我国也逐渐引入建设工程担保制度，2004年8月6日，建设部以建市（2004）137号文件下发了《关于在房地产开发项目中推行工程建设合同担保的若干规定（试行）》，要求各省市、自治区的建设行政主管部门在工程建设合同造价高于1000万元的新建、改建和扩建的房地产开发项目中，强制推行投标担保，履约担保，业主工程款支付担保等。
在我国，逐渐推行建设工程担保制度，对于解决建设工程领域的一些现有问题、完善各地建设工程管理制度、整合建设行业的资源配置、优化建设行业的金融政策、提高建设工程企业的行业竞争力都大有裨益。
本文在认真研究国外的研究成果，充分阅读国外相关文献、书籍的基础上，运用了归纳演绎、比较分析、案例分析等方法，并结合直观的图表，对建设工程担保制度进行了详细研究，了解建设工程担保基本概念、行业背景，分析实行建设工程担保制度的意义，结合我国建设工程担保行业现状，以及实行建设工程担保制度的现实条件，研究国外建设工程担保制度起源、模式、实行现状、担保种类、担保主体等方面容，比较国外建设工程担保制度的容，指出我国建设工程担保制度存在的问题，结合相关案例，提出相关建议。
本文主要得出的结论有：通过梳理我国建设工程担保制度所包含的容，结合其实施现状，提出扩大建设工程担保需求，同时提高建设工程担保行业准入门槛的建议；针对业主工程款支付担保效力受限问题，提出对业主单位以往的履约状况做详细记录，并评估履约水平，将履约状况和评估报告报送主管部门备案；通过对我国建设工程担保制度相关法律研究，对政府监管政策的学习，提出应完善建设工程担保制度相关法律以及配套措施，加强市场监管，推动建设工程担保制度的建设；通过对建设工程担保公司调查研究，对其收取保费标准进行分析研究，指出建设工程担保公司存在的问题，指出应提高建设工程担保公司专业化程度，提升从业人员专业素质；本文也提出从提高行业准入门槛，推广差额担保，完善建设工程担保取费体系等其他方面完善建设工程担保制度。
最后，应用本文研究容，对市园林绿化PPP项目进行分析，指出应用投标担保的必要性,提出相关建议；对梁园镇慎城大道、沿河防汛道路建设工程项目进行分析，提出加强区域间的银行合作以促进建设工程担保公司发展，加强与建设工程担保有关政府部门沟通的建议。
切实实行建设工程担保制度，并在应用中不断改进，可以有效提高项目管理水平，降低履约风险，保证合同各方利益，推广和完善建设工程担保制度可以促进我国建设工程行业的健康发展。

AbstractGuarantee for construction project is one of the engineering project management methods, guarantee to construction projects in the western developed countries is a mature method of risk management. Our country also gradually introducing the guarantee system of construction project,On August 6, 2004, the ministry of construction to build the city (2004) no. 137 document issued a《About in real estate development project implementation of project construction contract guarantee certain rules (try out)》for each construction administrative departments of provinces, autonomous regions, municipalities in construction project contract cost is higher than 10 million yuan building, rebuilding and expansion of the real estate development project, enforce the tender guarantee, performance guarantee, the owner the payment guarantee, etc.In our country, gradually implement the guarantee system of construction project, to solve some existing problems in the field of construction project, improving construction project management system, integration of construction industry around the allocation of resources, optimization of construction industry's financial policy, improve the industry competitiveness of construction engineering company are helpful.Based on the earnest study of domestic and foreign research results, in full, on the basis of reading related literature both at home and abroad, books, using induction deduction, comparative analysis, case analysis and other methods, and combined with intuitive chart, guarantee system has carried on the detailed study of the construction engineering, understand the construction project guarantee basic concept, background, analysis of the meaning of the guarantee system of construction project, combined with the present situation of construction project in our country guarantee industry, the realistic condition, and implement the guarantee system of construction project, study of the origin of the guarantee system of construction projects at home and abroad, the pattern, the status quo, the respect such as assurance type, subject content, compares the contents of the guarantee system of construction projects at home and abroad, points out that the problem of the guarantee system of construction project in our country, combining withrelated cases, related suggestions are put forward.This article main conclusion: by analyzing the guarantee system of our country construction project contains content, combined with the implementation of the status quo, expanding construction project guarantee demand is put forward, and suggestions for the improvement of construction guarantee industry barriers to entry; To owner the payment guarantee and the problem of limited effectiveness, past the performance status of the owner units do detailed records, and evaluate the performance level, and evaluate the performance situation report submitted to the competent departments for the record; Through the guarantee system of construction projects related to our country legal research and study of government regulation policy, should be perfect laws related to the guarantee system of construction project and supporting measures, strengthen market supervision, to promote the construction of guarantee system of construction project; Through the construction project guarantee company investigation and study, to research and analyze its charge premium standard, points out the problems existing in the construction project guarantee company, put forward to improve construction project guarantee company specialized level, enhance staff professional quality; In addition, this paper also put forward from raising industry admittance threshold, promotion shortfall guarantee, perfect the system of the construction project guarantee fees, and other aspects of perfecting the guarantee system of construction project.
