合同协议
本合同签订与2008年1月7日，一方为Yyyyyyyyy（以下称为“业主“）另一方为Xxxxxxxxxx（以下称为“承包商”）。
鉴于业主希望承包商承接GEITA-USAGARA公路一合同段（GEITA至SENGEREMA段，全长50公里）设计加施工项目（合同号TRD/HQ/1020/2007/08)并已经接受了承包商递交的设计、执行、施工、完成和维修该项目并修复其缺陷的投标书。
双方达成如下协议：
1．本协议的单词和词组的解释分别与合同条件所赋予的解释相同；
2．下列文件构成本协议的一部分：
（1）中标通知书
（2）投标书和投标书附件
（3）承包商的投标书
（4）资格后审文件
（5）特别条款
（6）一般合同条件
（7）业主的要求
（8）技术规范
（9）承包商提供的最终设计图纸
（10）投标书附件中列出的其它文件
3．做为对业主付款的回报，承包商在此向业主保证将全方位的根据合同条款设计、执行、施工、完成、维护项目，修复任何缺陷。
4．业主向承包商保证将按照合同规定的次数和方式向承包商支付合同款或其它可能根据合同条款需要支付给承包商的费用用以执行和完成本项目以及修复缺陷。

Contrat
Le contrat a été signé le 7 janvier 2008, une partie est le chef de la direction de bureau d’infrastructures routières de Yyyyyyy(soit propriétaire ci-dessous), l’autre part ie est la XXxxxxxxxx(soit entrepreneur ci-dessous).
Vu q ue le propriétaire a confié à l’entrepreneur le projet de conception et de construction (dont le code de contrat est TRD/HQ/1020/2007/08) pour la section routière GEITA-USAGARA ( de GEITA àSENGEREMA, de longeur de 50 km au total), et a acceptél’acte de soumission de conception, exécution, construction, achèvement, et entretien, remise par l’entrepreneur.
Les deux partie s ont fait l’accord comme ci-dessous :

3. Comme la récompense pour le propriétaire, l’entrepreneur s’engage pour le
propriétaire, i ci, que la conception, l’exécution, la construction, l’achèvement, l’entretien de projet, et la restauration de tous les défauts s’effectueront en respectant les articles de contrat.
4. Le propriétaire s’engage que le frais de contrat, ou les autres frais necessairesment
payés à l’entrepreneur comformément au contrat seront payés en respectant la manière et la fréquence règlée selon le contrat, afin d’exécuter et achever ce projet, et de restaurer les défauts possibles.
