No. YES--9805 本合同由"厦门永华电子有限公司"(以下称"公司")与爱德华•莫里斯(Edward Morris ) 先生(以下称“受雇方”)签订。双方同意履行如下条款与条件:
This contact is agreed and signed by Xiamen Yonghua Limited Company" (here after is called company") and Mr. Edward Morris (here after is called employee). The two have agreed on items and conditions as follows:
1. 聘任职务: station for employment
公司向受雇方提供高级技师的职位。服务期限自1998年6月1日起,至1999年5月
31 日止。受雇方的职责范围详见附录。Company offers the station of Senior Technician to employee. The time limit is from 6.1/1998 to 5.31/1999. Duties required can be seen in appendix.
受雇方必须竭尽全力,恪守职责,忠实地完成公司所交与的一切任务。Employee should try his best to observe duties, loyally complete all the works by the Company.
2. 待遇: Treatment
2.1 工资:Payment
受雇方的月薪总额为3000元人民币,其中应由公司每月扣除受雇方应缴纳的所得税。
Employee will get 3000 yuan per mouth, out of the tax which employee should be discount.
2.2 特区津贴:SEZ Allowance
除了 2.1条款中所规定的,扣除了个人所得税后的实得工资外,受雇方每月可以获得
400 元人民币的厦门经济特区补贴。In addition to the mentioned 2.1, employee can get Xiamen SEZ allowance about 400 yuan per mouth.
特区津贴只在受雇方居住厦门期间发给。如果受雇方于1号至15号期间报到开始工作,
则可领到当月百分之百的特区津贴;如果受雇方于16号至30/31号期间开始工作,则只领
取当月百分之五十的特区津贴。The SEZ allowance only is paid out when employee live in Xiamen. If employee works between 1st and 15th, the Company will pay 100%; while the employee works between 16th and 30 or 31st, the Company only pays 50%.
受雇方度假的四个星期期间不得享受特区津贴。The employee can 't enjoy the allowance when you are in holiday about four weeks.
2.3 住房津贴:Housing allowance
如果公司没有为受雇方提供住房,则应发给受雇方每月500元的住房津贴。
If the Company don't offer house for employee, it should pay 500 yuan per mouth to rmployee.
2.4 交[甬木卜贝占:Traffic allowance
公司每月付给受雇方120元的交通补贴,用于上、下班及个人交通费用。受雇方的其它
个人旅行费用均由自己负责。The Company should pay 120 yuan to employee as gong to work ' traffic allowance, others don 't include.
与公事有关的交通费用根据公司“业务开支制度”在公司如数报销。
Business related expenses will be reimbursed according to Business Expense Regulations of the Company.
2.5 奖金:Bonus
受雇方有权享受公司根据雇员表现所发放的“季度业绩奖金”o The employee is entitled to the company" s bonus according his perform.
公司有权根据需要更改或修正奖金发放制度。And company has right to amend and alter bonus system.
2.6 安遣津贴:Repatriation allowance
受雇方在合同期满时,可以在领取最后一个月工资的同时,得到人民币2000元的安遣
津贴。When the employee is entitled, he can get last mouth ' salary and 200yuan'repatriation allowance extract.
如果受雇方提前终止合同,则无权享受安遣津贴。If the employee terminates the contract, he can't enjoy this.
3. 其它福利:Other allowance
3.1 往返机票:Rough-trip ticket
公司承担受雇方从家庭所在地途经香港或北京到本公司报到的往返经济舱机票。
The company will bear rough-trip economy class tickets between via Hong Kong or Beijing from the point of hire to work.
3.2 带薪休假:Paid holiday
受雇方有权在一年内享受四周的带薪假日,外加中国的法定传统节日,即"元旦”(1天),“春节3天),“五一劳动节”(1天)和“国庆节” (2天)。
Employee is entitled to four weeks' paid holiday, in addition to Chinese tradition festivals: New Year (one day), the Spring Festival (three days), May Day (one day) and National Day (two days).
受雇方何时度假应与公司协商,取得批准。The employee who wants to leave should associate with company in advance.
3.3 医疗与保险:Insurance and Medical Scheme
公司为受雇方投保“个人事故险”,保险赔偿费最大额为4万元人民币
The company should pay the Person Accident Insurance " for the ensured with a maximum benefit of 40,000 yuan.
公司负责为受雇方缴纳“医疗保险”的保金,但不负责受雇方的医院挂号费、医生出诊
费、护齿保健费及往返医院的交通费。
The company shall pay the premium for the Employee's medical insurance, but it has not duty to pay dental care, hospital registration, doctor 's home visits, and transport to and from the hospital. 4. 公司法规: Company rules
受雇方必须遵守公司的一切规章制度,服从公司领导所下达的一切合法指示。
The employee should observe all the rules, and obey leaders ' all legal orders.
4.1 保守机密: Maintenance of Confidentiality
受雇方在公司服务期间及离任后,不得使用、公开或泄露公司的技术机密或与本公司业
务有关的任何资料。After the employee leave this company, he don't allow to use, open or divulge technical secrets or any materials about this company.
4.2 兼职: Part-time job
在公司服务期间,受雇方不得在其它单位兼职或接受与公司工作无关的业务,不得直接
或间接地接受或获取其它地方的报酬或回扣。During working in the company, the employee must not be allowed to work for other companies, must not receive or indirectly reward or
