Force Majeure ：
The sellers shall not be held responsible for the delay in shipment or non-deli-very of the goods due to Force Majeure， which might occur during the process of manufacturing or in the course of loading or transit. The sellers shall advise the Buyers immediately of the occurrence mentioned above the within fourteen days there after . the Sellers shall send by airmail to the Buyers for their acceptancea certificate of the accident. Under such circumstances the Sellers， however，are still under the obligation to take
all necessary measures to hasten the deliveryof the goods.

篇一：网络技术支持及服务协议 网络技术支持及服务协议 甲方： 乙方：池州市房地产网络信息中心 根据《商品房入网销售申请暨承诺书》，甲乙双方经友好协商，就乙方向甲方提供“池州网上房地产”技术支持及服务事宜，达成如下协议，特订立本合同。 一、自““网上房地产”技术支持及有偿服务，甲方支付乙方费用： 总计人民币(小写)：元 总计人民币(大写)：。 二、乙方责任 1、乙方建立完善的用户档案，负责甲方用户密钥的制作、登记、发放、注销等管理工作。 2、乙方根据甲方提交的入网资料，保证受理资料齐全，入网信息录入准确无误。商品房预售许可证发放次日内完成入网项目的挂接工作，项目信息公示上网。 3、甲方如是新开通的用户，乙方提供上门协助服务，为甲方上门安装密钥、设臵应用环境，指导甲方进行系统应用的权限设臵，并协助定义首个项目的销售楼盘。 4、乙方每天8：30—18：00提供用户热线技术咨询（法定节假日除外），接到咨询电话应及时、全面解答并记录甲方所提出的问题；若当时不能及时解答的问题，要做详细的记录，尽快与业务部门和设计人员联系给出解决答案后，及时给甲方做出反馈。 5、乙方提供现场应急技术服务。上门为甲方解决在应用软件使用中遇到的因软件故障引起的用户自行无法排除的软件和应用问题，主城区在1小时（郊区2小时）内到达现场，并在短时间内解决问题；较大的问题在处理的同时，应有应急措施。 6、乙方负责做好网上房地产硬件网络平台的维护，提供多种专线访问方式，避免因单条通讯线路故障造成的应用中断，确保系统平台的安全稳定；并根据业务需求及时做好应用软件的开发和维护。如遇系统调整、维护等原因需暂停服务，应提前3天告知甲方。 7、乙方每天备份系统数据，确保甲方数据的安全。 １8、乙方可根据甲方需要对网上操作人员进行培训。并依据系统改造情况，安排培训教材和培训内容，通过业务知识和实际操作能力培训，提高甲方使用能力和操作水平。 9、乙方建立与甲方的回访制度，定期以电话、反馈邮箱等方式了解甲方的使用状况和业务需求，不断完善应用服务。 10、凡是因为甲方自身硬件和网络或因运行非乙方提供的软件造成使用中的问题, 乙方有义务提供相应的技术指导,但是不承担任何责任。 三、甲方责任 1、所有从事网上销售的人员必须持证上岗（一个公司不少于两人），因工作人员操作失误而导致要求乙方经常性修正（单个项目错误数不超过10处视为经常性）,每超过一处甲方应另行支付乙方技术服务费。 2、甲方必须准确、及时地反馈在使用过程中遇到的问题，使乙方能及时了解并解决问题。 3、必须按协议约定向乙方支付相关服务费用。 4、甲方在使用过程中造成密钥的物理性损伤或丢失，需更换或补领密钥的，需向乙方支付除密钥制作和维修费用。 5、甲方不得对软件使用权私自或供他人进行破密等损害乙方权益的活动，一经发现，将追究其法律责任。 四、付款方式及其他 乙方在收到甲方入网项目全部技术服务（一次性支付）后,即时给甲方提供系统使用的权利。 五、本合同一式贰份，双方各持壹份，一经签署，立即生效。

Claim for quality discrepancy should be filed by the Buyer within 60 days after arrival of the goods at the final destination while for quantity / weight discrepancy claim should be filed by the Buyer within 30 days after arrival of the goods at the final destination.
