1/1/09INSTITUTE CARGO CLAUSES (A)RISKS COVERED2009年1月1日协会货物条款（A）承保风险Risks1. This insurance covers all risks of loss of or damage to the subject-matter insured except as excluded by the provisions of Clauses 4, 5, 6 and 7 below. 风险1. 风险（Risks）本保险承保除了下述第4、5、6和7条规定的除外责任以外的保险标的的灭失或损害的一切风险。
General Average2. This insurance covers general average and salvage charges, adjusted or determined according to the contract of carriage and/or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those excluded in Clauses 4, 5, 6 and 7 below.2.共同海损（General Average）本保险承保根据运输合同及/或适用法律和惯例理算或确定的，为避免或与避免任何原因导致的有关引起共同海损和救助费用的损失，但不包括以下第4、5、6和7条的除外责任。
"Both to Blame Collision Clause"3. This insurance indemnifies the Assured, in respect of any risk insured herein, against liability incurred under any Both to Blame Collision Clause in the contract of carriage. In the event of any claim by carriers under the said Clause, the Assured agree to notify the Insurers who shall have the right, at their own cost and expense, to defend the Assured against such claim.3.“船舶互有责任碰撞条款”（"Both to Blame Collision Clause"）本保险赔偿被保险人根据运输契约的船舶互有责任碰撞条款，由被保险人就承保风险应承担的责任。
在上述条款下若承运人向被保险人提起索赔，被保险人同意通知保险人，保险人有权自负费用为被保险人就此项索赔抗辩。
EXCLUSIONS除外责任4. In no case shall this insurance cover4. 在任何情况下，本保险不承保：4.1 loss damage or expense attributable to wilful misconduct of the Assured 4.1可归因于被保险人的恶意行为引起的灭失、损害或费用；4.2 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject-matter insured4.2保险标的的自然渗漏、重量或容量的自然损耗或自然磨损；4.3 loss damage or expense caused by insufficiency or unsuitability of packingor preparation of the subject-matter insured to withstand the ordinary incidents of the insured transit where such packing or preparation is carried out by the Assured or their employees or prior to the attachment of this insurance (for the purpose of these Clauses "packing" shall be deemed to include stowage in a container and "employees" shall not include independent contractors)4.3 由于保险标的的包装或配装不足或不当引起的无法承受运输途中发生的通常的事故而产生的灭失、损害或费用，此种情况适用于：该包装或配装是由被保险人或其受雇人员完成的，或该包装或配装是在本保险责任开始前完成的。
( 本条所称的“包装”，包括集装箱内的积载；本条所称的“雇员”，不包括独立合同人。
)4.4 loss damage or expense caused by inherent vice or nature of the subject-matter insured4.4 保险标的的固有缺陷或特性导致的灭失损害或费用；4.5 loss damage or expense caused by delay, even though the delay be caused by a risk insured against(except expenses payable under Clause 2 above) 4.5迟延引起的灭失损害或费用，即使该迟延由于承保风险所引起( 上述第2 条可以赔付的费用除外) 。
4.6 loss damage or expense caused by insolvency or financial default of the owners managers charterers or operators of the vessel where, at the time of loading of the subject-matter insured on board the vessel, the Assured are aware, or in the ordinary course of business should be aware, that such insolvency or financial default could prevent the normal prosecution of the voyage.This exclusion shall not apply where the contract of insurance has been assigned to the party claiming hereunder who has bought or agreed to buy the subject-matter insured in good faith under a binding contract.4.6因船舶所有人、经理人、租船人或经营人破产或不履行债务导致的灭失损害或费用。
此情况适用于，在保险标的装上船舶之时，被保险人知道或被保险人在正常业务经营中应当知道，此种破产或不履行债务会导致该航程被取消。
本条除外条款不适用于，当保险合同已经转让给另一方，即另一方已经善意购买或同意购买保险标的且受保险合同约束。
4.7 loss damage or expense directly or indirectly caused by or arising from the use of any weapon or device employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.4.7 因使用任何原子或核子裂变和( 或) 聚变或其他类似反应或放射性力量或物质的武器或设备直接或间接导致的灭失损害或费用。
5. 5.1 In no case shall this insurance cover loss damage or expense arising from5.5.1 本保险在任何情况下均不承保因下述原因所致的灭失损害或费用：5.1.1 unseaworthiness of vessel or craft or unfitness of vessel or craft for the safe carriage of the subject-matter insured, where the Assured are privy to such unseaworthiness or unfitness, at the time the subject-matter insured is loaded therein5.1.1被保险人在保险标的装船时已经知道船舶或驳船的不适航，及船舶或驳船不适合安全运输保险标的。
5.1.2 unfitness of container or conveyance for the safe carriage of the subject-matter insured, where loading therein or thereon is carried out prior to attachment of this insurance or by the Assured or their employees and they are privy to such unfitness at the time of loading.5.1.2在本保险合同生效前，装载已开始或已完成，或被保险人或其受雇人在装载时已经知道集装箱或运输工具不适合安全运输保险标的。
5.2 Exclusion 5.1.1 above shall not apply where the contract of insurance has been assigned to the party claiming hereunder who has bought or agreed to buy the subject-matter insured in good faith under a binding contract.5 . 2 上述 5 . 1.1 所述的除外条款不适用于: 当保险合同已经善意转让给另一方 ,即另一方已经购买或同意购买保险标的且受合同约束。
