教学大纲法学院《国际商法》(双语)教学大纲(殷楠)

《国际商法》(双语)教学大纲(International Business Law)编制单位:法学院编写人:殷楠审核人:路广编制时间:2010年9月课程说明一、课程概述(一)课程介绍国际商法是为适应教育部进行双语教学的要求而对法学专业学生开设的一门专业选修课。

国际商法课程的任务主要是培养适应对外经济交往需要,既懂国内法、又懂国际公约、国际商业惯例和外国语的涉外型专业法律人才。

(二)教学目标明确该课程的性质、地位及其研究对象,了解课程的基本体系和基本内容,掌握课程的主要知识点,运用理论知识分析解决实际问题,以提高在英语环境下应用法律的能力,并最终脱离汉语的干扰,能独立使用英语来思考和解决国际经济交往中出现的法律问题(三)课程性质国际商法是法学专业本科阶段的专业选修课。

(四)适用对象国际商法是为法学专业本科高年级学生开设的。

学生应在修完民法、商法、合同法、国际法、国际经济法的基础上,才进入本课程的学习。

(五)预修课程民法;商法;民事诉讼法;国际法;国际经济法。

二、课时分配(一)课时分配说明本课程的总学时为32学时。

(二)课时分配教学要求及教学要点Chapter One Introduction to International Business Law【本章教学目标和要求】:使学生通过对本章的学习,了解国际商法的渊源、历史发展、英美法系和大陆法系的介绍、国际商法与我国法的关系。

由于熟悉本章是学好国际商法的前提,要求学生掌握有关国际商法的基本内容和基本英语词汇,为以后的学习奠定基础。

同时,希望学生通过学习掌握关于国际贸易进出口、国际贸易管理及国际许可证协议的基本词汇,并能够简单翻译。
