根据《中华人民共和国劳动法》、《中华人民共和国劳动合同法》、《上海市劳动合同条例》以及有关法律、法规和政策,甲方和乙方(以下各自称“各方”,共同称“双方”)遵循平等自愿、协商一致的原则,签订本劳动合同,以确立劳动关系,明确双方的权利和义务,并共同遵守。各方的权利和义务如下:

According to "The Labour Law of the People's Republic of China," "The People's Republic of China Labour Contract law," "Shanghai Labour Contract Regulations," and other relevant laws, regulations and policies, Party A and Party B (below termed "each party," together termed "both parties") shall adhere to the principles of equality and consensus, and will sign this labour contract in order to establish a working relationship and to define the rights and obligations of both sides. The rights and obligations of each side are as follows:

第一条劳动合同期限

Article 1 Labour Contract Time Period

1.1 本合同期限类型为期限劳动合同。

第二条工作岗位、工作职责

Article 2 Work Position and Duty

2.1 甲方安排乙方到___________部门,担任________职位,乙方必须按甲方确定的职务说明书的工作内容,按时、按质、按量完成甲方分配的工作(生产)任务;

2.1 Party A arranges for Party B to work in________department, serving as___[position]_____. Party B, according to the Party A-approved stipulations for the particular post as stated in the work manual, must complete assignments for Party A on time and according to certain quality and quantity standards;

2.2甲方根据生产经营的需要以及依据乙方的能力(专业、技能、健康)和工作表现,可在协商一致的基础上调整或重新分配乙方的工作职位,如乙方同意被分派到一个不同的职位,则甲方有权根据该职位的要求和该职位的市场情况重新审定和调整乙方的报酬。

2.2 According to the needs of production and management of Party A, and according to the ability (specialty, skill, health) and work performance of Party B, Party A can adjust the working position of Party B, or reassign Party B to other positions

on a consensual basis. If Party B agrees to be assigned to a different position, Party A, according to the duties of this position and market conditions, has the right to authorize and adjust the remuneration of Party B.

第三条工作时间

Article 3 Working Time

3.1 甲方实行每周正常的工作时间40小时(用餐、休息时间除外),特殊岗位需实行不定时工作制或综合计时制的,双方将另行签订《补充协议》。

3.1 Party A will implement an ordinary work week of 40 hours (excluding meals and rest periods). For special positions that require an indefinite period of time or a certain accumulated amount of time, both sides will sign a separate "supplementary agreement."

3.2甲方因工作需要,如需延长工作时间的,应按国家有关规定执行。

3.2 Due to the needs of work, Party A shall comply with all relevant state regulations in carrying out an extension of the work period.

3.3甲方应按国家有关规定支付乙方加班费。

3.3 Party A shall pay Party B overtime according to the pertinent regulations of the state.

第四条劳动保护和劳动条件

Article 4 Labour Protection and Working Conditions

4.1甲方应按《中华人民共和国劳动法》规定,必须为乙方提供符合国家规定、安全卫生的工作环境,保证乙方在人身安全及人体不受危害的环境条件下工作;甲方根据乙方的岗位实际情况,按照国家及甲方的规定向乙方提供必要的劳动防护用品。

4.1 Party A shall, according to "The Labour Law of the People's Republic of China," conform to the state regulations in providing for Party B a safe and healthy working environment, and guarantees that Party B works under conditions where personal security and the human body are not endangered; according to the working conditions of Party B, and according to the regulations of the State and Party A, Party A shall provide to Party B any necessary protective articles.

4.2甲方负责对乙方进行职业道德、业务技术、劳动安全卫生及各种规章制度的教育和培训。包括但不限于《人事手册》在内的甲方各类的培训材料及培训内容均可作为对乙方工作表现的考核标准

4.2 Party A is responsible for carrying out education and training regarding professional ethics, business technology, labour safety and hygiene and other various regulations. Party B's work performance will be assessed according to Party A's various trainings and related materials including, but not limited to, the "Personnel Manual."

第五条劳动报酬

Article 5 Labour Remuneration

5.1乙方的税前工资为每月人民币______ 元,试用期税前工资每月人民币_______ 元。乙方的奖金、津贴由甲方按国家规定支付。

5.1 The monthly pretax salary of Party B will be RMB________, pretax monthly salary during the probationary period will be RMB________. Bonuses and subsidies for Party B shall be paid by Party A according to national regulations.

5.2甲方遇生产(工作)不景气时,支付乙方的收入不低于本市规定的最低工资标准。

5.2 If Party A's production (work) demand becomes depressed, the income which Party A pays to Party B must not be lower than the minimum wage stipulated by local city standards.

5.3甲方按本公司规定的工资形式和考核办法确定乙方的劳动所得,甲方按月支付乙方工资,乙方必须按国家规定缴纳个人所得税,月薪制工资发放时间为每月 ____ 日,并以银行卡转帐的方式向乙方支付。

5.3 Party A shall, according to the company's rules on wage distribution and according to a defined method of assessment, determine Party B's labor income. Party A pays Party B's salary monthly, Party B must according to national regulations pay individual income tax. The monthly salary will be paid to Party B on _______ of each month by way of bank card.

5.4甲方可根据乙方的工作业绩及表现和甲方的经营状况对乙方的工作岗位进行调整,人力资源部门事先会做书面通知,乙方对此表示同意。
