聘用合同附件一、受聘方工作任务⑴受聘方教授课程为英语口语,阅读、写作、英美文学等课程。
⑵受聘方授课时数为每周16 节课,每节课时为50分钟,每周意指星期一至星期五。
如双方要求增加工作量,增加课时和工资报酬将由双方协商决定。
⑶受聘方应参加由学生组织的英语角或就聘方和受聘方都感兴趣的话题开展讲座。
⑷受聘方必须每学期参加由聘方组织的期末口语考试、阅卷评分等工作。
⑸受聘方必须在每学期结束前向聘方提交依据学生课堂表现给出的平时成绩。
⑹受聘方必须将学生每学期期末考试成绩文字材料递交给聘方作为资料保存。
⑺受聘方必须遵守聘方的教学计划、教学任务和教材要求,不得擅自更改课程和课时安排。
如需变动,须向聘方提出书面申请,经同意后方可更改。
二、工资待遇㈠.直接报酬。
⑴现金工资: 每月人民币元,工资以人民币现金支付。
⑵现金工资拟定为每月25日发放,遇特殊情况酌情后延,聘方应就此通知受聘方。
⑶受聘方按合同规定准时到位工作者,工资发放按合同规定的期限按月发放;首月实际工作日期不足整月的,按日计发,日工资为月工资的1/30(二月份同)。
凡因旅程、手续办理、个人私事等原因造成延误不能按合同规定准时到位工作者,工资发放从实际到位工作之日开始发放。
⑷聘用合同期为二个学期(或一个学年),受聘方享受发放工资月份为十个月,其中包括九个月工资和一个月带薪假工资,受聘方享受发放工资月份为二零一零年九月、十月、十一月、十二月、二零壹壹年一月、二月(带薪假)、三月、四月、五月和六月. 如聘用合同期为一个学期的或跨假期实际工作期限不到十个月的不享有带薪假。
⑸受聘方应当按照《中华人民共和国个人所得税法》依法交纳个人所得税。
㈡.间接报酬。
⑴聘方将保障受聘方在华生活的基本条件:主要包括提供独立住所,含卧室三间、客厅一间、厨房一间、餐厅一间及洗手间一间;附设基本家具、卧具、厨具、电冰箱一台、热水器一个、空调三部、洗衣机一部、电话一部、电视机一台、电脑一台及打印机一台和取暖设备的单独住房。
⑵聘方负责支付和办理受聘方在华的工作许可、专家证、居留许可、在华健康体检及证件费用。
⑶合同期限为两个学期,并且教学效果良好的,受聘方可在合同结束时获得2,200元的旅差费奖励。
⑷聘方为工作地点和住所相距较远的受聘方提供上下班交通工具或交通补贴。
⑸国际机票(中国至受聘方出发地点最近距离经济舱国际机票)。
合同期限为一个学期的提供单程机票,合同期限为两个学期的提供往返机票;受聘方必须在合同期满两个月前告知聘方需要代买机票的请求和具体旅程安排。
如合同结束时受聘方未能提供自购的往返机票票据或购票证明,聘方将按每学期每人5,000元或每年每人10,000元的交通补助标准对受聘方的旅费进行发放。
⑹在合同期满离校前报销受聘方单程来华行李运输费,受聘方需提供正式来华行李托运收费单据或发票,报销费用最高不超过来华机票的20%。
如果空运,应以24公斤行李分离运输价格计价,不以随机运输价格计价。
因中美航线规定可免费承运两大件64公斤,所以对来自美国的受聘方可不负担其行李运输费。
⑺受聘方在校内内部电话通话费用免费;水每户免费使用25吨,电每户免费使用500度,超出部分自付费用;暖气免费使用;宽带上网免费。
三、休息及节假日⑴受聘方享受中国下列节日休假:周末(国家调假时按国家安排执行)、元旦、春节、国际劳动节、国庆节以及法律、法规规定的其他节假日。
⑵受聘方可按其国籍和信仰相应享受下列节日休假:圣诞节两天:宰牲节(古尔邦节)三天;开斋节一天;泼水节一天。
四、旷工、病假和事假⑴未经聘方同意而擅离职守的,旷职一天,扣发两天工资,对于合同期内擅离职守两次及以上者或一次擅离职守达七天者(含周末),聘方有权解除合同,并追究受聘方的违约责任。
⑵受聘方病假。
受聘方请病假必须向聘方提供书面申请并批准,凭聘方指定的涉外医生证明并获聘方外事部门批准。
对连续请病假达十五天者,聘方有权扣除其一个月月薪;受聘方在一个合同期(一年或一学年)内,若连续病假或累计病假超过三十天,聘方有权解除聘用合同。
若未解除合同,工资将按70%发给,直至恢复正常工作为止。
⑶受聘方事假。
出于个人的紧急原因经聘方管理部门同意后受聘方可获准休假;在合同期(一年或一学年)内,事假累计不得超过十天,连续事假不得超过三天。
超过一天,将扣发两天工资,天工资为月工资的1/30(二月份同)。
受聘方在合同期(一年或一学年)内,如事假累计超过十五天,连续事假超过十天,聘方有权解除合同,并追究受聘方的违约责任。
⑷受聘方请假需找代课教师为其顶课,所请代课教师须经聘方认可才能代课。
如确有困难,由聘方处理,代课教师课酬从受聘方月薪中扣除,按照人民币100元/课时支付给代课教师。
五、疾病和医疗。
⑴受聘方必须如实向聘方告知自身健康状况以及潜在重大疾病隐患,并保证能胜任工作。
如受聘方年龄超过60周岁,需提供正规医院的健康检查证明。
⑵聘方在被聘方到校后为受聘方投保意外伤害险和医疗保险,并承担相应保险费用。
如受聘方要求其他保险险别,聘方代为办理,受聘方自付费用。
⑶在合同期内若受聘方在商丘师范学院内工作中获病,或因公在中国境内出差,在医院就诊的医疗费用,按照医疗保险的有关规定执行,受聘方在华医疗费用超出医疗保险金额的费用将由受聘方自负;在合同期内,若受聘方因私外出中国或在中国台湾、香港、澳门地区及中国境外就诊的医疗费用自理。
六、责任免除条款。
㈠聘方对受聘方身故及残疾责任免除。
因下列情形之一,造成受聘方身故、残疾的,商丘师范学院不负责任:⒈受聘方的故意行为;⒉受聘方犯罪、吸毒、殴斗、酒醉、自残或自杀;⒊受聘方人酒后驾驶或无照驾驶;⒋受聘方人患有艾滋病或其它性病;⒌战争、军事行动、内乱或武装叛乱;⒍核爆炸、核辐射或核污染;⒎受聘方突发重大疾病。
㈡聘方医疗责任(意外伤害医疗、住院医疗、高额医疗费用)免除。
因下列情形之一造成受聘方支出的医疗费用,商丘师范学院不负责任:⒈受聘方故意犯罪或拒捕、自杀或故意自伤;⒉受聘方殴斗、醉酒,服用、吸食或注射毒品;⒊受聘方酒后驾驶、无照驾驶及驾驶无有效行驶证的机动交通工具;⒋受聘方因整容手术或其他内、外科手术导致医疗事故;⒌受聘方因矫形、整容或康复性治疗等所支出的费用;⒍受聘方支出的挂号费、膳食费、陪住费、取暖费、交通费等;⒎当地社会基本医疗保险或公费医疗管理部门规定的自费项目和药品;⒏受聘方未遵医嘱,私自服用、涂用、注射药物;⒐战争、军事行动、暴乱或武装叛乱;⒑核爆炸、核辐射或核污染。
⒒签约前的既往症、精神疾病、艾滋病、性病、先天性或遗传性疾病及其并发;⒓在中国大陆地区以外发生的医疗费用。
⒔普通疾病门诊医疗费用;⒕受聘方突发重大疾病。
七、合同试用期和信誉保证金⑴受聘方的试用期为三十天,在试用期内,聘方如发现受聘方健康状况或专业水平等不能胜任本聘用合同规定的工作任务,有权解除合同。
⑵受聘方自购机票,以旅费作信誉保证金,合同期满离校前予以报销,考虑到聘方住房及财物安全保障问题,通常报销时间为受聘方交出住房钥匙时聘方给予报销。
八、其他规定⑴聘方不允许受聘方与学生幽会、留宿异性学生、与异性学生同居以及对学生有不得体的行为举止和关系,若发生以上行为均为受聘方违约;上述情况一旦发生,聘方有权对此进行调查,如情况属实,聘方有权终止合同并将一律终止合同以及追究受聘方的违约责任。
⑵受聘方应保障自身及财务安全,如离开商丘或中国应及时告知聘方行程及联络方式;遵守中国交通规则;准备长期外出时断电断水锁好门窗;规范使用电器。
⑶受聘方有义务保证居住所内设施及聘方所配备设施完好,任何人为损坏或丢失都将照价赔偿。
非人为故意损坏或因设施内在原因毁损,聘方负责修理或更换。
若设施非正常频繁毁损或经检验由于非正当操作、人为破坏而造成的设施毁损,受聘方须负责修理或照价赔偿。
⑷如受聘方在工作期间在校内组织学生做大型活动都应告知聘方并获得批准,聘方也应给予适当的方便或合作。
⑸受聘方自负在华期间市内、国内以及国际长途电话费用。
⑹受聘方不得在校外兼职教学及做其他工作,如受聘方擅自兼职,聘方核实后将书面告知受聘方停止兼职;如受聘方继续兼职工作,聘方有权终止合同并追究受聘方的违约责任。
⑺凡因受聘方违约而解除合同,受聘方在华合同终止后的一切费用自理。
九、本聘用合同附件各项条款的确定和变更均须由当事人双方协商,并以书面形式做出约定。
任何口头协议均视为无效。
本附件与标准聘用合同具有同等效力,是合同不可分割的一部分。
十、本合同附件在商丘市签订,一式两份,均用中文和英文写成,每份中文四页,英文六页,两种文本同等作准。
十一、本合同附件自签订之日起生效,合同期满自行失效。
若因政策或因受聘方资质条件所限,聘方无法从政府机关获得相关受聘方的工作批准及相关证件,本合同自行失效。
聘方:日期:地点:商丘师范学院受聘方:日期:地点:APPENDIXⅠWork assignment for the Employed Party(hereinafter called Party B).⑴ Party B shall teach Oral English, English Reading, English Writing, EnglishLiterature or other courses required by the University(hereinafter called Party A).⑵ Party B shall conduct English classes for students up to 16 teaching periodseach week. “Each period” is understood as 50 minutes and “each week”as Monday through Friday. If both parties want to add more workload, the course and pay of overtime work depends on bilateral discussions.⑶ Party B shall join English corner organized by students or give lecturesto the college on topics of interest to both Party A and Party B.⑷ Party B shall conduct the final exams organized each semester by Party Aand grade the papers fairly.⑸ Party B shall give his/her students average scores according to their classperformance as required by Party A.⑹ Party B shall hand in the written form of the results of his /her students`exams to Party A.⑺ Party B shall teach according to the Party A’s arrangements, syllabus andschedule and can not change his/her class and schedule without being authorized. Any change must be approved by Party A after Party B’s written application is provided.Ⅱ Payment.ⅰ Direct Payment.⑴ Monetary Salary: Party B will be paid RMB/month in cash.⑵ The paydays will be from 25th to the last day of each month. If the pay isdelayed owing to some unpredictable reasons, Party A will inform Party B for the reasons and a new possible payday.⑶ Party B will be paid monthly according to the contract stipulations,provided that Party B can start his/her work on time according to the contract. In case the actual working time is shorter than a whole month, the payment shall be counted by day and the daily payment shall be 1/30 of the monthly salary (the same with February).Party B will be paid from the actual date he/she starts the work, if Party B can not start his/her work on time according to the contract stipulations or delayed by journey, hiring procedures, private matters etc.⑷ Party B ,under two semesters(or one full academic year)contract, isentitled to be paid ten months which includes nine working months and one month of holiday, and they are September, October, November and December in 2010 and January ,February (holiday),March, April, May and June in 2011;Party B, under one semester contract or the actual working time is not above10 months, is entitled to no paid-vacation.⑸ Party B shall pay the personal income tax in accord with the Personal TaxLaw of People’s Republic of China.ⅱ Indirect Payment.⑴ Party A will guarantee the fundamental living conditions for Party B inthe university during the term of contract, which mainly includes: a free on-campus individual apartment with 3 bedrooms,1 living-room, 1 kitchen,1 bathroom and 1 dinning-room. The apartment is equipped with fundamental furniture, bedding, kitchenware, 1 refrigerator, 1 hot-water heater, 3 air-conditioners, 1 washing-machine, 1 telephone, 1 TV set, 1 computer,1 printer and heating facilities, act.⑵ Party A will handle and cover Party B’s Work Permit, Expert Certificateand Resident Permit. The fees for Party B’s health examination for certificate and the certificate in China will be covered by Party A.⑶ Party B will be paid RMB2,200 bonus as Travel allowance when the contractis finished, provided the contract time is two semesters and the teaching result is good.⑷ Party A will provide transportation to and from work or provide propertransportation allowance for Part B whose work place is far from residence.⑸ Part A will provide international air ticket (international economy classair ticket for the nearest distance between China and the country where the employed party are from).Airfare: single trip for one semester(contract time no less than 6 months), round trip for two semesters (contract time no less than 11 months).If Party A is asked to provide tickets for Party B, Party B shall inform Party A of their detailed travel arrangement at least two month before the expiration of the contract. If Party B can not provide copies of invoice or other proofs of the air tickets, Party A will pay Party B RMB 5,000 for one semester or RMB 10,000 for two semesters.⑹ Party B’s Luggage transportation expenses of one-way to China will bereimbursed before the expiration of the contract and leave. Party B must provide Party A with the formal documents of the baggage charges or invoices, and the maximum reimbursement shall not exceed 20% of airline tickets to China. If by air transport, the expenses shall be calculated by separate transportation for 24 kilograms, not by that of accompanying transportation.Since airlines between China and the U.S. stipulate to carry two large pieces of luggage of 64 kilograms for free, the employed party from the United States may not bear the luggage transportation expenses.⑺ Party B is free to use internal telephone within the University, free touse heating and internet; Party B is free to use water25tons/month and electricity 500kwh/month and pay for the excess.Ⅲ Holidays.⑴ Party B is entitled to the following holidays and festivals in China:weekends(carried out as the Government’s instructions when holidays are adjusted), New Year’s Day, Spring Festival, May Day, National Day and other holidays stipulated by laws and regulations in China.⑵ Party B is entitled to the following festivals and holidays correspondingto their nationalities and religions: two days for Christmas, three days for Corbin, one day for Lesser Bairam and one day for Water-splashing Festival.Ⅳ Absenteeism, Sick leave and Private matters leave.⑴ Any unapproved leave of absence will result in a deduction of the salary,and two days` salary will be deducted for one day’s absence. Party B’s repeated unapproved leaves exceed two times or one absenteeism exceed 7 days(including weekend) will be deemed in breach of this agreement and hold Liability for the breach of the contract. Party A has the option of terminating this agreement and is entitled to make a claim against Part B.⑵ Certificate or proof from doctors appointed by Party A, together with PartyB’s written application approved by Party A, should be presented when PartyB asks for sick leave. If the continuous sick leaves amount to 15 days orabove, a whole monthly salary will be deducted; In case the total sick leaves or the continuous sick leave exceed 30 days within one contract term (one year or one academic year),Party A has the right to terminate the contract.If the contract is not terminated, the 70% of the salary will be paid until the normal work is resumed.⑶ Private affairs leave of Party B shall be approved by Party A and Schoolof Language Studies and The Party A will deduct the salary by day, the daily payment shall be 1/30 of the monthly salary(the same with February). In the contract term (one year or one academic year), the private affairs leaves should not exceed 10 days. The continuous private affairs leave shall be no more than 3 days, and two days’salary will be deducted for each day thereinafter. In case the total private affairs leaves exceed 15 days or the continuous private affairs leave exceed 10 days within one contract term (one year or one academic year), Party A has the option to terminate the contract.⑷ If Party B asks for sick leave or private affairs leave, he/she shall finda substitute teacher for his/her classes who must be approved by Party A;Party A will help Party B to get one substitute teacher in case Party B has difficulty in doing so. During this period the substitute teacher will get his/her payments for the extra classes from Party B` monthly salary, RMB100 per period.Ⅴ Diseases and Medical.⑴ Party B shall guarantee that he/she is healthy enough to be qualified forthe teaching task, and Party B’s actual state of health and potential risk of major diseases shall be notified to Party A. If Part B’s age is over 60, proof of medical examination shall be provided to Party A.⑵ Party A will cover the insurance against Personal Accidental Death andInjury and Medical Insurance for Party B in China during the contract term, and any extra premium for additional coverage, if required, shall be borne by the employed party.⑶ If Party B fall ill when working in the university or being on a businesstrip required by Party A during the contract time, medical expenses will be borne by Medical Insurance, and extra medical expenses, which exceeds Personal Accidental Death & Injury Insurance premium and Medical Insurance premium, should borne by Party B. If Party B falls ill when staying outside China, or in Taiwan Region, Hong Kong Region, Macao Region, or in other countries, medical expenses will be borne by Party B.Ⅵ Liability Exemption.⒈Liability Exemption for Loss of Life and Disability.Party A shall be exempted from the liabilities for the loss of life and disability of Party B for any of the following circumstances:⑴ Any intentional act of the applicant;⑵ Criminal act, addiction to narcotic, fighting, drunkenness, self-injuryor suicide of Party B;⑶ Driving while intoxicated or driving without license of Party B;⑷ AIDS or other VD of Party B;⑸ War, military action, civil rebellion or armed revolt;⑹ Nuclear explosion, radiation or pollution;⑺ Sudden major diseases of Party B.⒉Liability Exemption for Medical Treatment (accidental injury medicaltreatment, hospitalization medical treatment and major medical expenses) Party A shall be exempted from the liabilities for any of the following circumstances:⑴ Criminal act or arrest resistance , suicide or intentional self-injury ofParty B;⑵ Fighting, drunkenness, illegal drug taking, or addiction of Party B;⑶ Driving while intoxicated or without license or driving motor-drivenvehicle without valid driving certificate of Party B;⑷ Medical accident occurred during the cosmetic operation or other physicianor surgical treatment of Party B;⑸ The expenses for orthopedic, cosmetic operation or rehabilitatingtreatment of Party B;⑹ Registration fee, expenses for board, accompanying accommodation, heatingand traffic of Party B;⑺ Items and drugs at private expense stipulated by the local departments incharge of the social basic medical insurance or medical treatment on public expense of Party B;⑻ Taking, using or injecting drugs not in conformity with doctor’s adviceof Party B;⑼ War, military act, rebellion or armed revolt ;⑽ Nuclear explosion, radiation or pollution;⑾Previous disease, mental disease, AIDS, VD, congenital or hereditary disease and the complications before the first application for insurance; ⑿ Medical treatment expenses occurred outside of the People’s Republic of China;⒀ Out-patient treatment expenses of common disease.⒁ Sudden major diseases of Party B.Ⅶ The Probation period of the Contract and the Credit Bail.⑴ The probation period of Party B shall be 30 days. In the probation period,if Party A finds out that Party B is unfit for the assignment specified in the contract for reasons of health or professional ability, it has theright to terminate the contract.⑵ Party A provides Party B with the international air ticket to China, butParty B should purchase the ticket by him/herself (with the traveling expenses as the credit bail), and the expenses will be reimbursed on handing in the receipt before the expiration of the contract and leave.Taking into account of the housing and property security, Party A usually reimburse the airfare to Party B when Party B hands over the key of the apartment.Ⅷ Other Conditions⑴ Sexual relationships with students, including dating students, stayingovernight with heterosexual students, cohabiting with heterosexual students, or other inappropriate behaviors to students, are not allowed.In the event this should occur, the matter will be investigated by PartyA and if the events are proven to be true, the consequences will resultin the termination of employment and the contract, and Party A will makea claim against Party B.⑵ Party B is expected to ensure his/her own safety and his/her belongingssecurity, inform Party A when leave Shangqiu City or China, observe Chinese traffic rules, cut off the electricity and water supply, lock the apartment before leaving, and use electrical appliances correctly.⑶ Party B is expected to take good care of the furniture and equipments. Thefull price has to be paid for anything lost or damaged non-normally and purely man-made factors. Party A is responsible for the normal repair.⑷ When Party B wants to sponsor some faculty or students for extracurricularactivities, it is necessary to notify Party A such activities which can be organized upon approval. Party A will offer convenience or cooperate when necessary.⑸ Party B’s telephone charges of long-distance calls in Shangqiu, domesticlong-distance calls and international long-distance calls are borne by Party B.⑹ Party B shall not render service elsewhere or hold currently any postunrelated to the work agreed on with Party A. If Party B renders service elsewhere, Party B will be deemed in breach of this contract. Party A will inform Party B in written notice to stop his/her part-time job elsewhere, If Party A continue to do so, Party A is entitled to terminate the contract and make a claim against Party B.⑺ All the expenses incurred during Party B's stay in China will be born byParty B after the contract is terminated due to Party B’s breach of the contract.Ⅸ Confirmation and change of every term of the appendix of the standard contract must be stipulated in written form through negotiation between the two parties. Any oral agreement will be regarded as invalid. This appendix has equal validity of the standard contract and comprises anintegral part of the contract.ⅩThis appendix is signed at Shangqiu City, in duplicate, each in Chinese version altogether 4 pages, and English version altogether 6 pages, and both shall take effect equally upon being signed at the same time.ⅪThis appendix shall take effect upon being signed by both parties and shall be automatically terminated upon expiration.
