合同

Xxxx大学(聘方)聘请籍

(外文姓名)(中文名)女士/先生为外籍教师。

双为本着友好合作精神,自愿签订本合同并保证认真履行合同中约定的各项义务。

一、合同期:

合同期自2018年7月16日起至20 19年7月15日止。

如果合同期长于一个学期,则第一学期为试用期。

二、受聘方的工作任务(见附件一):

受聘方的税前月薪为人民币元。若课时量多于16课时每周,则可根据实际课时量增加月工资。

四、聘方的义务:

(四)向受聘方提供必要的工作和生活条件(见附件二第五、六条)。

(五)按时支付受聘方的报酬(见附件二第一条)。

(六)对受聘方的种族、文化及风俗不带歧视。

五、受聘方的义务

受聘方对聘方的义务如下:

(一)遵守中国的法律、法规及有关规章制度,不干预中国的内部事务。

(二)主动了解并遵守聘方的工作制度和教工的管理规定,接

受聘方对其工作的指导、监督和评估。

(三)未经聘方同意,不得在外兼任与聘方无关的其他劳务。

(四)按期完成聘方交给的工作任务,保证工作质量。

(五)尊重中国的宗教政策,不能在校园内外以教学或其它方式从事与中国宗教政策相悖的宗教活动。

(六)尊重中国人民的道德风俗习惯。

六、合同的变更、解除和终止:

双方应信守合同,未经双方一致同意,任何一方不得擅自变更、解除和终止合同。

(一)合同的变更。经当事人双方协商同意后,可以变更。在未达成书面一致意见前,仍应当严格履行合同。

(二)合同的解除。经当事人双方协商同意后,可以解除合同。

在未达成书面一致意见前,仍应当严格履行合同。

1. 聘方在下述条件下,有权以书面形式通知受聘方解除合同:

1)受聘方未履行合同中所约定的义务,经聘方指出后仍不

改正的。

2)受聘方因不可抗力事件而不能履行合同中所约定的义

务。

3)当聘方两次正式收到学生对受聘方教学表现不满意的

投诉后,聘方经证实后无需征得受聘方同意,有权立即

解除合同。受聘方收到解除合同的通知后,将不享有本

合同及其两个附件中列出的福利待遇。

4)受聘方犯罪。

5)受聘方对聘方工作人员使用侮辱性的字眼、行为进行人

身攻击。

6)受聘方被发现有酗酒/吸毒行为。

7)由于受聘方患有某些疾病,按中国有关的法律、法规禁

止其留在中国的。

2. 受聘方在下述条件下,有权以书面形式通知聘方解除合同:

1)聘方未履行合同中所约定的义务。

2)聘方因不可抗力事件而不能履行合同中所约定的义务。

(三)合同的终止。

1. 合同期满该合同即告终止。

2. 经当事人双方协商同意后,也可以终止该合同。在未达成书

面一致意见前,仍应当严格履行合同。

七、违约金

当事人一方未履行合同中所约定的义务,即违反合同时,应履行下列条款:

(一)应当向另一方支付500--2000美元(或相当数额的人民币)的违约金,具体数额视尚未履行合同的时间长短而

定。

(二)受聘方因不可抗力事件要求解除合同,需出具有关机构证明,离华的费用自理。

(三)受聘方若无故解除合同,除离华费用自理外,还应当向聘方支付(一)中所述违约金。

(四)受聘方若达不到聘方的期望,聘方有权在受聘方试用期满后解除本合同,受聘方离华的费用自理。

(五)聘方因不可抗力事件要求解除合同,受聘方离华费用由聘方负担。

(六)聘方若无故解除合同,除负担受聘方离华费用外,还应当向受聘方支付(一)中所述违约金。

八、附件

本合同2个附件为合同不可分割的一部分,与合同具有同等效力。

九、合同到期/续签

(一)本合同在合同期满(见合同第一条)即自行失效。当事人一方要求续签合同,必须在本合同期满30天前向另

一方提出。当本合同期满自行失效或续签合同被一方拒

绝时,该方没有必要向另一方提供理由。

(二)一旦一方提出要求续约,另一方应在20天内给予同意或不同意的确切答复。届时若双方同意续约,双方需

签订续约合同,以便聘方正式上报上级主管部门,办理

续聘手续。

(三)受聘方合同期满后,在华逗留期的一切费用自理,且必

须在合同到期之后7天内搬出聘方所提供的公寓。

十、仲裁

当事人双方发生合同纠纷时,尽可能通过协商或者调解解决。若协商、调解无效,可向国家外国专家局设立的外国文教专家事务仲裁机构申请仲裁。

本合同于年月日在杭州(地点)签订,一式三份,每份都用中文和__英文__(文字)写成,两种文本同等作准。

本合同自甲方获得浙江省外国专家局批准同意甲方聘请乙方之日起生效。

附件一

有关在浙江理工大学工作的外籍教师的工作任务与责任

一、受聘方的任务

1.受聘方每周周一至周五课堂教学16标准学时(包括口语/听说类课程和写作及其他主干课程,每学时45分钟),工作地点在浙江理工大学各校区指定教室。此外,在聘方事先通知的情况下,受聘方有责任参加学校学生/教师的外语活动,例如外语角、外语演讲比赛,每学期不少于3次。受聘方每超额上1标准学时,其该月工资增加人民币120元。某些课程可能会因学生选课人数不足等原因而停开,受聘方须承担的教学工作量以学生第三轮选课结束后形成的课程表为准。

2.受聘方应遵守聘方的教学规范,如果出教学事故,视情节的严重程度,将扣发受聘方酬金人民币200-1200元不等。

3. 受聘方应接受聘方为其安排教学对象以及课程类型,教学对象名单以学生在选课周期结束后(最迟至新学期开学后第四周)形成的名单为准,受聘方不得因所持有的学生名单不同为由拒绝学生听课。受聘方不得以教学对象与前一学期重复为由拒绝聘方安排的教学任务。

4. 受聘方上课两周后需向聘方递交教学计划、教学资料、教学设备使用情况及教学方法。在合同期内,受聘方应接受聘方有关教学计划、教学资料、教学设备使用情况及教学方法方面的监督、监控(有时是不事先通知受聘方的听课)及指导。

5.若受聘方需要对既定课表或给定的教室作变动时,需事先获得聘方的同意。未获得聘方同意,受聘方不能按个人意愿私下换课。

6.若受聘方需进行非课堂教学,必须事先征得聘方同意。未经聘方同意,受聘方不得私下进行。

7.受聘方使用语音室的频率应受限制。受聘方不得太频繁地使用VCD、DVD等作为教学工具。若因VCD、DVD等使用频率造成争议,受聘方需接受聘方的监督。

8.受聘方不得以分班及其他形式减少学生的总课堂教学学时。

9.受聘方需在期末考试后3天内递交学生成绩单。必修课的学生成绩应以百分制记分,其中60分为及格。应根据学生的总体表现计算总评成绩,包括出勤、课堂表现、考试等。受聘方首先应把学生

分数输入电脑系统(若有需要,可以寻求中方合作教师的帮助),然后需在打印好的登分单上签名并注明日期。如要修改先前递交的登分单上的分数,受聘方需递交一份书面报告。受聘方应做好学生平时表现的记录工作,并在学期结束前将平时记录和评分标准复印一份交学院存档。

10. 未经聘方同意,受聘方不得接受浙江理工大学个别教职工派给的工作,不能应其个人要求提供服务。

11. 根据中国大使馆或领事馆的要求,受聘方来华前应体检。体检结果须在受聘方到华时经杭州市有关部门确认。若未进行该项体检,受聘方须在中国杭州进行体检。以上所有费用均自理。

12.根据公安局的规定,为安全起见,受聘方需告知聘方在其住处过夜的客人。未经聘方允许,受聘方不得将聘方提供的住处提供给他人居住。

13.受聘方在合同期内离开本市,需事先告知聘方其前往目的地、停留时间、出发/回程日期以及旅途中的联系方式。其旅途安全由受聘方本人负责。

14.受聘方应经常检查其签证、居留许可和外国专家证,保证其在中国的居住和工作合法、时间有效。如有违反,受聘方应承担公安局印发的守则中所规定的惩罚。

二、聘方的任务

1.聘方应协助受聘方办理中国签证、居留许可及专家证。当需办理上述证件延期时,受聘方应至少在证件过期30日前将证件交给聘方。所有办证费用应由受聘方自理。

2.受聘方若在服务期内能享受的假期之外的时间为出城(杭州市)或出境而向聘方提出请假,聘方有权拒绝。

3.在受聘方递交教学计划、方法等后,若有问题,聘方将提供监督与指导。

4.聘方对受聘方教学质量的监督可以有以下形式:学生调查/问卷、学生座谈会、督导组成员听课等。若聘方接到受聘方学生对受聘方教学质量的投诉后,聘方可以采取其他形式的督导方法。聘方有权决定采用何种方法对受聘方的教学质量进行监督,所有方法均可不事先通知受聘方。

5.聘方应帮助受聘方处理有关课表变动的事宜。但是,若受聘

方的要求不恰当,或可能对学校/学生造成危害时,聘方有权拒绝受聘方的要求。

6.聘方应事先通知受聘方有关本学期的课表变动、放假、考试日程安排。而且,聘方在不同学期,有必要时甚至在同一学期里有权决定是否更改受聘方的课表与学生。

7.聘方应帮助受聘方确认受聘方本国的体检结果。若无现成体检结果,聘方应帮助受聘方在杭州完成体检。

8.若受聘方有本市外客人来访,不管其居住在受聘方住所多久,聘方将帮助受聘方报告当地派出所。

9.聘方应为受聘方支付购买综合医疗保险(含意外身故保障、伤残保障、重大疾病保险)的费用,但若受聘方无故解除、中止合同或违约,受聘方须向聘方支付该费用。因受聘方年龄原因聘方不能为其购买保险者,若发生意外责任由受聘方自行负责。聘方可协助受聘方随行家属购买保险,但费用由其自理。

10.若受聘方在合同期内离开本市,聘方有责任获知受聘方前往的目的地,停留时间,出发/回程及旅途中的联系方式等信息。

11.聘方有责任应受聘方要求为其提供住所内各种维修服务(由于受聘方本人原因引起的各种损坏的维修费用由受聘方本人自理)。同时,当受聘方不在住所内时,聘方有权在未经受聘方同意的情况下,进屋维修。

12.聘方免费提供受聘方来校任教和离职时的免费交通服务。其余时间用车,费用由受聘方自理,聘方可帮助安排车辆。

附件二

浙江理工大学外籍教师待遇

一、工资

聘方根据受聘方承担的工作任务,以及学历、资历确定月工资。

受聘方的税前起始月薪为:

(一)受聘方具有学士学位,起始月薪为5200-5800元人民币。

(二)受聘方具有硕士学位,起始月薪为5900-6500元人民币。

(三)受聘方具有博士学位,起始月薪为6600-7200元人民币。

注:

1.根据中国有关法律,当外教月工资超过4800元人民币时,将征个人所得税。

2.经双方同意,受聘方的月工资可以低于理论上其能归入的工资档所规定的工资。

3.合同终止后,在受聘方离开聘方前,受聘方须将其外国文教专家证、公寓钥匙、学校图书证、食堂就餐卡等交还给聘方。

否则,聘方不支付其最后一个月工资或国际旅费。

4.受聘方圆满完成1年(含1学年)合同并续聘的,从第二年起,月薪增加200元人民币;从第四年开始,月薪再增加200

元人民币。

二、薪水计算

受聘方的薪水应按以下方法按时支付。

(一)薪金自到职之日起到合同期满之日止。

(二)聘方按月支付薪金。合同期内,受聘方在聘方任职第一个工作月或最后一个工作月实际工作天数不足整月

的,工资按日计发。日薪为薪金的三十分之一。

(三)受聘方的工资一般于次月8日后发放。对于首次聘用的受聘者,第一个月除外,该月工资在其开始授课后可

发放,以便保证其正常生活。

(四)若受聘方续签合同,不管是否整月工作,整个合同期内,聘方按月发放薪水。

三、休假:节日与补贴

所有外籍教师,有权:

(一)享有在合同期内的浙江理工大学规定的中国教师的

节假日,如暑假或者寒假。

(二)在事先通知聘方的情况下,每年享受带薪假期1天,以庆祝其本人的宗教节日或者其本国的国庆节。

(三) 合同期内,外国文教专家可享受休假补贴费,补贴

标准为:合同期为1学年的,均为2200人民币,合同期为

半年(1学期)的,均为1100人民币。补贴将在每个学期

的最后一个月发放。

(四)受聘方若续约,其有权享受上述(一)、(二)、(三)中的待遇。此外,受聘方在合同期内的节假日薪水照发。

四、国际旅费

聘方向受聘方提供以下国际旅费:

(一)受聘方聘期为一年,合同期满时可报销一张一年有效的从离中国杭州最近的机场与其本国居住地间的经济

舱往返国际机票,或可选择领取往返程国际旅费补贴☆。

(二)受聘方聘期为一学期,合同期满时可报销一张一年有效的中国杭州/上海与其原出发点经济舱单程国际机

票,或可选择领取单程国际旅费补贴☆。

☆注:

☆1、中国至欧洲、美洲、大洋洲国家和地区国际机票往返程的报销额度不超过8000元人民币,单程不超过4000元人民币。

受聘方在一年或一学期合同结束时可报销机票。报销时,需提供仅限受聘方本人使用的机票的购买发票及机票本身。受聘方若选择领取国际旅费补贴,聘方则按照往返6000元或者单程3000元的标准(税前)发放补贴。

☆2、中国至亚洲国家和地区的往返程报销额度不超过4000元人民币,单程不超过2000元人民币。受聘方在一年或一学期合同结束时可报销机票。报销时,需提供仅限受聘方本人使用的机票的购买发票及机票本身。受聘方若选择领取国际旅费补贴,聘方则按照往返3000元或者单程1500元的标准(税前)发放补贴。

☆3、若发票上机票价格低于上述报销额度,则按该实际额度报销。

五、生活条件

聘方提供受聘方以下生活条件。受聘方需接受聘方因合理原因提出的其需搬迁而更改其住址的要求:

(一)住房位于以下地址:

浙江省杭州市下沙高教园区,室。

(二)住房内设有:必要的家具,一套被褥(床单、被子和枕头),一个冷暖空调/室,一台电视机,一部电话机,

一台冰箱,一个电磁炉,一台热水淋浴器,一个微波炉,

一台饮水机(受聘方应自供饮用水),一台洗衣机、一台

电脑(包括宽带网络服务)。所有由聘方提供的电器、家

具等用品所有权归聘方,受聘方不得任意将其搬走。

(三)所有电器或家具在使用过程中若出现故障或破损,原则上由受聘方自行找人维修并负责支付相关费用。

(四)聘方每月为受聘方支付300度以内的电费以及自来水费、市话费和Internet上网费用。超出以上额度的电费

由受聘方自理。

(五)受聘方若因上下班交通需要自行车,可自行购买一辆。凭发票最高可报销400元人民币。发票上价格少于

400元的则按实际价格报销。

(六)受聘方自行添置的用于住宿地和工作的其他物品由受聘方自行支付费用。

六、工作条件

聘方向受聘方提供以下工作条件:

(一)聘方提供常规教室以供受聘方教学。若有特殊要求,可作相应安排。

(二)经受聘方事先要求,且使用频率合理时,聘方可提供技术设备。

(三)提供限量的打印、复印。

七、保险

受聘方在来校工作前需购买健康和意外保险。作为补充,聘方为受聘方在当地中国的保险公司购买综合保险(含意外身故保障、伤残保障、意外伤害医疗保险),但因受聘方年龄等原因聘方不能为其购买保险者,若发生意外,责任由受聘方自行负责。

八、病假

若受聘方要求请病假,需遵守以下条款:

(一)受聘方应在请假前或请假后的3天内出具请假条,未能出具有效医院假条者视为事假未批准后的旷工论处。

(二)受聘方病假期间的课酬扣发。受聘方在恢复健康后需补课。经核实后补发先前扣发的课酬。(标准工作量内

每节课课酬扣发/补发标准为标准月工资÷月课时总数;

超工作量部分每节课课酬扣发/补发标准按原给予的超课

时课酬标准计算)

(三)因病连续请假超过半个月或者在半个月内断续请假4次以上(含4次),聘方可以要求与受聘方终止合同。

九、事假

若受聘方要求请事假,需遵守以下条款:

(一)受聘方需事先填写请假单,并获得聘方的书面同意。

经同意后,受聘方仍需补上因请假未完成的课时。

(二)请假时,受聘方需向聘方提供补课时间表,以便聘方日后核实。经同意的请假,请假期间课酬的扣发标准以

及之后的补课课酬标准按每节课120元人民币计算。

(三)受聘方未经聘方书面同意而擅离职守,旷工一天,扣发三天薪水。若情节严重,聘方有权解除合同,并要求

受聘方负违约责任。

(四)受聘方一学年内事假累计不得超过10天。

(五)受聘方不能连续请事假超过3天。

十、其他

聘方的准假部门(包括病假、事假)为国际交流与合作处。

Contract

Party A Zhejiang Sci-Tech University wishes to engage the service of Party B

as foreign teacher .The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.

I.Term of Agreement

The period of service will be from 16 July, 2018 to 15 July, 2019.

II.Duties and Responsibilities (refer to Appendix I)

III.Salary

Party B’s monthly salary(before tax) will be ¥(RMB).

IV.Party A’s Obligations

Party A’s obligations to Party B are as follows:

a)Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese

government, and shall explain Party A’s work system and regulations concerning the administration of its staff

upon Party B’s request.

b)Party A shall provide direction, supervision and evaluation of Party B’s work.

c)Party A shall provide Party B with the necessary working and living conditions (refer to Appendix II.V and

II.VI).

d)Party A shall pay Party B’s salary regularly (refer to Appendix II.I).

e)Party A shall ensure non-discriminatory relations with Party B through sensitivity towards Party B’s race,

culture and customs.

V.Party B’s Obligations

Party B’s obligations to Party A are as follows:

a)Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall

not interfere in China’s internal affairs.

b)Party B shall understand and observe Party A’s work system and regulations concerning administration of its

staff on Party B’s own initiative and shall accept Party A’s direction, supervision and evaluation in regard to

his/her work.

c)Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to

the university.

d)Party B shall complete all work assigned by Party A on schedule and guarantee the quality of work.

e)Party B shall respect China’s religious policy, and sh all not conduct religious activities on and off campus,

through teaching or in any manner that contradicts China’s religious policy.

f)Party B shall respect China’s moral standards and customs.

VI.Revision, Cancellation and Termination of the Contract

Both Parties shall abide by the contract and shall refrain from revising, canceling, or terminating the contract without mutual

consent.

a)Revision of the contract. This contract can be revised with mutual consent in writing. Before both parties have

reached an agreement, the contract shall be strictly observed.

b)Cancellation of the contract. This contract can be canceled with mutual consent in writing. Before both parties

have reached an agreement, the contract shall be strictly observed.

1. Party B has the right to cancel the contract by written notice to

Party A under the following conditions:

1)Party B does not fulfill the contract obligations according to the terms stipulated.

2)Party B cannot fulfill his/her contract obligations due to events beyond his/her control.

3)Upon receiving student complaints officially about Party B’s teaching twice, Party A having

established that the complaints are based on unsatisfactory performance has the right to

terminate the contract immediately after confirmation, without Party B’s consent. After

receiving Party A’s notice of termination of the contact, Party B is not entitled any longer to all

benefits stated in this contract and its two appendices.

4)Party B commits crimes.

5)Party B makes a personal attack on Party A’s staff with insulting remarks and aggressive

behavior.

6)Party B is found out to be alcohol/drug addicted.

7)Party B suffers from any disease that makes Party B prohibited from staying in China by

relevant Chinese laws or regulations.

2. Party B has the right to cancel the contract by written notice to

Party A under the following conditions:

1)Party A does not fulfill the contract obligations according to the terms stipulated.

2)Party A cannot fulfill the contract obligations due to events beyond the university’s control.

c)Termination of the contract

1. This contract shall be terminated once it expires.

2. This contract may be terminated with mutual consent of both

parties, and it shall be strictly observed until both parties reach

an agreement otherwise.

VII.Breach Penalty

If either of the two Parties fails to fulfill the contract obligations according to the terms stipulated, that is to say breaks the

contract, the following hold true:

a)He/She/They must pay a breach penalty of US$500 to $2,000 (or the equivalent in RMB), the amount of which

is calculated on the remaining amount of time left on the contract.

b)If party B requests the cancellation of the contract due to events beyond his/her control, he/she may be

requested to produce certification by the department concerned and will be expected to pay his/her own return

expenses to his/her home country.

c)If Party B cancels the contract without valid reason, he/she will be required to pay his/her own return expenses

and pay a breach penalty to Party A as stipulated in point (a).

d)If Party B doesn’t live up to Party A’s expectations, Party A shall be entitled to cancel the contract at the end of

Party B’s trial period without paying Party B’s return expenses.

e)If Party A requests the cancellation of the contract due to events beyond the university’s control, Party A will

pay Party B's return expenses to his/her country of origin.

f)If Party A cancels the contract without valid reason, he/she should pay Party B's return expenses and pay a

breach penalty to Party B, as stipulated in point (a).

VIII.Appendix

Two appendices to this contract are an inseparable part of the contract and have equal effect.

IX.Contract Expiration and/or Renewal

In the case of the expiration or renewal of a contract the following shall occur:

a)According to the Term of Agreement (See Clause I), the contract will automatically expire. If either Party puts

forth a request for contract renewal, he/she/they must forward the request to the other Party 30 days prior to the

expiration of the existing contract. Neither party shall necessarily provide the other with the reason while the

contract automatically expires and the request of renewal is rejected.

b)Once the request has been forwarded to the Party concerned, a response of acceptance or rejection must be

given within 20 days. Once both parties agree to renew the contact, a renewal contract shall be signed for part

A’s reporting to the authorities concerned and deal with the process of renewing the documents concerned .

c)Party B shall bear all expenses incurred when staying on after his/her contract expires, and shall vacate the

premises provided by Party A within 7 days after the contract expires.

X.Arbitration

The two parties shall consult with each other any points of conflict in the contract. Should attempts to reach a fair compromise

fail, the two parties may appeal to the Organization of Arbitration for Foreign Experts Affairs in the State Bureau of Foreign

Experts to request a final arbitration.

This Contract is signed at _____________Hangzhou________, in triplicate, this ______ day of _________ __ , in the Chinese and __English_________ languages, both texts being equally authentic.

This Contract is not valid until ZSTU gets the approval of employing Party B from Zhejiang Administration of Foreign Experts Affairs.

Appendix I

Duties and Responsibilities Regarding Foreign Teachers

Employed Under ZSTU

I.Duties and Responsibilities of Party B

1.Party B will be required to conduct classroom teaching for 16 periods (45 minutes per period)per week from Monday to Friday on

the designated sites of any ZSTU campus, within which the teaching of both substantial (i.e. Writing and other major courses for foreign language majors and/or non-foreign-language majors) and non-substantial courses (i.e. oral communication based courses) might be assigned. In addition, with Party A’s due notice, Party B shall have the responsibility for participating in student/teacher foreign language activities on campus, such as English (or other foreign languages) Corner, English (or other foreign languages) speech contest, at least three times each term.. If Party B is asked to teach more than 16 periods a week, an increase of ¥120 (RMB) per period will be added to Party B's salary for any approved periods worked overtime. Some courses might be closed for reasons including the number of registered students failing to meet the minimum requirement. Therefore, the exact class load assigned to Party B is subject to Party A’s final confirmation made after the third round of course registration is completed.

2.Party B should follow Party A’s teaching regulations. Should there be any dischargeable offense of teaching regulations, Part y B must

pay a penalty of RMB 200-1200 according to the seriousness of offense.

3.Party B shall teach the students and courses assigned by Party A. The list of the students is subject to updates made during the course

registration period which may last into the fourth week of the new semester at the latest. Party B shall not refuse to teach the students assigned by Party A on the grounds that students that have been taught in the previous semester remain in his/her class in the new semester, or that some students’ names are not on the list given before the course registration period is over.

4.Party B shall provide Party A with teaching plans, including content, methods to be used and resources required no later than two

weeks after the commencement of the semester and accept Party A’s supervision, monitoring (sometimes sitting in Party B’s classroom with no notice in advance) and guide regarding the plans, resources, access and/or methods he/she employs within the duration of the contract.

5.Should Party B desire to make any alterations to his/her set class schedule or given classroom, he/she must request Party A’s approval

for such changes in advance. Without Party A’s consent, Party B must not make any change to the set schedule at his/her own will

6.Should Party B plan to conduct any non-classroom teac hing, he/she must obtain Party A’s consent in advance. Party B must not do it

without P arty A’s approval.

7.Access to audio/visual rooms is limited. Party B shall not use VCD, DVD, etc. too frequently as a teaching tool, and shall accept Party

A’s ruling if an issue over the frequency of using the above tools arises.

8.Party B shall not reduce any student’s expected total classroom teaching hours by dividing the regular class or other means.

9.Party B shall be required to submit students’ scores within 3 days after the completion of final examinations. Scores should be given

based on students’ overall performance including attendance, participation in classroom activities, exams, etc.. Percent-system, under which 60% is equal to a “pass”, should be used. Party B shall first input students’scores to the computer-based system (with the assistance of a Chinese co-operative teacher if necessary) and then sign and date the printed transcript. Party B shall submit a written report if any changes have to be made to the previously submitted scores. Party B should keep records of students’ performance and submit a hard copy of such records with an explanation of the evaluation standards to Party A at the end of semester.

10.Party B shall not accept any jobs or provide any services that are requested by individual staff at ZSTU without Party A’s consent.

11.Party B shall have the medical examination as required by Chinese Embassy or Consulate before coming to China. Its result shall be

confirmed by the department concerned upon his/her arrival in the city of Hangzhou. Party B without this result shall be required to have the medical examination completed in Hangzhou, China. In all cases, Party B shall cover the fees.

12.Party B will be required to inform Party A of overnight guests for security reasons as per the rules and regulations set by the Public

Security Bureau. Party B shall not offer other people the premises of the accommodations provided by Party A without Party A’s consent.

13.Party B will be required to inform Party A in advance of his/her trip out of the city (Hangzhou) during the duration of the contract. The

following information is required: destination(s), the length of the stay, departure/return dates and the contact information during the trip. Party B shall be responsible for his/her safety in traveling.

14.Party B shall check his/her visa, residence permit, and foreign expert certificate regularly to make sure his/her stay and work in China

is legal and his/her certificates are valid. Party B shall be responsible for any penalties if any rules stated in the PSB rulebook are violated.

II.Duties and Responsibilities of Party A

1.Party A will help Party B with the processing of Chinese visa, residence permit, and foreign expert certificate. As for the extension of

the above documents, Party B shall submit them to party A at least 30 days before they are expired. In all cases, Party B shall pay the fees.

2.Party A has the right of refusal to Party B’s request of a leave of absence from Party A for a trip out of the city (Hangzhou) or out of

China should it not occur in the holiday time that Party B is entitled to during his/her service at Party A.

3.Party A shall provide supervision and guide for Party B after he/she submits his/her teaching plans and/or teaching methods if Party A

thinks necessary.

4.Party A shall control Party B’s teaching quality in the following ways: survey and/or questionnaire among students, talk with students,

sitting in classroom by members of Party A’s teaching quality supervision team, etc. Should Party A receive any negative feedback from Party B’s students, Party A might employ any other quality control methods. Party A has the right to decide which method to use to control Party B’s teaching quality and all methods can be employed by Party A without notice given to Party B in advance.

5.Party A will assist Party B with any alterations he/she requests regarding the set class schedule. However, Party A has the right of

refusal to Party B’s request should such a request place either the university or the students in an inappropriate/dangerous situation.

6.Party A will be responsible to disseminate information to Party B regarding any changes in class schedules, all holidays, examinations

dates in advance. However, Party A has the right to decide whether or not to change Party B’s class schedules and students in a different semester or even in the same semester when Party A thinks necessary.

7.Party A will assist Party B with the confirmation of the result of the medical examination in his/her own country, and will assist Party B

to have the medical examination completed in the city of Hangzhou if there is not any handy result.

8.Should Party B desire to have out-of-Hangzhou guests reside at their residence for any period of time and should Party A approve of

this request, Party A will assist Party B by placing a report with the local police station.

9.Party A will cover the expenses of the purchase of Comprehensive Medical Insurance Plan f or Party B. If Party B breaks the contract

without valid reasons, he/she shall repay Party A for such expenses. If Party A is unable to purchase such Comprehensive Medical Insurance Plan for Party B for the reason that he/she is not included in the insurance company’s insurance coverage due to age, Party B is responsible for any result by himself/herself.

10.Party A shall have the responsibility to get necessary information, including destination(s), the length of the stay, departure/return dates

and the contact information during the trip about Party B’s trip out of the city (Hangzhou) during the duration of his/her contract.

11.Party A shall be responsible for the repairing work in Party B’s apartment upon request. However, Party B shall be responsible for the

cost of repairing that results from any damage deliberately made by Party B or by people related to Party B. Party A shall have the right to enter the premises Party A provides, without Party B’s consent for such purposes, should Party B not be in.

12.New teachers shall be met at the airport and brought to the university, and taken to the airport when they finally depart. Expenses for

such transportation service are covered by Party A. Should Party B require transportation service at other times, Party A shall assist him/her with the arrangement of the vehicle; however, the expense shall be covered by Party B himself/herself.

Appendix II

Conditions For Foreign Teachers Working For ZSTU

I.Salary

Party A shall fix party B’s salary according to his/her professional and educational background and according to the work

assigned.

The commencing salary of Party B is as follows before individual income tax*:

a)With a Bachelor’s degree, ¥5200(RMB) —5800(RMB)/ month.

b)W ith a Master’s degree, ¥5,900 (RMB) —6500(RMB)/ month.

c)With a PhD degree, ¥6600 —7200(RMB)/ month

*NOTES:

1. According to the relevant Chinese law, individual income tax will be imposed

when Party B’s monthly income exceeds ¥4800(RMB).

2. With mutual agreement, Party B’s monthly salary might be lower than that for

which he/she is eligible.

3. At the termination of the contract, Party B must return the Foreign Expert

Certificate, the key to the apartment, the library card and the cafe card to Party

A, otherwise his/her l ast month’s salary or international travel expenses will

not be paid.

4. If upon successfully completing a one year (academic year) contract Party B renews the contract with Party A, a 200RMB

increment will be added to the basic monthly salary from the second year, and another 200 RMB increment will be added to

the basic monthly salary from the fourth year.

II.Calculation of Payment and the Housing subsidy

Party B’s salary shall be paid regularly as follows:

a)The calculation of Party B’s salary and housing subsidy begin from the day Party B commences his/her work at

Party A and the ends at the expiration of the contract as stipulated under the terms of agreement.

b)Acknowledging that Party B’s salary and housing subsidy is paid on a monthly basis, if the actual teaching days

are less than a month in the first and/or last working month in his/her service period on the contract at ZSTU, the

payment shall be made by the day.

c)Party B’s salary of each month shall be paid no earlier than the 8th day of the next month. An exception will be

made to those who hold a contact with Party A for the first time. For such individuals, his/her first month salary

shall be paid at the beginning of his/her teaching in order to ensure his/her normal living expenses.

d)Upon the renewal of a contract, Party B will receive his/her monthly salary for the entirety of the contract

regardless of partial months worked.

III.Vacation: Holidays & Allowance

All foreign teachers are entitled to:

a)Within the term of the contract, all holidays that ZSTU Chinese teachers share, including the winter vacation or

summer vacation.

b)Party B is entitled to one day off with pay every year for the celebration of his/her religious festival or the

National Day of his/her own country with notice forwarded to Party A in advance.

c) During the period of the contract, Party B can enjoy the vacation subsidy. The subsidy standard is that the contract

period is 1 years, the subsidy is RMB2200, the contract period is half a year (one term), the subsidy is RMB1100.

The subsidy will be paid in the last month of each semester.

Upon the renewal of a contract, Party B is entitled to both points(a,b and c)stated above. In addition, he/she will receive full

salary during all months regardless of holiday time within the term of the contract.

IV.International Travel Expenses

Party A will provide Party B with International Travel Expenses as follows:

a)Upon successfully completing a one (academic) year contract, Party B will be reimbursed or subsidized for an

economy class round-trip airline ticket*, between his/her place of residence (or the nearest city) in his/her home

country and Hangzhou/Shanghai, P.R.China.

b)Upon successfully completing a one semester contract, Party B will be reimbursed or subsidized for an

economy class one-way airline ticket*, between his/her place of residence (or the nearest city) in his/her home

country and Hangzhou/Shanghai, P.R. China.

*NOTES:

1.Reimbursements for international travel expenses between cities in Europe/Americas/Oceania

and Hangzhou/Shanghai, P.R. China shall be no more than ¥8,000 for a round-trip airline ticket

and no more than ¥4,000 for a one-way airline ticket. Reimbursements are made at the end of

the one (academic) year/semester service, upon handing in both the purchase invoice and the

ticket itself that are issued in the name of Party B and to be used exclusively by Party B. Should

Party B be unable to present the above invoice and ticket itself, the subsidy for a round-trip

ticket and a one-way ticket is ¥6,000 and ¥3,000 respectively before tax.

2.Reimbursements for international travel expenses between cities in Asia and

Hangzhou/Shanghai, P.R. China shall be no more than ¥4,000 for a round-trip airline ticket and

no more than ¥2,000 for a one-way airline ticket. Reimbursements are made at the end of the

one (academic) year/semester service, upon handing in both the purchase invoice and the ticket

itself that are issued in the name of Party B and to be used exclusively by Party B. Should Party

B be unable to present the purchase invoice and ticket itself, the subsidy for a round-trip ticket

and a one-way ticket is ¥3,000 and ¥1,500 respectively before tax.

3.If the cost on the invoice is less than the above limit, only the exact cost will be reimbursed. V.Living Conditions

Party B will b e provided with the following living conditions, and shall accept Party A’s possible change made onto Party B’s accommodation location due to some reasonable reasons:

b)Accommodations will be furnished with: necessary furniture, one set of bedding including sheets, comforter

micro-wave oven, a purified water unit (Party B is responsible for his/her own supply of water for the unit), a

washing-machine, etc. Part A will retain ownership of these things. All the furniture and household appliances

must not be moved from the apartment.

c)If there arise any problems with the machines, Party B shall have them fixed and meet the cost for such repairs.

d)Charges for electricity consumption up to 300 kilowatt-hours per month, running water, local calls and Internet

usage fees will be covered by Party A. The bill for electricity consumption beyond the above limit shall be paid

by Party B.

e)If Party B has the need to buy a bike for transportation back and forth between his apartment and the university,

he/she can buy one and can be reimbursed upon showing the receipt up to RMB 400 yuan. If the cost on the

receipt is less than 400 yuan, only the exact cost can be reimbursed.

f)Expenses for any other additional items used in the apartment and at work shall be covered by Party B.

VI.Working Conditions

Party B will be provided with the following working conditions:

a)Standard classroom for each course taught unless special requirements are needed at which time the necessary

arrangements will be made.

b)Access to technical facilities made available upon request in advance at a reasonable frequency.

c)Access to printing and photocopying with limits.

VII.Insurance

Before his/her service at ZSTU, Party B is expected to buy health and accident insurance in his/her own country that will cover his/her relevant cost should he/she have a misfortune in China. As a complement to his own insurance, Party A will cover

the expenses of Comprehensive Medical Insurance Plan. If Party A is unable to purchase such Comprehensive Medical Insurance

Plan for Party B for the reason that he/she is not included in the insurance company’s insurance coverage due to age, Party B is

responsible for any result by himself/herself.

VIII.Sick Leave

If Party B requests sick leave the following shall occur:

a)Party B will be required to produce a hospital’s official suggestion of sick leave before or within 3 days after

his/her illness. If he/she is unable to present the above document, his/her absence will be considered as

absence without reason.

b)Money will be deducted from the monthly salary for classes missed - then returned when the classes missed

have been made up. This will include payment for all work done including approved work over and above the

sixteen hours. Party A will deduct or reissue the money on the following basis:1) Money for any period within

the regular workload:=regular monthly salary ÷total periods per month; 2) Money for any period exceeding

the regular workload shall be the amount he/she should receive if he/she didn’t ask for a leave.

c)If Party B asks a sick leave for 15 continuous days or asks for occasional sick leave more than 4 times in two

weeks, Party A may request Party B’s termination of contract.

IX. Absence

If Party B desires leave of absence the following shall occur:

a) Party B shall fill up a form for leave of absence in advance and must obtain Party A’s written consent before his/her

absence. Party B shall make up all missing classes even wi th Party A’s approval of leave.

b)While Party B is making the request of the leave, he/she will be required to inform Party A of the rescheduled class(es) for

Party A’s confirmation in future.Payment of 120 yuan per period will be deducted for any not made up.

c) If leave is taken without prior approval, three days’ salary will be deducted for each day missed and if the situation is

considered irresponsible, party A may cancel the contract and ask Party B to account for liabilities for breach of contract.

d) Party B is entitled to an accumulative total of 10 days’ leave of absence over one academic year period.

e) Party B may not request leave of absence that exceeds 3 continuous days.

IX.Others

The office that has the right to decide whether to giv e or refuse Party B’s sick leave or absence leave request in Party A is International Exchange & Cooperation Office.

EMPLOYMENT CONTRACT Employer School: Official Represe ntative: Koreig n Teacher: I.Employee* duties and Responsibilities 1.The foreign teacher willingly comes to the Employer School to be a part-time English teacher. When traveli ng outside of Guan gdo ng provin co, Hong Kong, or Macao, the foreign teacher is further responsible for announcing his/her travel pla ns to the Employer School through his/her con tact teacher and the Coord in ator, a week in adva nee in writ ing or via e-mail. 5.I n the eve nt of ill ness that preve nts the foreig n teacher from teachi ng, hc/she is resp on sible to no tify both his/her con tact teacher and the Coord in ator in adva nee, and further is required to provide the Employer School with written documentation. If this notification is not done, there will be a reduction of pay by RMB 100 per time of abse nee; this pen alty also applies to any un approved tard in ess from class. (For instance, if the foreign teacher is late for over one hour, he or she will lose RMB300: wage RMB 200 added a fine of RMB 100). After receiving the written warning letter from the employer, a total of three such occurre nces arc grounds for dismissal. 6.During the lessons, the foreign teacher will make his or her own meal and tran sportati on arran gome nts. 7.The foreig n teacher is to respect the moral sta ndards and customs of the Chin ese people. This specifically in eludes mai nta ining an appropriate professi onal appeara nee and standard of behavior.
