Tenancy Agreement租约An Agreement made the day of , between the Landlord and the Tenant as more particularly described in Schedule I.此合约由业主及租客(双方资料详列于附表一) 于年月日订立:The Landlord shall let and the Tenant shall take the Premises for the Term and at the Rent as more particularly described in Schedule I and both parties agree to observe and perform the terms and conditions as follow:业主及租客双方以详列于附表一的租期及租金分别租出及租入详列于附表一的物业,并同意遵守及履行下列条款:1.The Tenant shall pay to the Landlord the Rent in advance on the first day of each and every calendar monthduring the Term. If the Tenant shall fail to pay the Rent within 7 days from the due date, the Landlord shall havethe right to institute appropriate action to recover the Rent and all costs, expenses and other outgoings so incurredby the Landlord in relation to such action shall be a debt owed by the Tenant to the Landlord and shall berecoverable in full by the Landlord.租客须在租期内每个月份第一天上期缴付指定的租金予业主。
倘租客于应缴租金之日的七天内仍未清付该租金,则业主有权采取适当行动追讨租客所欠的租金,而由此而引起的一切费用及开支将构成租客所欠业主的债项,业主将有权向租客一并追讨所欠款项全数。
2.The Tenant shall not make any alteration and / or additions to the Premises without prior written consent of theLandlord.租客在没有业主书面同意前,不得对该物业作任何改动及/ 或加建。
3.The Tenant shall not assign, transfer, sublet or part with the possession of the Premises or any part thereof to anyother person. This tenancy shall be personal to the Tenant named therein.租客不得转让、转租或分租该物业或其他任何部份或将该物业或其他任何部份的占用权让予任何其他人等。
此租约权益为租客个人拥有。
4.The Tenant shall comply with all ordinances, regulations and rules of Hong Kong and shall observe and performthe covenants, terms and conditions of the Deed of Mutual Covenant and Sub-Deed of Mutual Covenant (if any)relating to the Premises. The Tenant shall not contravene any negative or restrictive covenants contained in theGovernment Lease(s) under which the Premises are held from the Government.租客须遵守香港一干法律条例和规则及该物业所属的大厦有关的公契内的条款。
租客亦不可违反属该物业地段内的官批地契上的任何制约性条款。
5.The Tenant shall during the Term pay and discharge all charges in respect of water, electricity, gas and telephoneand other similar charges payable in respect of the Premises.租客须在租约期内清缴有关物业的水费、电费、煤气费、电话费及其他类似的杂费。
6.The Tenant shall during the Term keep the interior of the Premises in good and tenantable repair and condition(fair wear and tear and damage caused by inherent defects excepted) and shall deliver up vacant possession of thePremises in the same repair and condition on the expiration or sooner determination of this Agreement.租客须在租约期内保持物业内部的维修状态良好(自然损耗及因固有的缺陷所产生的损坏除外) 并须于租约期满或终止时将物业在同样维修状态下交吉回业主。
7.The Tenant shall pay to the Landlord the Security Deposit set out in Schedule I for the due observance andperformance of the terms and conditions herein contained and on his part to be observed and performed.Provided that there is no antecedent breach of any of the terms and conditions herein contained, the Landlordshall refund the Security Deposit to the Tenant without interest within 30 days from the date of delivery of vacantpossession of the Premises to the Landlord or settlement of any outstanding payment owed by the Tenant to theLandlord, whichever is later. If the Rent and/or any charges payable by the Tenant hereunder or any part thereofshall be unpaid for seven (7) days after the same shall become payable (whether legally demanded or not) or if theTenant shall commit a breach of any of the terms and conditions herein contained, it shall be lawful for theLandlord at any time thereafter to re-enter the Premises whereupon this Agreement shall absolutely determine andthe Landlord may deduct any loss or damage suffered by the Landlord as a result of the Tenant’s breach from theSecurity Deposit without prejudice to any other right of action or any remedy of the Landlord in respect of such breach of the Tenant.租客须交予业主保证金(金额如附表一所列)作为保证物业租客遵守及履行此租约上租客所需遵守的条款的按金。
若租客在租期内并无干犯此合约内任何条款,则业主须于收回交吉的物业或一切租客欠款后(以较迟者作准) 三十天内无息退还该保证金予租客。
但若租客拖欠根据此合约需要支付的租金及/ 或其他款项超过七天(无论有否以法律行动追讨) 或若租客违反此合约内任何条款,业主可合法收回该物业而此租约将立被终止;业主可从保证金内扣除因租客违约而令业主所受的损失,而此项权利将不会影响业主因租客违约而可采取的其他合法行动的权利。
8.Provided the Tenant shall have paid the Rent and other outgoings on the days and in the manner herein providedand observed and perform the terms and conditions herein contained and on the Tenant’s part to be observed and performed, the Tenant shall peacefully hold and enjoy the Premises during the Term without any interruption by the Landlord.若租客按时清缴租金和杂费及没有干犯此合约内任何条款,则业主不得在租约期内干扰租客享用该物业。
9.The Landlord shall keep and maintain the structural parts of the Premises including the main drains, pipes andcables in proper state of repair provided that the Landlord’s liability shall not be incurred unless and until writtennotice of any defect or want of repair has been given by the Tenant to the Landlord and the Landlord shall havefailed to take reasonable steps to repair and remedy the same after the lapse of a reasonable time from the date of service of such notice.业主须保养及适当维修物业内各主要结构部份(包括主要的排污渠、喉管和电线)。
