叶宇飞 我国代位继承制度研究 3 中 文 摘 要 代位继承制度的一般规定，在世界和时代发展的现代法律要明确和完善。在我国，代位继承制度是指继承人死亡或者失去继承权，由继承人的继承人继承被继承人的遗产的制度。代位继承制度实际上是法律继承的必要补充，是法定继承的一种特殊形式，它会保护的权利和利益的人的直系后裔，安全的作用是不容忽视的。随着时代的进步，人们的法律意识增强，逐渐，代位继承制度逐步完善。目前，根据中国的基本条件，代位权限制的范围仍然是非常严格的，有是一个很大的争议在法学界，有是仍然在应用的一些问题代位继承制度的理论和实践，对于这些情况我们需要探究。研究代位权，产地和其他相关理论问题的性质，分析了在我国代位继承制度的现状，以及中国的代位继承系统相比国外，分析和研究系统中的一些有争议的问题，并提出了一些建议。
