客户资金安全担保协议

Fund Safety Agreement

Party A (甲方):Australia AFT Finance Market Pty

Party B (乙方):

Party C (丙方):西安炳隆商务咨询服务有限公司

作为甲方授权的外汇咨询合作及代理商，丙方愿意就乙方在甲方平台进行外汇交易，并开设真实外汇

账户，为乙方开户及存取款过程提供资金安全担保，本协议经乙、丙双方协商一致，达成如下协议:

As a authorized first premier brokerage firm of Party A in Asia, with respect to Party B’s forex transaction on

Party A’s platform and establishment of real forex account, Party C is willing to provide fund safety guarantee against Party B’s fund, Party B and Party C agree as follows:

第一条:丙方在本协议中，为乙方资金安全提供担保，以期做到:乙方投资资金在甲方开设外汇交易账户，

并开设专用外汇账号，提供专用密码。如开户程序不能完成，甲方必须返还乙方已为其汇出的全部资金。

Party C will provide fund safety for Party B’s fund herein. Party B will establish forex trade account with

Party A and open real forex account with password for the investment fund. In case of failure to complete the

procedure for establishment of account, Party A must refund all funds Party B invested.

第二条:甲、乙双方于年月日签订投资理财协议，乙方以汇款的方式将投资所需金额: 万

元整(, RMB )在甲方银行开设交易账户(以银行汇款回执、对账凭证或类似单据为准)。

Party A and Party B entered into investment and financing agreement dated__ __ day_ _ of 2011. Party

B will remit the amount required for investment, ______ ___ (,_ RMB______) to establish a trading

account with Party A Bank (subject to the bank remittance receipt or bill statements etc. )

第三条:甲方在收到乙方提交的个人资料、本人身份证(复印件)，三至五个工作日内(如遇到法定节假日

顺延至下二个工作日)完成乙方的外汇账户开设。如资料或证件不清晰造成的延误，由乙方自行负责。

Party A will complete the establishment of Party B’s forex account within three business days to ten business

days (for public holiday, to the next business day )as upon receipt of personal information, ID certificate (copy)

provided by Party B.

第四条:甲方在协议规定的时间内未为乙方开立外汇账户，甲方必须把乙方已汇出的全部款项退还给乙方;

如乙方要求提款后，未能顺利从甲方取回账户款项，则由丙方在第二十个工作日承担先行还款义务。同时，

丙方有权向甲方追讨该款项并保留相应的权利。

In case of failure to establish forex account for Party B with the stipulated time hereunder, Party A must refund

Party B’s all amount wired; If upon request of drawing, Party B fails to withdraw such amount, Party C shall

bear the obligation to refund such amount in advance within twenty business days. Notwithstanding, Party C

shall be entitled to recourse for such amount and reserve the relevant rights.

第五条:本协议不为第三方开户或汇款者的资金进行安全担保。如有发现非乙方本人开户汇款或提款，将

视为乙方违约，丙方将不提供资金担保或承担相应责任。

This agreement shall not be effective if the account is not opened by Party B himself/herself, and the fund

is not wired, deposited and withdrew by Party B himself/herself. Meanwhile, Party B is entitled to cause

default of the agreement, and therefore Party C shall not provide any warranty on fund safety issues and be

responsible on relevant fund issues.

第六条:本协议生效后，甲或乙方需要变更主协议的有关条款，应征得丙方同意，由乙、丙双方重新达成书

面协议。
