关于企业实行不定时工作制和综合计算工时工作制的审批管理办法

关于企业实行不定时工作制和综合计算工时工作制的审批管理办法第一条 为加强对企业实行不定时工作制和综合计算工时工作制的审批管理,维护劳动者的合法权益,根据《中华人民共和国劳动法》、原劳动部《关于企业实行不定时工作制和综合计算工时工作制的审批办法》(劳部发〔1994〕503号)和国家有关规定,制定本办法。

第二条 企业部分岗位因生产特点或工作性质不能实行标准工时制度的,经企业申请、劳动保障行政部门批准,可以实行不定时工作制或综合计算工时工作制。

国家机关、事业单位、社会团体、个体经济组织、民办非企业单位和与其建立劳动关系的劳动者,依照本办法执行。

第三条 不定时工作制是指因生产特点、工作特殊需要或职责范围,无法按标准工作时间衡量、需机动作业而采取不确定工作时间的一种工时制度。

综合计算工时工作制是指因工作性质特殊或受季节及自然条件限制,需在一段时间内连续作业,采取以周、月、季、年等为周期综合计算工作时间的一种工时制度。

第四条 企业申请实行不定时或综合计算工时工作制,应报企业法人工商营业执照登记注册地县级以上劳动保障行政部门审批。

省直属企业、部队企业经主管部门审核后报省劳动保障行政部门审批。

中央企业驻粤分支机构按国家及省有关规定执行,已经国务院人力资源和社会保障部门批准的,应将批复文件报送企业登记地县级以上劳动保障行政部门备案。

第五条 企业申请实行不定时或综合计算工时工作制,应当提交以下材料:(一)企业实行不定时或综合计算工时工作制申请表(见附件一),写明岗位(工种)的职能、特点和申请理由。

(二)企业实行不定时或综合计算工时工作制的申请报告、实施方案、工时管理及工资支付规章制度。

实施方案及规章制度需向本单位职工公示至少5个工作日,并提交公示反馈意见。

(三)企业申请实行不定时或综合计算工时工作制职工名册及职工签名表(见附件二)。

(四)企业法人营业执照副本及复印件。

(五)实行期满需再次申请的企业,应当书面报告上期实施情况。

(六)法律、法规或规章规定需要提交的其他材料。

第六条 劳动保障行政部门应对企业报送的申请材料进行审核。

根据实际需要,可指派两名以上工作人员对企业进行实地核查。

有下列情形之一,应对企业进行实地核查:(一)申请实行不定时和综合计算工时工作制职工人数占企业职工总数50%以上;(二)申请实行以季、半年或年为周期的综合计算工时工作制的。

第七条 劳动保障行政部门对申报不定时或综合计算工时工作制企业实地核查的内容应当包括:(一)企业生产经营特点,工作时间、考勤管理制度及执行情况,工资分配制度及支付情况;(二)申请实行不定时或综合计算工时工作制人员工作岗位和工时安排等情况;(三)企业工会或职工代表意见。

企业和劳动者应当对审查工作予以配合,据实提供材料。

第八条 劳动保障行政部门应当在受理申请之日起20个工作日内作出是否准予实行不定时或综合计算工时工作制决定。

如情况特殊需要延长时间的,经劳动保障行政部门负责人批准,可延长10个工作日。

申请材料不齐全的,从补齐之日起计算。

批准决定中应当包含企业实行不定时或综合计算工时工作制的岗位名称、实行时间、综合计算工时计算周期、执行中的注意事项,并可根据不同岗位特点对劳动者日或周工作时限作出具体规定。

每次批准实行期限一般为一年,最长不得超过两年。

第九条 经批准实行不定时工作制和综合计算工时工作制的企业,应当将劳动保障行政部门的批准决定在单位内公示,明确实行的工种及人员,并在劳动合同中予以明确,不得混岗混员、擅自扩大实行范围。

企业应根据标准工时制度合理确定劳动者的劳动定额和其他考核标准,合理安排劳动者休息。

对实行综合计算工时工作制的职工,应按《广东省工资支付条例》及国家有关规定计发加班或延长工作时间工资。

第十条 企业应当建立实行不定时和综合计算工时工作制登记存档制度。

登记存档内容应包括实行人员、岗位、实行时间、综合计算工时计算周期、综合计算工时考勤记录,并应经劳动者签名确认。

档案应至少保存两年。

第十一条 各级劳动保障行政部门应加强对企业实行不定时和综合计算工时工作制的监督检查,建立企业执行工时情况定期检查和信息公布制度,并将企业执行工时制度情况纳入企业信用监督机制。

对于违反工作时间和休息休假规定的用人单位,严格按照《劳动保障监察条例》的规定作出处理。

第十二条 本办法自2009年3月1日开始施行。

已批准实行但没有规定实行期限的企业,应在本办法发出之日起60日内重新办理申报手续。

附件: 实行不定时或综合计算工时工作制申请表.doc附件: 实行不定时或综合计算工时工作制职工签名表.doc(Since the English translation has not been vetted by PPD, it should only be used as reference and with care.)Administrative Measures of Labor and Social Security Department of Guangdong Province on the Examination and Approval Concerning Enterprises Implementing Flexible System for Working Hour and the System for Comprehensive Calculation of Working hoursYue Lao She Fa [2009] No. 8February 1, 2009Article 1 With a view to Strengthening the administration on the examination and approval of flexible system for working hours and the system for comprehensive calculation of working hours and safeguarding the lawful rights and interests of workers, these Measures are formulated in accordance with the Labor Law of the People's Republic of China, Measures of the Former Ministry of Labor on Examination and Approval of the Flexible System for Working Hours and the System for Comprehensive Calculation of Working Hours of Enterprises (Lao Bu Fa [1994] No.503) and relevant regulations of the State.Article 2 Where the standard working hour system cannot be applied to some posts of an enterprise due to the production characteristics or work nature, the flexible system for working hours or the system for comprehensive calculation of working hours may be implemented after the administrative department of labor and social security approves the application filed by the enterprise.The state organs, public institutions, social organizations, individual economic organizations and non-government non-enterprise units and the workers who establish labor relationship with them shall implement in accordance with these Measures.Article 3 Flexible system for working hours is the working hour system for the employees whose working hours can not be measured by standard working hour system or who need to work flexiblydue to the production characteristics, special requirements of work or work responsibilities.The system for comprehensive calculation of working hours is a working hour system for the employees who need to work continually because whose work are restricted by seasons or natural conditions due to the special nature of work and who adopt week, month, quarter, year, etc. as the cycle for comprehensive calculation of working hours.Article 4 To implement flexible system for working hours or the system for comprehensive calculation of working hours, an enterprise shall submit an application to the administrative department of labor and social security above the county level of the place where the business license of the enterprise as a legal person is registered for examination and approval. Enterprises directly under the provincial government and army enterprises shall submit to the provincial administrative department of labor and social security for examination and approval upon the verification of competent authorities. The branches of central enterprises in Guangdong Province shall implement according to the provisions of the State and Guangdong Province and where such matter has been approved by Ministry of Human Resources and Social Security under the State Council, the branches shall report and submit the approval documents to the administrative department of labor and social security above the county level where the enterprise is registered for record.Article 5 To apply for implementing flexible system for working hours or the system for comprehensive calculation of working hours, an enterprise shall submit the following materials: (1) Application of an enterprise for implementing flexible system for working hours or the system for comprehensive calculation of working hours (Attachment I), which shall specify functions and characteristics of post (type of work) and reasons for application.(2) Application letter, implementation plan, and rules and regulations on working hour administration and wage payment of an enterprise for implementing flexible system for working hours or the system for comprehensive calculation of working hours. The implementation plan and rules and regulations shall be made public to the employees of the enterprise for at least 5 working days and the feedback opinion from the publicity shall be submitted.(3) Roster of employees in respect whom the enterprise applies for implementing flexible system for working hours or the system for comprehensive calculation of working hours and signature form of such employees (Attachment II).(4) Duplicate of business license of enterprise as a legal person and the copy thereof.(5) Written report on the implementation of the pervious period where the enterprise makes a new application upon the expiration of the previous implementation period.(6) Other materials as provided for by laws, regulations and rules.Article 6 The administrative department of labor and social security shall examine theapplication materials submitted by the enterprise. It may appoint more than two working personnel to conduct spot inspection of the enterprise according to actual needs. The spot inspection shall be conducted under any of the following circumstances:(1) The employees in respect of whom the implementation of flexible system for working hours or the system for comprehensive calculation of working hours is applied account for 50% of the total employees of the enterprise;(2) The enterprise applies for implementing the system for comprehensive calculation of working hours by the calculation cycle of quarter, half a year or year.Article 7 The contents of spot inspection of enterprises that apply for flexible system for working hours or the system for comprehensive calculation of working hours conducted by the administrative department of labor and social security shall include:(1) Production and business characteristics of the enterprise, working hours, attendance management system and the implementation thereof, wage distribution system and the payment of wage;(2) Working posts and working hour arrangement as well as other relevant information of employees in respect of whom the implementation of flexible system for working hours or the system for comprehensive calculation of working hours is applied;(3) The opinion of the trade union or employee representative of the enterprise.The enterprise and the employees shall cooperate in the inspection work and truthfully provide materials.Article 8 The administrative department of labor and social security shall make decision on whether to approve the implementation of flexible system for working hours or the system for comprehensive calculation of working hours within 20 working days after receiving the application. If the time limit needs to be extended due to special circumstances, it may beextended for 10 working days upon the approval of the director of the administrative department of labor and social security. If the application materials are not complete, the time limit shall count from the date when all the materials are completed.The approval decision shall include the post names of the enterprise that adopt flexible system for working hours or the system for comprehensive calculation of working hours, implementation time, the calculation cycle for comprehensive calculation of working hours, matters that need attention in implementation and also may make specific stipulation on the daily or weekly working hour limits of employees according to the characteristics of different posts. The implementation period of each approval shall usually be one year and shall not exceed two years at the longest.Article 9 The enterprise that is approved to implement flexible system for working hours or the system for comprehensive calculation of working hours shall publicly announce the approval decision of the administrative department of labor and social security in the unit to specify the type of work and employees that adopt such system, and shall not make employees take up different posts so as to expand the implementation scope without authorization.The enterprise shall reasonably determine the labor quota and other assessment standards of employees according to standard working hour system and reasonable arrange for the employees to rest. With regard to the employees that adopt the system for comprehensive calculation of working hours, the wage for overtime or extended working hours shall be calculated and paid according to Regulation of Guangdong Province on the Payment of Wages and relevant provisions of the State.Article 10 The enterprise shall establish registration and filing system for the implementation of flexible system for working hours or the system for comprehensive calculation of working hours. The contents of registration and filing shall include persons that implement such system, posts, implementation time, calculation cycle for comprehensive calculation of working hours, attendance record for comprehensive calculation of working hours, and such contents shall be signed and confirmed by employees. The file shall be kept for at least two years.Article 11 The administrative department of labor and social security of each level shall strengthen the supervision and examination on the implementation of flexible system for working hours or the system for comprehensive calculation of working hours by the enterprise, establish the system for regular examination and information release of the implementation of working hour system by the enterprise, and include the implementation of working hour system by the enterprise into the corporate credit supervision mechanism. The employers that violate the provisions on working hours and rests & vacations shall be punished strictly according to Regulation on Labor Security Supervision.Article 12 These Measures shall come into force as of March 1, 2009. The enterprise whose implementation has been approved but in respect of which the implementation period is not specified shall handle application procedure anew within 60 days from the promulgation of these Measures.Attachment:1.
