Party A and Party B, upon equal con sultatio n, hereby agree to con clude and en ter into the terms and con diti ons as below for joi nt complianee in accordanee with the Labor Law of the People's Republic of China and releva nt rules and regulati ons.一、工作合同期限Con tract Term第一条本合同为壹年期限合同。

Clause 2 Party B shall agree to take the positi on as pursua nt to Party A ' work need.第三条乙方工作应达到国内相关职业要求管理标准，并能完成公司所安排合理的工作要求。
Clause 3 Party B shall perform its work in line with releva nt n ati onal sta ndards on the occupati onal requireme nts man ageme nt and shall be capable of reas on able works arran ged by Party A.三、工作保护和条件Working Protection and Working Conditions第四条原则上执行标准工时制度，乙方每日工作时间8小时，每周工作40小时。
Clause 4 Party B shall be subject to the standard working hour system in pri nciple, n amely eight hours per workday and forty hours per week.第五条因设计工作的特殊性，如项目要求需要加班，不计加班费。
Clause 5 Any extra hour worked by Party B for project need as the result of special feature of desig n work shall not be charged.第六条甲方为乙方提供必要的工作条件，建立健全工作方式，制订工作规范和工作制度。
Clause 6 Party A shall provide n ecessary work con diti ons for Party B, establish sound work mode, and formulate job specificati on and system.四、劳动报酬Labor Remuneration第七条甲方每月18日前以货币形式支付乙方工资，每月实发工资税后为兀。
Clause 7 Party A shall on a monthly basis pay Party B ' salary in currency prior to the 18 th day, and Party B ' monthly salary after tax shall be _____ Yuan.五、福利待遇Welfare and Ben efits第八条乙方患病或非因工负伤的医疗待遇按国家、北京市有关规定执行。
甲方按XXX管理制度支付乙方病假工资。
Clause 8 Party B shall be en titled to the medical ben efits as stipulated by the State and Beijing Municipality if he/she falls illor is injured other tha n due to work. Party A shall pay Party B the salary duri ng the sick leave in accorda nee with XXX man ageme nt system.第九条乙方患职业病或因工负伤的待遇按国家和北京市的有关规定执行。
Clause 9 Party B shall be entitled to the benefits as set forth in the relevant rules and regulations of the State and Beijing Municipality if he/she is ill with occupational disease or injured due to work.第十条甲方为乙方提供以下福利待遇：详则见XXX 管理制度。
Clause 10 Party A shall enable Party B to be entitled to the following welfare and benefits: refer to XXX management system for details.六、合约的变更、解除Contract Alternation and Cancellation第十一条有下列情形之一的，甲乙双方应变更合同并及时办理变更合同手续：Clause 11 Party A and Party B shall alter this Contract and promptly go through contract alternation procedures if any of the following circumstances happens:（一）甲乙双方协商一致的；Party A and Party B reach an agreement on alternation upon negotiation;（二）订立本合同所依据的客观情况发生重大变化，致使本合同无法履行的；The performa nee of this Con tract is ren dered discontinued by the substantial change of objective circumstances which the conclusion of this Contract is relied upon;（三）订立本合同所依据的法律法规、规章发生变化的。
Laws, rules and regulations upon which the conclusion of this Contract is relied change.第十二条乙方有下列情形之一的，甲方可以解除本合同：Clause 12 Party A shall be entitled to cancel this Contract in any of the following circumstances:（一）在试用期间被证明不符合录用条件的；Party B is proven during the probationary period not to satisfy therequirements of employment;（二）严重违反劳动纪律或者甲方利益造成重大损害的；Party B materially violates labor disciplines or causessubstantial damage to Party A 's interests;（三）严重失职，营私舞弊，对甲方利益造成重大损害的；Party B seriously neglects his duty, engages in malpractice forselfish ends and brings significant damage to Party A 'sinterests;（四）被依法追究刑事责任的。
