofarchitectureindustryinourcountryseriously.Howtoconsummateourcountry’sconstructsuesfordamagesistheimportanttopicinourconstructs.Throughanalyzingtheperformanceoftheweakinourcountry’ssuefordamages,thisarticleinquiredintoobjectiverootcausingbackwardnessinourcountry’ssuefordamagesaswellastheseriousconsequence,thenproposedtheconcretemeasuretoenhancethelevelandimprovethepresentsituationofourcountrytosuefordamages.First,thestrengthensconsciousnessofsuesfordamagesisimperative;Nest,thestrengthensthemanagement,andthedocumentsmanagementisthekeyroadwhichmustbetakentostrengthensuesfordamagesthemmanagement,third,enhancingthequalityofmanagementtroopisthecruxtosolvethetalentedpersondeficientinourcountry,suefordamages.Howeverconsideringthatsuesforsuesfordamagesisthecompensatesafterallafterwards,sothisarticledhasdiscussedtheriskguardbrieflybeforesuedfordamages,topromoteourcountryarchitectureindustry’sdevelopment,andenhancetheinternationalcompetitionstrength.

摘要
随着中国加入WTO，建筑市场逐步与国际接轨。施工索赔在中国的缘起，是建筑业市场化的产物，是与国际接轨的产物。然而目前市场化程度不够，施工索赔还不是建筑行业的通行做法。在施工索赔过程中还存在着这样那样的问题，严重制约了我国建筑业发展。如何完善我国施工索赔是建筑企业的重要课题。本文通过分析我国工程索赔意识薄弱的主客观表现，探究造成我国索赔管理落后现状的主客观根源以及由此而造成的严重后果，进而提出提高我国索赔管理水平，改善我国索赔现状的具体措施：首先加强索赔意识；其次，加强管理；再次，提高经营管理队伍的素质，是解决我国索赔人才匾乏问题的关键。同时考虑到索赔毕竟是事后补偿，为此，本文对索赔发生前的风险防进行了简要的论述以期促进我国建筑业的发展提高国际竞争力。
