This agreeme nt is valid from (________ Y ____ M ____ D)un til(Y _____ M _______ D)or termi nated by either party二、工作内容和工作时间Respo nsibility & worki ng hours1. 甲方聘请乙方担任 _______________ 职务,详见职务说明书。

Party B's position : ________________________ Please refer to the job description for details.2. 乙方须完成甲方安排的生产(工作)任务Party B must accomplish his/her regular work and additi onal assig nments on time3. 每天工作8小时,每周工作共48小时。

There are 8 work ing hours a day , 48 work ing hours a week.4. 甲方如因业务拓展变化需要对乙方的工作岗位及工作区域进行调整,乙方应当接受。

如因甲方公司业务扩展需要或公司合并分立等变更,乙方同意按照法律规定延续此合同,并接受甲方安排。

If Party A n eeds to make adjustme nts to Party B 'work positi on and work ing area due to bus in ess developme nt , Party B shall accept it. If Party A's bus in ess expa nsion n eeds or the compa ny's merger is split, etc., Party B agrees to continue this con tract in accorda nee with the law and accepts Party A's arran geme nts.三、工资Salary乙方每月的基本工资: ___________ (该金额尚未扣除税金、住房费用以及社会保险中个人应缴的部份),试用期满,经考核后,根据考核结果确定是否正式录用,正式录用后薪金保持不变。

公司保证该员工的月工资将不低于当地政府规定的最低工资。

Party B's monthly total revenue ( before the deduction of tax ,housing fund,social in sura nee paid by in dividual ) each month would be _____ ,After probation total revenue would be unchanged.The COMPANY shall ensure that the monthly salary of the EMPLOYEE is not less than the minimum pay standard set by the local government.四、工资的发放Payme nt甲方于每月_20_日前以货币的形式发放上月工资。

Party A will pay the employee's last mon th's salary in curre ncy before the 20_th day of each mon th.五、超时工作Over Time乙方应致力于提高工作效率,按时完成生产、工作任务,如因特殊情况需要加班详见《员工手册》。

Party B shall be committed to improvi ng work efficie ncy and complet ing work tasks on time. For details on overtime requireme nts for special cases, see the Employee Han dbook.六、假期与福利Holiday & Ben efits1. 有薪国家法定假日Statutory Holiday of PRC Chi na with pay2. 有薪婚假/产假/丧假Leave for Marriage ,Maternity and Mourning with pay.3. 有薪年假Annual leave with pay4. 社会保险Social In sura nee5. 年度奖金Annual bonus ( based on the mon ths worked with party A at the rate of one month ‘wage for each full year worked. )详情请参照《员工手册》Please refer to Party A's employee manual for detail info.七、劳动纪律Discipline乙方应严格遵守甲方制定的各项规章制度和劳动纪律(详请请参照《员工手册》执行)Party B shall strictly obey Party A regulati ons and discipli ne. Please refer to Party A's employee manu al.八、保密协议Confidentiality乙方需严格保守工作过程中接触和了解到的公司商业秘密(包括生产技巧、工艺流程、技术秘密、管理方法、产销策略、货源情报、设计图纸、成本价格和客户资料),否则将受到行政处罚(如无条件解雇、赔偿等);触犯刑法的,甲方将有权移交司法机关处理。

乙方调离甲方,应得到甲方同意,并将所有商业秘密资料移交甲方,同时承担不向外泄露的义务,并保证半年内不得利用甲方商业秘密在生产同类且与甲方有竞争关系的产品的其他企业内任职。

否则,甲方有权要求乙方赔偿因此而带来的一切经济损失。

The recipie nt shall un dertake the obligatio n to keep con fide ntial ,in accorda nee with the scope and durati on agreed upon by both parties ,the tech ni cal secrets contained in the tech no logy provided by the supplier ,which have not bee n made public.九、合同终止Termi nation1. 终止本合同条件Termin ati on con diti onsA. 试用期间,双方皆可即时通知对方解除本合同;Duri ng the probati on period ,either side can term in ate the con tract by immediate effect.B. 试用期满后,任何一方欲解除合同,须提前三十日以书面形式通知对方。

否则,违约方须向守约方支付违约金(违约金为乙方一个月的工资),若造成守约方经济损失的,应依法承担赔偿责任。

After a three-m onth trial period, any party wishi ng to resc ind the con tract must inform the other party in writte n 30 days in adva nee. Otherwise, the default ing party should pay breach of con tract damages to the observ ing party (the breach of con tract is Party B 'on e-m onth salary). If the breachi ng party causes econo mic losses, it shall be liable for compe nsati on accord ing to law.2. 甲方在下列情况下可随时直接地通知乙方解除本合同,无须履行任何法定义务和手续,无须向乙方补偿If any case of the following circumstances ,Party A has the right to inform Party B rescissi on of the con tract :A. 乙方在试用期间达不到甲方的要求;Party B ‘performanee can 'meet Party A s requirement.B. 乙方严重失职,给甲方利益造成重大损失的;The other party has breached the con tract ,to the exte nt that such breach has seriously affected the econo mic ben efits expected whe n con cludi ng the con tractC. 违反甲方有关规定,应予开除的,详情请参照《员工手册》执行。

The con diti on agreed on in the Party A's employee manual for rescissi on ofthe con tract has arise n3. 乙方在下列情况下终止本合同不需向甲方补偿If any one of the followi ng circumsta nces ,Party B has the right of i nform Party A rescissi on of the con tract without any compe nsatio nA.被非法限制人身自由的手段强迫劳动的;Party B is forced to work by illegal means.B.未按本合同约定支付劳动报酬或劳动条件的;Party B cannot get the salary or worki ng con diti ons which agreed in the con tract.十、甲、乙双方须共同遵守国家有关法规以及甲方《员工手册》的有关规^定OBoth Party A and Party B shall obey the related regulation of PRC China and Party A's employee manu al.十^一、本合同自甲方盖章、乙方签署之日起生效。
