第一条总则

第二条人员

第三条签证和其他证件
1.乙方应按中国政府的有关规定办理人员出入中国国境的一切必要手续，并承担其费用法。商
2.甲方应按项目所在国政府的有关规定办理人员出入项目所在国及居留、工作许可证、机动车驾驶执照等必要手续，并承担费用法。商
甲方为人员办理上述手续，应向乙方具体明确提出由乙方提供的全部必要的证件，如因甲方的要求不明确而引起证件不足致使人员不能入境或无法获得居留和工作许可证，则乙方不负责任法。商
3.如果甲方未能为人员获得在项目所在国的居留、工作许可证和机动车驾驶执照等，而使人员无法进行工作，应付给人
员在此期间的合同工资法。商如人员因此被迫返国时，甲方应负担人员的回程旅费，并支付每人____个月合同工资的赔偿费法。商
乙方公司没有按甲方要求提供全部必要的证件，从而使甲方无法为人员办理在项目所在国的居留和工作许可证等使人员无法工作或被迫返回中国，人员工资、回程旅费等由乙方公司负担法。商
4.乙方公司应按本合同附件一和二将人员的姓名、出生地和日期、职称、护照号码、发照日期和单位、出发日期通知甲方或甲方在项目所在国的授权代表法。商甲方应在接到乙方公司的通知后即向项目所在国政府办理申请入境的必要手续，并
通知乙方公司法。商同时甲方应通过项目所在国有关机构通知该国驻华使馆，以便办理入境签证法。商
第四条乙方公司的义务
1.符合双方在附件一商定的技术条件；
2.遵守项目所在国的法律和法令，尊重当地风俗习惯；
3.尊重甲方人员的技术指导；
4.不参与项目所在国的任何政治活动；
5.遵守工地和驻地的纪律和规章制度；
6.与甲方为实施本工程而雇佣的其他国籍的人员合作共事法。商
第五条甲方的义务
1.对人员给予正确的技术指导；
2.尊重人员的人格、风俗和习惯；
3.不干涉人员在非工作时间的活动自由；
4.保障人员的安全；
5.对人员的解雇和更换，应由双方的工地的授权代表商定法。商
第六条工作时间
1.人员每周工作5天，每天工作白班8小时，夜班7小时，每天工作时间安排可由甲方与乙方公司授权代表在工地商定法。商
2.凡由于待料、停电、气候恶劣等非人员的责任而造成的停工，应计为工作时
间，合同工资照付法。商
3.驻地至工地的单程所用时间，不应超过20分钟，超过的时间应计入工作时间法。商
4.人员自中国到达工地后和本合同期满自工地回中国前，应分别享有____ 日有薪休息法。商
第七条合同工资
1.人员的月工资(包括伙食费)在本合同有效内按以下标准支付(美元)：

第八条夜班及加班
1.根据工程的需要，甲方要求人员在夜间工作或加班，应商得乙方授权代表同意，每月加班工作小时原则上不得超过

2.夜间时间系指从当日晚上9时至次日晨5时法。商人员夜间工作(指正常夜班工作)甲方应按合同工资150%支付工资；人员夜间加班，甲方应按合同工资200%支付

第九条工资和加班费支付
1.人员工资支付应自人员离开中国____之日起至回到中国____之日止法。商平均日工资为月合同工资的1/25法。商
2.乙方公司在工地的授权代表应按甲方提供的表格填写工作时间和加班时间，编制工资单，在每月工资结算日即____日后____天内即____日前提交甲方在工地的授权代表审核批准法。商
3.工资单审批后，甲方应在每月工资结算日即____日后一天内将工资和加班费以美元支付给乙方法。商其中：____ %电汇至____银行营业部乙方公司帐号；

第十一条节假日、每周休息日和年度休假
1.按项目所在国政府的规定，每周的休息日为星期____法。商
2.人员应享受项目所在国政府颁布的
法定节、假日和中国春节2天，国庆节1天的休假，共____天法。商
3.人员每工作期满1年，享受为期____天的回国年度休假法。商甲方承担休假人员从驻地至中国____间的往返旅费法。商人员工作不满一年，其实际休假天数按下列公式计算：
实际工作月数× (x/12)=休假天数
4.人员在项目所在国的节、假日和中国上述节假日以及年度休假期间，应享受全部合同工资法。商
5.因工作需要并应甲方要求，人员可不回国休假而留在工地继续工作法。商但需经双方代表协商同意法。商在此种情况下，人员年度休假工资及其从工地到____
间的往返旅费甲方支付，同时支付人员在年度休假期间的实际工作天数的合同工资和加班费法。商
第十二条预付工资
1.甲方在每批人员抵达岗位后，即应向乙方授权代表以当地货币支付每人相当于____美元的预付工资法。商

第十三条动员费
1.甲方应向人员每人支付____美元的动员费法。商

第十四条保险

2.人员在中国投保人身意外险后，如经甲方要求，乙方可向甲方提供必要的证明文件，以避免甲方为人员在项目所在国重复投保法。商
第十五条医疗和病假
1.甲方应为人员在整个合同期间因病或因工伤提供免费医疗、药品和住院治疗法。商所需中药乙方可代购，但药费、包
装费和运费由甲方承担法。商
2.人员如因病或因工伤休假不超过1个月，甲方应支付全部月工资法。商如休假超过1个月但不足3个月，甲方支付
____ %月合同工资法。商如休假超过3个月仍不痊愈送回中国继续治疗，甲方不再支付第4个月的工资，但应承担其回中国的旅费法。商如甲方要求乙方派人替换该伤病人员，则替换人员由____ 至工地的旅费亦由甲方承担法。商
3.人员在合同期间如因病或因工伤死亡，甲方负责其遗体处理并承担死者遗物运回中国的费用法。商
第十六条交通、通讯工具和差旅费
1.甲方应负担人员由中国____至工地
间的往返旅费及每人往返随身携带____公斤超重行李费法。商甲方应于人员合同期满后回中国前____天，将回程旅费及超重行李费支付给乙方授权代表法。商
2.甲方应免费向人员提供驻地至工地间(1.5公里以外)的上、下班交通工具法。商
3.甲方应免费向乙方授权代表、工程师、驻地经理提供一辆小轿车和供人员采购仪器及生活用品的一辆小型货车法。商如人员人数每超过____人，应增加一辆法。商上述车辆所需的司机、燃料，应由甲方免费提供，并负责检修法。商此外，人员在节假日可以免费使用甲方的交通工具，用于正当的目的诸如游览、购物等

4.乙方授权代表和人员可以免费使用甲方的通讯工具，如电话、电传、图文传真等法。商
5.人员如经甲方批准出差，其差旅费应由甲方负担，差旅费的支付标准和使用的货币按有关规定办理法。商
第十七条生活和膳食设施
1.甲方应为人员免费提供适宜的住房，每人使用面积的标准为：工人为____至____平方米；翻译、会计、技术员为____至____平方米；授权代表、工程师、医生、驻地经理为____ 至____ 平方米；雇主还应免费提供水、电、卧具、空调、沐浴、卫生、洗衣设备和用品及必要的家具

3.中餐专用的餐、炊具，可由乙方在中国代购法。商所需费用(包括运输和包装费)由甲方承担法。商甲方应在收到乙方代购上述物品的帐单后____天内以美元电汇至乙方公司帐户法。商
4.乙方自费购买人员的主副食法。商但乙方为此而派遣的必要数量的厨师和帮厨在平日加班的每周休息日、节假日加班应享有标准小时工资法。商
5.人员所需部分副食品，如需从中国
空运或海运至项目所在国，物品到达机场或港口后，有关报送、提货、运输等工作，雇主应给予协助法。商
第十八条劳保用品及小工具
1.甲方应为人员免费提供一般劳保用品和专用劳保用品以及办公用品，本合同附件7中所列的一般劳动用品可由乙方公司在中国包干代购，甲方应向乙方支付每人____美元法。商专用劳保用品如需乙方公司代购，由雇主据实支付货款，并承担这些物资的包装费及运费法。商
