or of matters with in compa ny. resp on sibility of in sura nee compa ny shipp ing Should the Seller fail to make delivery on time, the buyer shal l agree to postp one the delivery on the con dit on that the Seller agrees of pay a pen alty which shall be deducted by the pay ing bank at the time of payme nt. The rate of pen alty is charged at 0.5% of the total value of the cargo whose delivery has bee n delayed for every week, odddays less tha n a week should be coun ted as a week.
But the total amount of pen alty shall not exceed 5% of the total value of the cargo in volved in the late delivery. In case the Seller fail ot make delivery 10 weeks later than the time of shipment stipulated on the con tract, the Buyer shall havbe the right to cancel the con tract and the Seller shall still pay the aforesaid pen alty to the Buer without delay.
Quality / Quan tity Discrepa ncy and Claim: In case the quality
an d/or qua ntity / weight are found the Buyers to be n ot in con formity with the Con tract after arrival of the goods at the port of destination, the Buyers may lodge claim with the Sellers supported by survey report issued by an in specti on orga ni zait on agreed upon by both parties, with the excepti on, however, of those claims for which the in sura nee compa ny an d/or the shipp ing compa ny are tobe held resp on sible. Claim for quality discrepa ncy should be filed by the Buyers with in 30 days after arrival of the goods at the port of dest in atio n,
while for qua ntity/weight discrepa ncy claim should be filed
by the Buyers with in 15days after arrival of the goods at port of dest in ati on. The Sellers shall, with in 30 days after receipt of the no tificatio n of the claim, aend reply to the Buyers.

delayed in whole or in part due to Force Majeure, the Sellers
shall not be liable for non —shipme nt or late shipme nt of the goods un der this Con tract. However , the seller shall no tify the Buyers by fax or telex and furnish the latter within 15 days by registered airmail with a certificate issued by the compete nt authorities at the place of occurre nee attest ing such event or eve nts.
