FIXTURE NOTE OF BULK COAL散装煤租船合同IT IS ON THIS DAY 5TH, JULY, 2011, THAT MUTUALLY AGREED AND CONFIRMED BY AND BETWEEN THESIGNATORIES BELOW ON THE FOLLOWING TERMS AND CONDITIONS: -即2011年7月5日起双方就租船事宜达成如下协议:1.-PERFORMING VESSEL:履行船舶如下:MV HUARUN 18船名: 华润 18号SD/ST/GRAB/BCBLT 2010 建造:2010年PRC FLAG 国旗:中华人民共和国CCS CLASS 中国船级57180 MDWT ON 12,50 M SSW TPC 60.4 载重:57180吨,吃水12.5米LOA/BEAM 199,90/32,26 长/宽: 199,90/32,26GT/NT 33547/18486GRAIN 71647.3 CBM5H/5H 5个舱,5个口4 X 30 MT CRANES, 4 X 12 CBM GRAB 4 X 30 MT船吊, 4 X 12 CBM 抓斗ADA WOG ( 译注:“ADA”(all details about),WOG without guarantee,即“上面所述指标信息还没有经过严格考证仅供参考), 是船东企图逃避严格保证的责任。
2.Owner:Huarun shipping limited 船东: 华润船务有限公司3.Chrts:租家:4.Cargo: 50000mt coal in bulk 10% moloo 货物: 50000吨散装煤炭10%增减由船东选择ycan:18th-28th july 2011 受载期:2011年7月18日-28日6.Loadding port:load port : 1sap (muara satui, south kalimantan( indonesia ),open sea装货港:一个安全锚地(muara satui, south kalimantan ( indonesia ),open sea Discharging port: 1sbp shanghai port ,china卸货港:中国厦门港,一个安全泊位 , 一个安全港。
7.Freight:USD14.00 / mt on fiost 1/1 basis运价14.00美金每吨,在一个装港泊位和一个卸港泊位的基础上,船东不负责装/卸费用及平舱,理舱费用。
7.1Charterer pay 30% of the frt bss 50000mt as deposit to owr’s nominated bank acct w/i one banking day after signing the fixture note在签合同后一个银行工作日内,租家需支付30%保证金基于50000吨到船东指定的账户。
7.2Charterer will pay all ocean freight(less deposit)within three banking days after vsl’s loading. The original B/Ls only be released to shipper upon receipt of all ocean freight租家在船装完后三个银行工作日以内支付全部运费(扣除保证金)。
收到全部运费以后,正本提单才可以放给发货人。
7.3 Freight deemed earned once cargo on board, non-returnable, non-deductable, whether cargo/vessel loss or not.一旦货物装船,无论货物灭失与否,运费认可不能返回,不能折扣。
8 Loading rate:8,000 mt pwwd shinc装率:8,000吨每晴天工作日,星期日,节假日包括在内。
(译注:PWWD 英文全称 Per Weather Working Day 中文解释每晴天工作日. SHINC 英文全称 Sundays and holidays included 中文解释星期日和假日包括在内合起来译,就是“包括星期日和假日在内的每晴天工作日 )Ddischarging rate:15,000 mt pwwd shinc卸率:15,000吨每晴天工作日,星期日,节假日包括在内。
9. Demurrage / despatch:USD15000Despatch half demurrage or pro-rata bends滞期和速谴:滞期费率为15,000美元每天,装卸港,速谴费率为滞期费率的一半,不足一天按比例计算。
10 Notice of readiness to be tendered all time day and night sundays and holidays included, upon the time vessel arrival at pilot station.在船舶到达引航站以后,装卸准备就绪通知书递交,包括夜班,星期天和节假日,无论是否靠泊,是否检疫。
10.1 Laytime at loading/discharge port shall commence to count 12hrs after nor tendered, unless loading sooner commenced. In which case the actual time used to count as laytime.装卸港起算时间:在准备通知书递交后12个小时开始起算。
如果装货提前开始,按照实际开始装货的时间计算。
10.2 Charterer guarantee that cargo and the documents must be readay for loading before vessel’s arrival and commence loading 72hours within vessel arrival loading port, if not commence loading within 72 hours of vessel arrival, charterer should pay Dem USD 15000 day every 3 days in advance, otherwise owner has right towithdraw the vessel with an notice by telex of fax, and owr have further rights to claim all the loss cuased by在船舶到港前,租家应在船舶抵达后的72小时以内装货,如果在船舶抵达的72小时以内没有装货,租家应每3天预付15,000美元/天的延滞费,否则船东有权以电传或传真形式撤销船舶并索赔一切损失。
10.3 Demmurage / despatch at loading port to be settled together with freight payment and the same at discharging port to be settled within 10 days after completion of discharging and against owner’s supporting documents such as notice of readiness /time sheet/statement of fact在装港的速谴和滞期费与运费一起结算,在卸货的等卸货完毕后10日以内结算,根据船东提供的装卸准备就绪通知书/事实时间记录。
11 Owner’s agents bends 船东指定两港代理。
12 Cargo to be released against original B/L,in the event of non-presentation of original bill of lading at discharge port owing to the delay of bill(s) sending ,owners will discharge the entire cargo against charters single letter of indemnity singed by chatterers and consigee altogether in accordance with owner’s p&i club wording with negotiation, the bill of loading will be sent to owner or owner’s agent within 15 days after completion of discharging放货需根据正本提单,如果在卸港正本提单延迟到达,船东应容许根据租家提供并签章保函的卸下全部货物,保函格式以船东提供的符合P&I的格式为准,正本提单在卸货完毕的15天内提供给船东或其代理人。
(译注:P&I指Protection and Indemnity Association 保赔协会)13.The owner guarantee vessel is equipped with good-condition gears and grabs for chtrs free used and sufficient facilities fully suitable for loading bulk cargo in holds and to provide sufficient lights as on board for night works and free use of which in good working conditions.船东保证船舶装备良好状态的船吊和抓斗完全符合在舱内装载散货,并且在甲板上提供充足的照明以便晚上作业,而且处于良好工作状态。
14.Vessel’s cargo holds shall be ready for loading before commencement of loading, if cargo holds are not ready for loading, laytime not count untill all holds ready.在船舶装货之前,船舱应处于准备就绪状态,如果没有准备就绪,不计入装货时间。
