第三条：本合同自年月日起，至年月日止。
合同期满前一个月双方协商续签或终止事宜，如未续签，本合同期满自动终止。
第四条：双方的权利、义务、责任1、甲方有权要求乙方组织的劳务人员符合甲方提供的工作岗位要求，且身体健康，无慢性病史，并持有本年度卫生防疫站所发健康证。
2、甲方有权根据预定情况，要求乙方及时派出劳务人员，并要求乙方保证人员数量。
3、甲方要求乙方派遣的劳务人员需要具备一年以上工作的工作经验，且年轻在20-25 岁之间。
4、乙方劳务人员的各项社会保险（包括医疗保险及人身伤害保险）的缴纳及人事档案及相关事宜的办理由乙方负全部责任，乙方违反该约定而造成的一切后果均由乙方负全部责任。
5、甲方有义务对乙方派出的劳务人员进行与岗位相适应的专业培训和教育。
6、甲方有义务对乙方劳务人员的工作表现通知乙方，并协调处理相关事宜。
7、乙方有权要求甲方按劳动法和相关政策、法规，维护乙方劳务人员的合法权益。
8、乙方劳务人员如在工作中发生较重工伤事故，甲方应给予及时、积极的抢救，并及时通知乙方。
需做工伤鉴定的，应由乙方请有关部门做工伤鉴定，并由乙方处理善后事宜。
乙方劳务人员的工伤事故甲方负有直接责任的，甲方按照责任的比例负责善后事宜。
9、乙方有责任按甲方要求及时提供符合甲方要求的劳务人员，所派劳务人员应无违纪和犯罪记录，品行良好。
对于乙方派出的劳务人员，甲方一旦发现其有不良记录或在工作中违反劳动纪律、违反甲方的规章制度或不能胜任甲方工作要求的，甲方可要求乙方随时更换。
10、甲方在有临时变动或突发事件发生前，需在提前至小时内通知乙方。
如不能在规定的时间内通知乙方，给乙方造成的经济损失，由甲方全部负责。
第五条：劳务费用及相关事宜1、甲方按乙方劳务人员在甲方的服务总小时数支付乙方劳务费用。
支付标准为：服务每人每小时元人民币。
国家法定节假日期间甲方应支付三倍费用，即每人每小时元人民币。
2、甲方应保证乙方服务人员到点用餐。
3、甲方负责乙方劳务人员的考勤记录并经乙方劳务人员的签字认可。
4、甲方每月月初结算上月乙方劳务费用，经甲乙双方确认后，支付乙方实际发生人员的劳务费。
每月20号前以支票或现金形式支付给乙方。
5、乙方劳务人员所产生的个人所得税，由乙方劳务人员本人全部负担，并由乙方代扣代缴。
6、乙方劳务人员的上岗工服根据工作需要由甲方提供。
7、乙方应确保甲方要求的人数和工作时间派遣劳务人员。
8、乙方为保证服务质量每三个月一周期对员工进行一次培训。
第六条：其他1、乙方劳务人员应遵守甲方的各项规章制度和纪律，服从甲方的领导、管理和教育2、乙方劳务人员如有违反劳动纪律，甲方有权进行必要的批评教育，并通知乙方，如造成经济损失，则视情况由乙方劳务人员当事人承担赔偿责任，同时乙方对于该损失承担连带赔偿责任。
3、如订立本合同所依据的客观情况发生重大变化，致使协议无法履行时，经甲乙双方协商一致，本合同可以解除。
4、本合同未尽事宜以及对本合同任何条款的变更、修改或补充，须由双方协商并签订书面合同方可生效。
5、本合同履行过程中发现其内容与国家或北京市有关规定相悖时，应按国家或北京市有关规定执行。
6、凡因履行本合同时或发生与本合同有关的一切争议，双方应友好协商解决，如协商不能解决，则甲乙双方均有权向法院提起诉讼。
7、本协议一式两份，甲、乙双方各执一份，具有同等效力。

Party B shall fully be resp on sible to pay for service workers' each item ofsocial in sura nces (in clude medical treatme nt in sura nee and Huma n body injuryin sura nee) and pers onnel file and related affairs, any breach of Party B on this clause would result in Party B ' s fullyresponsibilities.5. Party A has an obligati on to carry on professi onal trai ning and educati onfor service workers for their posts.6. Party A has an obligati on to no tice Party B on service workers ' performa nces , and to coordi nate related affairs.7. Party B has power to request Party A for service workers ' legal rights accord ing to the labor law , releva nt policy and regulati ons.8. Party A shall give timely and initiative rescue to service workers in heavyin dustrial accide nts , and shall no tice Party B in time. Party B shall havecompete nt authorities to do in dustrial injury authe nticati on if n ecessary , and shall deal with aftermaths. In case Party A has direct responsibility inin dustrial accide nts , Party A shall be resp on sible for the deali ng of aftermaths according to the proportion of its responsibility.9. Party B has resp on sibility to provide service workers timely as requestedby Party , and such service workers shall have good con ducts without disobedie nt or crim inal records. In case Party A finds out that they have such records orthey disobey labor discipli ne or Party A 's regulati ons , or not compete nt for Party A ' s work requirements during their work , Party A can request Party Bto replace them at any time.10. Party A shall no tice Party B for temporary cha nges or abrupt occurre ncesto hours in adva nee. Any fail to no tice caus ing econo miclosses to Party B would result in Party A ' s fully responsibility;Article 5: Service charges and related affairs1. Party A shall pay Party B service charges according to the total working hoursof service workers for Party A. Payme nt sta ndard: yua n hourly perservice worker for service. During n ati on al legal holidays , PartyA shall pay triple charges , i.e. yua n hourly per service worker.2. Party A should en sure service workers to have meals on time.3. Party A shall be responsible for service workers ' attendance records , signed and approved by Party B.4. Party A shall settle service charges of last month to Party B at the beginning of each month , and shall pay service workers charges accord ing to actualoccurre nce after con firmed by both parties. Party A shall pay Party B in form of the check or cash before the 20th each mon th.5. Service workers shall be fully respon sible for their own in come taxes , and Party B shall be resp on sible to withhold in dividual in come taxes.6. Service workers ' worki ng wears shall be provided by Party A accord ing to work ing requireme nts.7. Party B should ensure quantity and time in sending out service workers as required by Party A.8. Party B shall tra in service workers every three mon ths to en sure service quality.Article 6: Others1. Service workers shall obey Party A' s regulations and disciplines , and complywith Party A ' s leadership , management and education.2. For service workers ' disobedienee , Party A has power to carry on necessary education , and notice Party B, for economy loss caused by such disobedienee , the concerned party shall take the indemn ificati on resp on sibility , and PartyB shall take joint resp on sibility.3. In case great cha nges of objective circumsta nee of this con tract occur , caus ing this con tract can't be impleme nted , this con tract can be termi nated through both parties ' agreeme nt.4. Any unfini shed problem of and any cha nges rectificati on or ame ndme nt to this con tract shall be thorough both parties ' con sultati on and in writi ng form totake effect.5. Any content contrary to national or Beijing regulations during implementingthis con tract , n ati onal or Beiji ng regulati ons shall prevail.6. For any dispute duri ng impleme nting this con tract or relat ing to thiscon tract , both parties should solve it through frie ndly n egotiati on , if negotiation cannot solve it , both parties have power to initiate publicprosecuti on toward the court.7.
