甲方为本公司文化宣传进行广告拍摄活动，特邀西安外国语学院_____________乙方作为本次拍摄活动协助模特，参与本次拍摄活动，为明确保障双方双方合法权益，活动模特乙自愿与甲方达成如下协议，并签约共同遵守。
In order to shoot advertisement for propagandizing the culture of this company, Party A hereby invites Party B-------from Xian Foreign Language School as the model assisting shooting and taking part in this activity. To ensure both parties’ legal rights and interests, Party B agrees to sign the agreement with Party A and both abide by the following terms and conditions:
1．拍摄活动，

摄影时间，地点由甲方与摄影师协商确定，乙方自愿配合甲方保证拍摄的作品内容健康，格调高雅，确实具有艺术品位，不得含有不健康内容。具体拍摄时间经甲乙双方协定，拍摄时间长为每日6小时。若乙方提前完成高质量的拍摄活动，甲方可以提前让乙方结束工作。The shooting time and place is confirmed by Party A together with photographers. Party B agrees to support shooting which is legal, graceful with high art taste instead of any harmful content. The shooting time is six hours per day and the specific arrangement is agreed by both parties. Provided that if Party B completes high-qualified shooting work ahead of schedule, Party A shall finish Party B’s work in advance.
2. 用途、使用范围
Usage and Scope
拍摄的作品的著作权，出版权，发行权，获得报酬权均属甲方所有：
此样片涉及的乙方肖像使用权归属甲方；乙方同意接受甲方将肖像作品用于宣传、展示、展览等合法用途的宣传品以及户外广告、网络及电视广告宣传。
All shot works’ rights of publication , distribution , copying, and being paid belong to Party A：The right to use Party B’s image or portrait related to this shooting belongs to Party A; Party B agrees and accepts that Party A use shot works to propaganda ,show, exhibition and other legal promotion usage, such as advertising on outdoor network and TV.
乙方同意授权甲方拍摄者可通过特殊的表现形式，在拍摄是将模特五官隐去，如剪影、背影。或通过暗房和Photoshop 技法加以处理，使用品中人物形象无法让人分辨。同意甲方拍摄者可在后期制作种对肖像作品进行技术处理。
Party B agrees to authorize Party A to shoot in particular way such as hiding the face of model, and process with skills of cucoloris, shadow, darkroom, and Photoshop software. Thus, the person can not be figured out in the shot works. Party B agrees that photographer is entitled to process in technology with the portrait works during post production.
3. 版权归属及使用年限
版权归属及使用年限：摄影作品的发表权、使用权、修改权、获得报酬权由甲方在存续期以及存续期后五十年内所有。同时，甲方允许乙方获得一份拍摄样品的副本，但此副本均是甲方完成后期制作以后并添加甲方公司或个人性质的水印。乙方承诺甲方此照片样本只作为个人使用。如果此类照片出现在非本公司网站以及其他具有盈利性质的媒体、展示、展览、宣传品以及户外广告、网络及电视广告宣传。甲方可以在法律的权限内追究乙方责任，如后果或情节严重，甲方可以追究乙方进行民事赔偿。
4. 报酬及支付方式
甲方同意在乙方完成每一次的拍摄，按天支付给乙方模特拍摄及肖像权使用费用共650元每天。
5．违约责任
乙方订立订立本协议后不配合摄影师完成本协议约定的摄影，乙方无权获取报酬；因拍摄广告造成乙方的自身家庭及社会矛盾，由乙方个人自行承担。
乙方完成拍摄后甲方不按约定支付给乙方摄影及肖像权使用费的，应承担违约责任。因甲方对乙方肖像作品进行技术处理所造成的与第三人的侵权有甲方承担。
6 本协议一式两份，双方签字生效，各持一份。如果有争议可协商补充达成协议，具有同等法律效力。
